The Supreme Court rules that Joe Biden is commander-in-chief. Three justices dissent.

<div><img class="ff-og-image-inserted" src="https://cdn.vox-cdn.com/thumbor/rEq1v2c5-YcO_XMUfD__jLHjRkU=/0x0:5210x2728/fit-in/1200x630/cdn.vox-cdn.com/uploads/chorus_asset/file/23345862/1237979113.jpg" /></div> <p>The Supreme Court on Friday evening decided, no, it was not going to needlessly insert itself in the military chain of command above President Joe Biden.</p> <p>The Court’s decision in <a href="https://www.supremecourt.gov/opinions/21pdf/21a477_1bo2.pdf"><em>Austin v. U.S. Navy SEALs 1-26</em></a> largely halted a lower court order that permitted certain sailors to defy a direct order. A group of Navy special operations personnel sought an exemption from the Pentagon’s requirement that all active duty service members get vaccinated against Covid-19, claiming that they should receive a religious exemption.</p> <p>A majority of the Court effectively ruled that, yes, in fact, troops do have to follow orders, including an order to take a vaccine.</p> <p>The decision is undeniably a win for the balance of power between the executive branch and the judiciary that has prevailed for many decades. But the fact that the Court had to weigh in on this at all — not to mention that three justices, Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch, dissented from the majority — is a worrisome sign about America’s judiciary.</p> <p>As Justice Brett Kavanaugh explained in a brief opinion laying out why the lower court erred, this court “in effect inserted itself into the Navy’s chain of command, overriding military commanders’ professional military judgments.” Had the Court ruled the other way in <em>SEALs,</em> it would have effectively placed itself at the apex of the military’s chain of command, displacing Biden as commander-in-chief.</p> <p>But as Kavanaugh correctly notes in his concurring opinion, there is a long line of Supreme Court precedents establishing that courts should be exceedingly reluctant to interfere with military affairs.</p> <p>In <a href="https://scholar.google.com/scholar_case?case=16268127249131160503&hl=en&as_sdt=6&as_vis=1&oi=scholarr"><em>Gilligan v. Morgan</em></a> (1973), for example, the Court held that “the complex, subtle, and professional decisions as to the composition, training, equipping, and control of a military force are essentially professional military judgments,” and that “it is difficult to conceive of an area of governmental activity in which the courts have less competence.”</p> <p>Nevertheless, Judge Reed O’Connor, a notoriously partisan judge in Texas who is best known for a <a href="https://www.vox.com/2021/6/17/22538462/supreme-court-obamacare-california-texas-stephen-breyer-standing-individual-mandate-constitution">failed effort to repeal the Affordable Care Act</a>, ruled in favor of the service members who refused to follow a direct order. And the conservative United States Court of Appeals for the Fifth Circuit refused the Navy’s request to stay key parts of O’Connor’s order.</p> <p>That left the responsibility of restoring the military’s proper chain of command to the Supreme Court. Though the Court’s order does not wipe out O’Connor’s decision in its entirety, it temporarily blocks that decision “insofar as it precludes the Navy from considering respondents’ vaccination status in making deployment, assignment, and other operational decisions.”</p> <p>But the astonishing thing about the <em>SEALs</em> order is that the Supreme Court needed to intervene in this case at all.</p> <h3>Order prevailed, but several justices wanted to upend things</h3> <p>The most astonishing thing about the <em>SEALs</em> order is that at least three justices dissented. (While it is likely that six justices sided with the Navy here, only four justices — the three dissenters plus Kavanaugh — chose to reveal how they voted. So it is possible that one other justice silently dissented.)</p> <p>Thomas did not explain why he dissented, but Alito published a <a href="https://www.supremecourt.gov/opinions/21pdf/21a477_1bo2.pdf">brief opinion</a>, joined by Gorsuch, which lays out why he thinks that judges should be allowed to countermand orders handed down to military personnel by their commanders. Among other things, Alito complains that the Navy did not provide service members with a meaningful process they could use to request a religious exemption from the vaccination requirement.</p> <p>The Navy provided the Court with several statements from high-ranking officers explaining why it requires nearly every sailor to be vaccinated, and why it generally considers unvaccinated special warfare personnel undeployable.</p> <p>According to Adm. William Lescher, the Navy’s second-highest-ranking officer, Navy vessels have only limited medical facilities. So, if one of the ship’s crew becomes seriously ill, that “would require a return to port or an emergency medical evacuation by helicopter” — potentially forcing the whole ship to abandon its mission to accommodate one unvaccinated service member.</p> <p>Special warfare personnel, moreover, often deploy in very small units. So one member becoming sick is a big blow to the team. And, the <a href="https://www.supremecourt.gov/DocketPDF/21/21A477/217841/20220307123349362_21A%20Texas%20Navy%20SEALS%20stay%20app.pdf">Navy argued</a>, special operations “are often conducted in hostile, austere or diplomatically sensitive environments” where a severely ill service member might not be able to obtain local medical care and may need to be evacuated by the Navy — an operation that is itself dangerous and that could force the sick service member’s fellow sailors to risk their lives on his or her behalf.</p> <p>To these concerns, Alito essentially said, “Prove it.”</p> <p>“In order to win at trial,” Alito wrote in response to the Navy’s warnings, “it would not be enough for the Government to posit that sending an unvaccinated Seal on such a mission might produce such consequences.” Rather, the Navy would have to prove that requiring vaccination “is the least restrictive means of furthering the interest it asserts in light of the present nature of the pandemic, what is known about the spread of the virus and the effectiveness of the vaccines, prevalent practices, and the physical characteristics of Navy Seals and others in the Special Warfare community.”</p> <p>I want to emphasize the sheer enormity of what Alito is suggesting here. Once the Supreme Court permits a single servicemember to defy a direct order, that opens the door to any member of the armed services who disagrees with an order running to court to seek an exemption.</p> <p>Think of the kinds of orders that military personnel have to obey — “take that hill,” “guard this prisoner,” “cease fire.” And even if Alito did not intend for his dissent to apply to such battlefield orders, his dissent could effectively neutralize major military assets while religious liberty cases brought by service members are being litigated. Imagine, for example, if the captain of an aircraft carrier is ordered to deploy his ship close to Ukraine — but the captain refuses because, for religious reasons, that captain believes that Vladimir Putin should prevail in his war against Ukraine.</p> <p>The Court has understood for many decades that the military simply cannot function if its members think orders may be optional. As the Supreme Court held in <a href="https://www.law.cornell.edu/supremecourt/text/475/503"><em>Goldman v. Weinberger</em></a> (1986), “the essence of military service ‘is the subordination of the desires and interests of the individual to the needs of the service.’”</p> <p>Permitting service members to seek exemptions from the courts, <em>Goldman</em> explains, would undermine service members’ “habit of immediate compliance with military procedures and orders” — a habit that “must be virtually reflex with no time for debate or reflection.”</p> <p>At the end of the day, every service member must know who their commander is, and everyone must respect the chain of command. There can only be one person at the apex of that chain, and it can either be Joe Biden or Samuel Alito.</p> <p>And, as Kavanaugh notes in his opinion, the Constitution is very clear about who is at the top of that chain. Schools K-12 Adopting Race-Based Discipline Policies

<p><strong>The Clover Park School District in Pierce County, Washington recently voted to pass a new student discipline policy where the race of a student plays a role in the severity of their punishments.</strong></p> <p>Under the term “culturally responsive” student discipline, the district has set the precedent for racism to run rampant in public schools.</p> <p>As Harrison Smith of <em>The American Journal</em> noted on Friday, “This is Critical Race Theory. It’s just racism in a different form, it’s just racism to be used as a weapon against white people.”</p> <p>Radio host Jason Rantz joined Fox News on Thursday to discuss the divisive policy.</p> <p>Rantz told Fox host Stuart Varney that the Clover Park School District race-based discipline adoption is only the beginning of what is actually to become a statewide policy in Washington.</p> <p>Rantz said, <em>“When you’ve got a white kid and a black kid committing the same exact rule-breaking, the teacher or administration is supposed to look at that and say, ‘Okay, we have too many black kids or too many Latino kids or too many Asian kids who are getting disciplined versus the white kids. Why don’t we assume there is some sort of implicit bias going on here. Maybe we don’t understand what it’s like to be a black child or an Asian child, so let’s not give them the same punishment as we would give the white kids,’ which I think is condescending that because you’re black you might not know that assault is wrong or stealing in classroom is wrong but the white kid does. Poll: Majority of Democrats Would Flee the United States if it Was Invaded Like Ukraine

As Shoebat.com Has Been Warning For Years: Germany Is Reviving Its Military

Now — after years of <a href="https://shoebat.com/"><span class="s2">shoebat.com</span></a> warning about this — we are seeing this, and it has been accelerated by the war in Ukraine. I wanted to write about this immediately. But, I thought, why rush writing on this when there are so many articles warning about the rise of Germany on <a href="https://shoebat.com/"><span class="s2">shoebat.com</span></a>, going all the way back to early 2016? We have written so much on this that I wonder, why should this even be a surprise?</span></p> <p class="p1"><span class="s1">As we warned back in January of 2019: “Europe will be ripped apart by war, and we have already seen a bloody image of this in Ukraine.” Now we are seeing this presaging sign deepening. Further West, we see the Germans<span class="Apple-converted-space"> </span> — looking at the war in Ukraine — reviving their military. Just three days after the Russians launched their military operation, Chancellor Olaf Scholz <a href="https://www.npr.org/2022/03/22/1087859567/germany-military-buildup-russia-invasion-ukraine"><span class="s2">declared</span></a> in the Reichstag that Germany will invest more than 2% of its gross domestic product on its military. To the revival of militarism, the entire German parliament erupted in applause. In 2020 and 2021, we had covid, and in 2022, we have a war between Russia and Ukraine. The world is on a train that is traveling into a conflagration. But it is not as if this is something new. America was optimistic about the remilitarization of Germany after the First World War. And now, this same emptiness of wisdom — or the rejection thereof — is existent in the American psyche in the face of a reviving Germany. After all, was it not Donald Trump who was calling for the Germans to ‘pay their fair share’? Well, the Germans are doing what the MAGA president was demanding, but Trump is now worried about this and made the same warning that we have been making for years:</span></p> <p><span class="embed-youtube">[embedded content]</span></p> <p class="p1"><span class="s1">But, it is the war that has given the Germans the opportunity to revitalized its military. And this has been actually an ongoing trend in Germany for years. For <a href="https://shoebat.com/2017/12/18/the-coming-armageddon-how-we-are-going-to-repeat-world-war-one-and-world-war-two/"><span class="s2">example</span></a>, in 2017 Ulrike Merten, the president of Germany’s <em>Society for Security Policy</em>, stated that it was the Ukraine conflict in 2014 that really got the Germans to begin increasing military spending, and, she hoped, that this will lead to more recruitment into the military:</span></p> <blockquote readability="10"> <p class="p1"><span class="s1">“Only the Ukraine Crisis 2014 led to a rethinking and the admission that it is not the best with the Bundeswehr.… The most visible sign is certainly the significant increase in the defense budget by 8 percent in 2016. This should be started as a development that increases the number of combat vehicles again, the readiness of the material improves through better maintenance, through the ‘agenda attractiveness’ recruitment and staffing be relieved.”</span></p> </blockquote> <p class="p1"><span class="s1">So the Germans, for years, have been looking to the conflict in Ukraine as the reason for boosting military spending. And now that the conflict has escalated into a full-blown war between Ukraine and Russia, the Germans are looking to lead Europe as its military power. But Germany doesn’t just want to be the biggest military might in Europe, but wants to be so as a global power independent of America. The aspiration is the ending of the unipolar world of American global power, and the rise of a multipolar world, in which Germany can be the pole of power in Europe. In <i>Global Trends 2040</i> (a report based on US intelligence) it speaks of how by the 2040s the world will be “fragmented into several economic and security blocs of varying size and strength, centered on the United States, China, the EU, Russia, and a few regional powers, and focused on self-sufficiency, resiliency, and defense.” Who will lead this future European bloc? Germany will become the dominant power in the continent. “We can’t rely on the superpower of the United States” was a statement said by Angela Merkel. “We can no longer completely rely on the White House,” was another statement of this nature, this time coming from the German Foreign Minister, Heiko Maas. The Germans want to create an integrated pan-European military force, in which various military units would be under the command of the German armed forces. An idea of this nature was discussed years ago, in 2017, by retired German Lieutenant General Rainer Glatz, and Martin Zapfe, a German researcher and an infantry captain in the German army reserve, when they <a href="https://www.swp-berlin.org/publications/products/comments/2017C35_glt_zapfe.pdf"><span class="s2">wrote</span></a> a whole report for the leading lobbyist organization that has the ears of the German parliament, <i>the German Institute for International and Security Affairs</i>, in which they wrote on Germany’s formation of a military force integrated with units from other European countries. This concept was called by the EU, “Framework Nation Concept,” or “FNC”, and it was envisioned by Glatz and Zapfe as going beyond NATO:</span></p> <blockquote readability="13"> <p class="p1"><span class="s1">“With few exceptions, neither NATO nor the EU permanently control forces. That is no downside, however. Through its long-term focus on generating a pool of principally national forces rather than standing multinational units, the FNC might contribute to European security beyond the Atlantic Alliance. While FNC units may be assigned to NATO, the FNC’s “larger formations” remain under the sovereign control of the member states – and may thus also be deployed for EU operations, thereby contributing significantly to the EU’s capacity to act.”</span></p> </blockquote> <p class="p1"><span class="s1">While these German militarists speak about these units being “assigned to NATO,” they also describe this giant military machine as “beyond the Atlantic Alliance”, and thus independent of America’s security umbrella and under the eye of Germany. As Glatz and Zapfe wrote:</span></p> <blockquote readability="15"> <p class="p1"><span class="s1">“Finally, <b>it will need continuous German leadership</b> to fully realize the potential of the FNC and current Bundeswehr planning. This is not an empty argument. <b>Any lack of leadership by Berlin would likely turn the FNC’s strength – its flexibility as an initiative driven by the states – into a critical weakness.</b> In the MoD, and within NATO, the FNC has to be led with clear responsibilities and at high levels. As of today, the Bundeswehr’s plans as outlined above still float about at the lofty heights of ministerial concepts. Many questions remain open, and the Bundeswehr’s services are currently tasked with examining the manifold implications. Yet should Germany be willing to shoulder the longterm political, military, and financial costs associated with the Bundeswehr’s ambitious plans and the FNC – and should the German public support such a commitment – the MoD’s current course has the potential to leverage Germany’s capability planning for its European partners within and <b>beyond the Alliance</b> – especially in times of crisis.”</span></p> </blockquote> <p class="p1"><span class="s1">Reading between the lines, we can see here a plan that allows for Germany — in the right opportunity — to break free from the American security umbrella, thus shifting “beyond the Alliance” with an amalgamation of European military units under Germany, or really a German military machine with its European auxiliaries. In June of 2017, German security expert Claudia Major spoke of a plan in which weaker European countries — realizing their lack of security — must give up some of their independence to be under the protection of a German led military force:</span></p> <blockquote readability="11"> <p class="p1"><span class="s1">“It is about giving up the little sovereignty states have left in defense for a greater good: jointly building a larger European capacity to act, to successfully manage real-world problems. Yet, strengthening EU defense in this way requires states to recognize that they have become powerless to address today’s challenges on their own, and that almost all the security problems they face are effectively approached only through cooperation.”</span></p> </blockquote> <p class="p1"><span class="s1">This should give us an idea as to what we see transpiring: Europeans are looking to the East and seeing Russia flattening cities in Ukraine and, realizing that they can’t just rely on the US for their protection, will look to Germany as their defense. Now, we are not emphatically affirming that every European country will be under the German yoke, but rather that there will be a boost in popularity for the idea of a German led defense, and that many Europeans will want to be under Germany in the name of security. Major points out that “for Germany, the topic above all implies collective defense in the East” — what is the east? She is speaking of the eastern front: eastern Europe and Russia, the same areas that Germany wanted to conquer in both World Wars, the same areas that were really the bloodbath of both the Nazis and the Soviets. Barbara Kunz, writing for the German Marshall Fund, wrote in the think-tank’s 2018 publication: “It is about time to envision a world in which the United States no longer upholds the liberal international order. In both France and Germany, this idea is part of official discourses.” Germany reviving its military strength is not just about Russia and Ukraine, but also about revolting and breaking lose from American control. Annegret Bendiek, writing in 2018 in an article entitled, <em>The New ‘Europe of Security’</em>, affirmed that Brexit and Trump’s rhetoric is what<span class="Apple-converted-space"> </span> motivated the sudden enthusiasm for European militarism:</span></p> <blockquote readability="7"> <p class="p1"><span class="s1">“The imminent departure of the UK from the EU and Donald Trump’s unpredictability as President of the United States are the main motives for the EU to seriously address its discussed but undefined goal of ‘strategic autonomy’ in the EUGS from July 2016.”</span></p> </blockquote> <p class="p1"><span class="s1">The Germans, for years, have been wanting to be independent of the American security umbrella, and to lead their own military bloc. One of the signs of this independence was the German-Russian project of the Nord Stream 2 pipeline. For years, when Russia exported natural gas to Europe, it had to do so through Ukraine and thus pay billions of dollars in transit fees to the Ukrainians. With Nord Stream 2, Russia can export gas directly to Germany. The pipeline has been completed and only needs to go into operation (but thanks to the war this has been impeded). The US was, of course, upset with Germany for building a pipeline with NATO’s archenemy, Russia, and began imposing sanctions on all of the European companies involved with Nord Stream 2. There was a deep sense of consternation in Ukraine about the pipeline, since if Russia could export gas without having to pay Kiev, then the Ukrainians would lose their political leverage. In other words, with Nord Stream 2 in operation, Ukraine would lose its significance. It is not surprising, then, that Russia would invade Ukraine after the completion of Nord Stream 2. In 2017, Poland’s former Prime Minister Mateusz Morawiecki warned: “Once Nord Stream 2 is built, Putin can do with Ukraine whatever he wants, and then we have potentially his army on the eastern border of the EU.” <span class="Apple-converted-space"> </span>In 2006, Poland’s Defense Minister, Radek Sikorski, compared a pipeline deal between Germany and Russia to the Molotov-Ribbentrop deal in which the Third Reich and the Soviet Union agreed on controlling and annihilating Poland:</span></p> <blockquote readability="8"> <p class="p1"><span class="s1">“Poland has a particular sensitivity to corridors and deals above our head. That was the Locarno tradition, that was the Molotov-Ribbentrop tradition. That was the 20th century. We don’t want any repetition of that”</span></p> </blockquote> <p class="p1"><span class="s1">In Poland there is an actual fear of a Russian-German collaboration against Poland, which is a legitimate fear given the history (although I believe that, ultimately, Russia will be a force for good). Explosive Interview: New Docs Found On Hunter’s Laptop From Hell

<p><strong>An interview posted Wednesday contains shocking claims of new documents being found on one of Hunter Biden’s infamous laptops.</strong></p> <p>Appearing on “Real Talk With Mary Grace,” researcher and political activist <a href="https://gettr.com/user/jack_maxey" target="_blank" rel="noreferrer noopener">Jack Maxey</a> described how he came across the new information and what comes next.</p> <p>Maxey has had access to the laptop since he worked with Steve Bannon and Rudy Giuliani years ago.</p> <p>After becoming unsatisfied with the investigations done by some of the people and institutions the laptop has been shared with, Maxey decided to head to Switzerland for a complete forensic audit.</p> <p>“In the last three days, we found 450 gigabytes of erased material,” he told Mary Grace. “That would include hundreds of thousands of emails we didn’t know about, 80,000 plus images and videos we knew nothing about, thousands and thousands of documents. Ukraine Defense Ministry Publishes Video Game Footage Claiming It Shows Military Destroying Russian Helicopters

<p><strong>The official government Twitter account belonging to the Ukraine Ministry of Defense shared footage from a video game claiming it showed Ukrainian defenses shooting down Russian helicopters.</strong></p> <p>The latest footage, showing a clip from the 2015 <a rel="noreferrer noopener" href="https://en.wikipedia.org/wiki/ARMA_3" target="_blank">ArmA III</a> tactical shooter video game, briefly appeared on the Ministry’s Twitter account Thursday, prompting many to question why the Ukraine government would promote such blatant propaganda if it’s supposedly winning the war ‘It Makes No Sense’: American, United, Delta, Southwest Airline CEOs Demand Biden Drops Mask Mandate

<p><strong>The CEOs of several major airline and logistics companies issued a joint statement Wednesday asking the Biden administration to end federal mask mandates.</strong></p> <p>Noting how “much has changed” since Covid measures were implemented, the CEOs argued that, given the high rate of vaccination and declining infection and death rates, the administration should consider dropping the mask rule.</p> <p><strong>“Now is the time for the Administration to sunset federal transportation travel restrictions – including the international pre-departure testing requirement and the federal mask mandate – that are no longer aligned with the realities of the current epidemiological environment,”</strong> the corporate execs wrote in a letter disseminated by the Airlines for America trade association. [emphasis theirs]</p> <p>The CEOs note the pre-departure test requirement is extremely burdensome to US travelers and companies, and highlight the World Health Organization’s own admissions earlier this year that <strong>“the failure of travel restrictions introduced after the detection and reporting of Omicron variant to limit international spread of Omicron demonstrates the ineffectiveness of such measures over time.”</strong> [emphasis theirs]</p> <p>Addressing face masks, the letter says, “The science clearly supports lifting the mask mandate, as demonstrated by the recently released CDC framework indicating that 99 percent of the US population no longer need to wear masks indoors.”</p> <p>“Several studies completed <strong>before we had the added layer of widespread availability of vaccines</strong>… have concluded that an airplane cabin is one of the safest indoor environments due to the combination of highly filtered air and constant air flow coupled with the downward direction of the air,” they added. Frontline Doctor: Millions Will Get AIDS From COVID Vax By The Fall

<p><strong>A frontline doctor is warning that COVID-vaccinated patients she’s treating are showing signs of Acquired Immunodeficiency Syndrome (AIDS) as a result of taking the experimental mRNA injections, and that many more triple vaccinated individuals will likely contract the deadly disease by fall 2022.</strong></p> <p>Dr. Elizabeth Eads, a 25-year Florida physician of osteopathic medicine, told USA Watchdog’s Greg Hunter on Tuesday that the tripled vaxed are exhibiting signs of AIDS and that she and her colleagues are struggling to figure out how to treat them, as hydroxychloroquine, ivermectin, and other methods like anti-parasitics are having no positive effect.</p> <p>“Yes, we are seeing vaccine related acquired immunodeficiency in the hospital now from the triple vaxed…It is a vax injury, and we are not really certain how to treat this,” Eads said. </p> <p>“We are kind of throwing the kitchen sink at it…We are trying to use everything we can think of to boost up the CD4 and CD8 counts and reverse this collapse, this calamity of immune collapse. It’s very stunning.”</p> <p>Eads went on to explain that the more COVID shots the patients took, the worse their autoimmune and neurodegenerative symptoms appeared, describing the third dose as the “kill shot”:</p> <blockquote class="wp-block-quote" readability="23"> <p><em>The Kill Shot, the Money Ball or whatever you want to call it. It is just devastating to the immune system, and I’ll tell you why.  If you look at the recent Stanford study, and I am just going to read a couple of sentences from the Stanford study: ‘The spike protein in the CV19 vaccines that everyone is talking about is called the Lentivirus.  The Lenti contains a combination of HIV, types one through three, SRV/1, which is AIDS, MERS and SARS.’</em></p> <p><em>In the Stanford study, the best-known Lentivirus is the human immune deficiency pathogen, which causes AIDS. This is why we are seeing autoimmune and neurodegenerative decline after the Covid 19 (Vax), especially the booster…<strong>It permanently changes the genome of the cell. That is why this is so terrifying to us in the medical community. We just don’t know how to attack this</strong>.</em></p> </blockquote> <p>“That is what the Spike Lentivirus is.
