The big question surrounding 15-year-old Kamila Valieva is whether or not she’ll be allowed to skate in the Olympic women’s individual event.
The <a href="https://www.nytimes.com/2022/02/10/sports/olympics/kamila-valieva-trimetazidine.html">International Testing Agency (ITA) said</a> that Valieva, who helped the Russian women win the team event and became the first woman in history to land a quadruple jump at the Olympics, tested positive for trimetazidine, a banned heart medication that is purported to improve endurance. <a href="https://www.reuters.com/lifestyle/sports/figure-skating-russias-valieva-shows-up-practice-again-beijing-2022-02-11/">Russia</a> wants her to skate, claiming a misunderstanding and perhaps Western jealousy. The ITA and the World Anti-Doping Agency (WADA) will attend a hearing on behalf of the International Olympic Committee (IOC) to appeal Russia’s decision to let her skate. The International Skating Union (ISU) will determine medals and results <a href="https://ita.sport/news/beijing-2022-the-ita-informs-on-figure-skater-kamila-valieva/">after the hearing,</a> which will happen before Tuesday’s event.
Lost in the shadow of this news, perhaps, are other important questions: how a 15-year-old girl got the medication, and why she would feel like taking it was a good idea.
Valieva, along with her quad-landing teammates Alexandra Trusova and Anna Shcherbakova, all train with coach Eteri Tutberidze. Tutberidze is the single most dominant coach in women’s figure skating, as her girls — most of her skaters become champions before the age of 18 — have taken home Olympic golds and silvers, World Championships, European Championships, and international champions.
But amid all that success, none of Tutberidze’s champions have gone to multiple Olympics. They’ve retired, many citing injury, in four-year windows. Even more distressing is how there seems to be a pattern of abusive practices when it comes to diet restriction and over-training.
When the IOC, ISU, and Russia convene, they’ll decide Valieva’s future. But it would behoove them and the sport to look beyond the athlete in question and also focus on the adults in charge.
Tutberidze’s girls land jumps no other women in the world can do and are some of the most amazing skaters on the planet. But what’s the price they pay to become so?
The unfortunate truth about women’s figure skating is that puberty is seen as the enemy. Smaller, leaner skaters have an advantage because of the physics involved. Lighter skaters have an easier time getting up in the air; having less mass and being narrow allows them to spin faster (think of a pencil, spinning between your fingers). Because puberty tends to add weight, height, and more fat to a woman’s body, it’s not uncommon to see it adversely affect female skaters. We’ve seen that skaters can hit more difficult jumps before they hit puberty, and then lose those jumps as their bodies change. It’s not impossible for female skaters to regain those highly difficult jumps post-puberty, but they remain the exception rather than the norm.
The downside to this, as you might expect in any elite sport, is coaches and athletes will try to physically change athletes’ bodies to keep or obtain those advantages. Hence, women’s figure skating is a sport that’s peppered with athletes who have had <a href="https://www.huffpost.com/archive/ca/entry/figure-skating-eating-disorders_a_23359385">eating disorders</a> like bulimia and anorexia.

And some of those stories have come from Eteri Tutberidze’s former students.
Back in 2014, Yulia Lipnitskaya became one of the Olympic Games’ breakout stars when she won a gold medal at 15. She was known for her spins and incredible flexibility. After Sochi 2014, she had middling results and ended her career in 2017 while suffering from a knee injury. In September of that year, <a href="https://www.cbc.ca/sports/olympics/winter/figure-skating/olympic-champ-lipnitskaya-anorexia-1.4285781">she revealed</a> to the Russian press she had been suffering from anorexia for “not just for one year, or two, or three” years and sought treatment at a rehab center in Israel. At the time, there were <a href="https://aleteia.org/2017/12/29/a-troubling-trend-among-olympic-figure-skaters/">reports</a> that Lipnitskaya was encouraged by Tutberidze’s team to sustain herself through “<a href="https://www.aljazeera.com/features/2018/2/16/eating-disorders-the-dark-side-of-figure-skating">powdered nutrients</a>” to keep the weight off.
Lipnitskaya never made it to the 2018 Olympics, where Tutberidze’s dynamic duo of Alina Zagitova and Evgenia Medvedeva shined. Zagitova and Medvedeva combined for the silver in the team event, and then went gold and silver, respectively, in the women’s singles event. At the time, Zagitova was 15 and seemed like an improved version of Lipnitskaya who could land very difficult jumps. She nabbed a gold that year.
After the Olympics, she was asked in an interview with the Russian website, Sport Express, about her growth spurt and puberty. She told them that her and her coaches’ plan to deal with the changes of puberty was to restrict her diet.
“And in terms of puberty, when you become fat — it seems to me that these are all fictions. You just need to shut your mouth and don’t eat! Or at least a little. I eat, but in small quantities,” Zagitova <a href="https://www.sport-express.ru/figure-skating/news/alina-zagitova-pubertat-eto-vydumki-zakryt-rot-i-ne-est-1386749/">said</a>.
Granted, there might be nuances lost in translation. At the time, Zagitova was 15 and may not have chosen her words wisely. But this wasn’t the first time she talked about what sounds like, at best, a very restrictive diet and, at worst, an eating disorder.
In a 2019 interview with Russian Glamour, Zagitova explained that she and team Tutberidze restricted her food intake and that she abstained from drinking water. She essentially used water as a rinse. She <a href="https://deadspin.com/alina-zagitova-says-she-didnt-drink-water-during-the-20-1832459869">said</a>:

No, I don’t like chips. Well, perhaps it’s because I don’t eat them. I like sweets — chocolate, candy. Generally, I restricted myself during the Olympic Games. I was, you can say, not drinking water at all. That is, we just rinsed our mouths and spit it all out.
</blockquote>
In another 2019 interview, <a href="https://olympics.com/en/news/alina-zagitova-technical-artistic-quads-artistry">Zagitova lamented</a> that the game had passed her by, that she was too old (at 19) to hit quads, and that if she had any hope at landing one, she’d need to first lose weight. Zagitova has since retired from the sport.
Medvedeva, who was Zagitova’s main rival, had a career punctuated with back and foot injuries. She left Tutberidze after the Olympics to train in Canada with coach Brian Orser. Orser is known for coaching champions like Yuna Kim and Yuzuru Hanyu.
While in Canada, Medvedeva opened up about how the <a href="https://olympics.nbcsports.com/2018/10/09/yevgenia-medvedeva-on-coaching-change-moving-past-controversy-and-new-outlook-on-figure-skating/">training methods were different</a>, and how Orser’s club did not pit her against her rivals. In a <a href="https://www.fsuniverse.net/forum/threads/vaytsekhovskayas-interview-with-medvedeva.105441/">2019 interview</a> with the Russian site RSport, she explained how she had severely restricted her diet and was now working with a nutritionist with Orser. She seems to allude to the same calorie restriction and water weight that Zagitova references:

I understood that I should be as “dry” as possible. I weighed in Pyeongchang one and a half kilograms less than a year before the World Championships in Helsinki. It was a difficult period, but I had no other choice ... I didn’t have too many muscles then, and in this case the body retains water very much. You become heavy and “swollen.” Therefore, everything was really very tough and caused decent damage to the body. Now, fortunately, all these problems are in the past.

Medvedeva returned to Tutberidze in 2020 because of the pandemic. And in a <a href="https://www.youtube.com/watch?v=X8z00IP-hYc&t=379s">2021 interview</a> with Russian media, Tutberidze said that Medvedeva gained weight and blamed Orser and Medvedeva for her poor scores. <a href="https://www.instagram.com/p/CDTqWNoH-G-/?utm_source=ig_web_copy_link">Tutberidze hasn’t been afraid of lashing</a> out against Medvedeva and other skaters who have left her training academy. Often those skaters, like Medvedeva, return.
“So we did all we could for her under the circumstances,” Tutberidze said. In that same interview, she mentions that she trains her students 12 hours a day.
Medvedeva has since retired, <a href="https://fs-gossips.com/evgenia-medvedeva-i-had-my-first-love-it-ended-ugly-in-a-difficult-moment-right-after-the-olympics-he-told-me-in-plain-text-thank-you-i-dont-need-you-anymore/">citing permanent injuries to her back</a>. She can only turn it one way.
While Lipnitskaya, Zagitova, and Medvedeva are all retired now, the stories alluding to weight restriction and injury among Tutberidze’s current crop of students continue.
In a 2019 interview with <a href="https://youtu.be/S7DnYBFKypk">Russian sports channel Sport24</a>, Daniil Gleikhengauz, who choreographs at Tutberidze’s school, talked about Anna Shcherbakova. Shcherbakova is a favorite to medal this year. The interviewer talks about how she was amazed that Shcherbakova can eat “two shrimps” for dinner and be full.
Again, there could be nuances and humor lost in translation. The host is seemingly joking about Scherbakova’s appetite and willpower. But given Lipnitskaya’s history, Zagitova’s mentality about weight loss, and Medvedeva’s frank answers to the Russian press, the idea that Scherbakova severely restricts her diet doesn’t seem like a joke.
As former Olympic skaters, physicists, and experts explained to me earlier this month, skating is an incredibly taxing sport on the body. Hence the injuries that skaters power through to win. It’s even more terrifying to consider those injuries on the bodies of young girls who are extremely thin, severely restricting their diet, or in a scenario like Lipnitskaya’s, not eating at all.
Trusova and Scherbakova have reportedly been dealing with nagging injuries as they skate. Aliona Kostornaia, who was once seen as a lock for the Olympic team and medal threat, pulled out of the Russian Nationals this year due to an <a href="https://olympics.com/en/news/alena-kostornaia-russian-nationals-2021-injury">unspecified injury</a>. And <a href="https://www.youtube.com/watch?v=9To1STHs3lY">Daria Usacheva</a>, who is one of Tutberidze’s prized pupils and Russian junior champion, appeared to suffer a very painful and serious injury this past <a href="https://olympics.nbcsports.com/2021/11/12/nhk-trophy-results-figure-skating-short-program/">November</a>. Injuries are usually kept close to the vest in the Russian press.
Amid Valieva’s failed doping test and accounts of what sure seems like disordered eating and careers cut very short due to injury, it raises the question of what skating’s governing bodies are doing about this. The answer seems to be rewarding her.
In 2020, the International Skating Union awarded Tutberidze its “<a href="https://www.youtube.com/watch?v=_4wHHGsg8oo">best coach</a>.” And if you’ve been watching NBC’s figure skating coverage, commentator and former skater Johnny Weir has been — up until news of Valieva’s failed doping test broke — talking about spending time at her coaching facility and the splendid time he had getting to know Tutberidze and the girls. Weir posted on <a href="https://www.instagram.com/p/CWU-KdXsTDh/">Instagram</a> in <a href="https://www.instagram.com/p/CWREUlQsU9O/">November</a>, about how thankful he was to visit the school. In hindsight, these decisions haven’t aged well.

“If people start to look under the hood of what’s going on in Team Tutberidze, that might actually be positive for the sport because it would really shine a light on adolescent girls being abused physically, mentally, emotionally. And now pharmacologically, with these drugs,” said Dave Lease, who runs the skating analysis YouTube channel <a href="https://www.youtube.com/watch?v=QZdpUHkQvR0">The Skating Lesson</a>.
While he acknowledges that Tutberidze’s skaters are talented, Lease has been critical of Tutberidze on his show, specifically calling into question her training practices. He has spoken with guests about allegations of eating disorders and possible doping (prior to Valieva’s positive test). He says what’s happening at Tutberidze’s school is analogous to the abuse that happened at US Gymnastics and the Karolyis’ ranch. Saying that Tutberidze’s coaching practices are “abusive” has gotten Lease harangued in the Russian press.
“It doesn’t take a genius to realize that there’s something aberrant taking place with Tutberidze’s training methods as opposed to training methods around the rest of the world,” <a href="https://www.youtube.com/watch?v=_tKTKPuqWe8&feature=youtu.be">he said</a>. “I don’t think that any intelligent person who follows figure skating should be surprised. The clues have been there.”
The clues Lease refers to are accounts from former skaters, but also Russian press interviews about diets, the injuries from over-training, <a href="https://www.youtube.com/watch?v=CkKWAcuW2H8">interviews with coaches</a> about possible doping, and Russia’s history with state-sponsored doping.
Since the news broke, former skaters like <a href="https://twitter.com/AdamRippon/status/1492113667785211907?s=20&t=kwCn3bVtXqCzQuiyKNDsyQ">Adam Rippon</a> and <a href="https://www.instagram.com/p/CZzClsMA_EX/">Katarina Witt</a> have spoken out about holding Russia and the adults surrounding Valieva responsible. And in an interview with the <a href="https://www.20minutes.fr/sport/jo/3233787-20220211-jo-2022-quoi-ressemble-camp-entrainement-patineuse-russe-kamia-valieva">French newspaper 20 Minutes</a>, top ice dancing coach Romain Haguenauer said the result hadn’t surprised him. He said:

When Valieva’s name came out, I wouldn’t say people weren’t surprised, but let’s say it’s been stuff that’s been around for years. ... To see these kids between the ages of 12 and 15 doing quadruple jumps ... it’s true that there are always questions from the [jumps] specialists. I’m not one, but I know plenty of people who are and all of them have always been extremely surprised that it happened all of a sudden. Before Sochi, Russia did not shine in women’s skating. ... And then, all of a sudden, every year they bring out four new kids rocking quads.

One of the problems surrounding skating is that it goes mainstream once every four years, not unlike gymnastics. Mainstream interest peaks during the Olympics and wanes sharply after, so unless there’s something newsworthy that happens — like Valieva’s failed test — most viewers don’t follow the skaters or Tutberidze enough to know her or her skaters’ history. In Russia where these women are considered top athletes, Lease says, Tutberidze’s success outshines any criticism.
It’s also especially difficult for casual viewers to know about the controversies when you have NBC and commentators like Weir talking glowingly about the academy. For many devout skating fans, though, Tutberidze’s methods have been an open secret for years.
“I know many intelligent people who follow the sport and like to watch the sport, but maybe they aren’t completely immersed. And they prefer to watch skating and see these beautiful young skaters and be amazed and choose to look the other way,” he said. “Or they choose to not know, and not look too far into why they are so amazing.”

Joe Rogan further addressed the campaign to have him booted off Spotify and silenced Tuesday, labelling it a “political hit job” and stating that he doesn’t believe he should “apologize for nonsense.”
Speaking with fellow comedian and podcaster Akaash Singh about out of context edited videos of his old shows online, Rogan stated “You know, in a lot of ways, like, all this is a relief, because it’s like, just because that that video it always been out there. It’s like, this is a political hit job.”
“And so they’re taking all this stuff that I’ve ever said that’s wrong and smoosh it all together, but it’s good because it makes me address some sh*t that I really wish wasn’t out there.”
Singh chimed in, “You can apologize if you say some wild sh*t and we’ve also had some wild sh*t and you apologize and own that is wrong. Good for you.”
“You should apologize if you regret something,” Rogan responded, adding “This idea that you should never apologize, like if you regret something, I don’t think there’s anything wrong with apologizing.”
However, he added the caveat “I do think you have to be very careful to not apologize for nonsense.”
Rogan also noted that “If you stay offline it’s just real life. You just have to stay offline. You just, life goes on as normal.”

Rogan’s comments come after <a href="https://summit.news/2022/02/08/trump-tells-joe-rogan-to-stop-apologizing/">President Trump said the podcaster should stop apologising.</a>
“How many ways can you say you’re sorry? Joe,” Trump wrote in a statement, adding “just go about what you do so well and don’t let them make you look weak and frightened. That’s not you and it never will be!”
In an interview with <a href="https://www.foxnews.com/politics/ron-desantis-joe-rogan-controversies-distrust-media">Fox News</a> Florida governor Ron DeSantis also said Rogan should not have to apologise because the left is “out to destroy him.”
“No, he shouldn’t have apologized. I mean, you see what happens? The mob will come after people, and they’re targeting Rogan because he’s threatening to upset the apple cart on some of the things that they’re holding dear.” DeSantis said, urging Rogan “do not kowtow to the mob.”

In response to charges of racism against Rogan, conservative pundit, and former pro wrestler Tyrus delivered a powerful rant Tuesday, noting that he was at first pissed with Rogan after viewing the edited videos, but then quickly realised the entire debacle is an effort to create outrage to get Rogan silenced.
“Nobody cares what he said 12 years ago,” Tyrus roared, adding “Hell, you didn’t. Where were you then? I’ll wait for a response, but we know that will fall on deaf ears.”
“Maybe it’s time you stop using us African Americans to do your dirty work, and fight your battles,” he urged, adding “Now, I get it, you use your favorite little words to get us fired up: ‘racist, systemic, critical. And your new favorite word: misinformation. And that’ll get us fired up, we won’t even look at the facts or the whatnots, and we’ll just jump in and cancel away with you.”
Tyrus continued, “You were losing that conversation [about COVID], so you needed something else. And you went right to the good old Woke Playbook — but you went one too many times. How about this: fight Joe Rogan yourselves. Leave us out of it.”

Video: Elementary School Children Explode With Joy After Being Told They Don’t Need to Wear Masks Anymore

Video out of a school meeting in New York Tuesday shows a man being forcibly ejected by a security goon because he refused to put on a face mask.
The footage, obtained by <a href="https://www.facebook.com/watch/?v=539094107187543">ROC for Educational Freedom</a>, reveals the jackbooted thug grabbing the parent by his clothing and attempting to throw him out of the meeting.
The woman filming the incident is heard saying “What are you doing? What the f*ck are you doing? This is assault”
“Is this how you treat our children?” Another woman asks the goon, who is joined by two other security guards, adding “Do you put your hands on the children like that?”
The other parents can also be heard asking a police officer to do something about the heavy handed goons.
As they eject the man, the woman filming the incident tells the security personnel “you’re on video,” further noting “And he’s laughing. He’s laughing. You’re laughing. Yeah, f*ck you dude.”

Comments on the <a href="https://www.facebook.com/ROCforEdFreedom/">ROC for Educational Freedom Facebook Page</a> indicate that the man had to seek medical attention following the incident, with other parents noting how the school doesn’t allow people to speak about “hot issues” including masks in schools.
Parents at school board meetings across the country are <a href="https://summit.news/2022/02/04/video-virginia-mother-slams-school-officials-over-asinine-political-theater-mask-mandate/">expressing their concern</a>s over unconstitutional mask mandates.
The latest example <a href="https://patch.com/illinois/naperville/parents-speak-out-against-district-203-mask-requirement">came in Illinois</a>, where a father broke down in tears while speaking about his child being forced to put on a mask in school.
The father stated “I’m here for my daughter and beyond anything else she loves school,” adding “The last two years have been shameful as the district has been busy lauding themselves while they enact policies that have been absolutely devastating for her growth. We have seen two years of almost no growth. Missed goals. Goals removed.”
He continued, “My 10-year-old daughter has kept these feelings to herself about how much she desperately wants to take her mask off. When we told her maybe it will be possible on Monday she cried.”
He further described “This morning she got up and she started singing a song to her dolls about how excited she was that kids were going to be able to see her smile, that she was going to be able to see other kids smile. That kids would be able to understand her, snd she would stop being picked on because kids could not understand her through her mask because her speech has been delayed even more than her special needs.”
“It broke me. I will never forgive myself for not fighting more. I feel that I have failed her for not fighting more… You have failed them!” the impassioned father said.
Incredibly, in a blatant disregard of everything the parent had just said, a school official ordered everybody in the building to put on masks.

Among several bombshells dropped by Malone during the interview, the medical expert revealed that the owners of music streaming platform Spotify, where Rogan hosts his show, and vaccine maker Moderna are one in the same.

Republicans Introduce ‘HUNTER’ Act to Block Taxpayer Funds for Crack Pipes

A new bill introduced by two Republican congressmen labeled the Hunter Act aims to prevent the use of public money to fund a federal crack pipe distribution program.
On Friday, Rep. Lauren Boebert (R-Colo.) revealed she and Rep. Dan Bishop (R-N.C.) have put forth legislation to block the use of taxpayer funds for a <a href="https://www.infowars.com/posts/biden-admin-to-fund-crack-pipe-distribution-for-racial-equity/" target="_blank" rel="noreferrer noopener">$30 million HHS grant program</a> that would provide local governments with “smoking kits/supplies” to smoke crack cocaine.
“The federal government should NEVER be funding crack pipes with our hard-earned tax dollars,” Boebert tweeted Friday regarding the Halting the Use of Narcotics Through Effective Recovery Act, or “HUNTER” Act. “That’s why I’ve just introduced the HUNTER Act with @RepDanBishop. Enough craziness!”

The bill aims “To prohibit the use of Federal funds to purchase, or support the purchase of, drug paraphernalia,” adding that the term “paraphernalia” refers to “crack pipes, harm reduction vending machines, syringes, and safe smoking kits and supplies.”
The bill’s acronym – a nod to President Biden’s degenerate son “Hunter,” of whom embarrassing photos surfaced during the 2020 presidential campaign <a href="https://www.infowars.com/posts/hunter-in-sack-with-crack-shock-photos-show-biden-son-amid-drug-binge/">showing him smoking crack</a> – was not lost on Boebert.

During Friday’s address, Trudeau labeled the protest’s road blockades “illegal,” and threatened to suspend the licenses of protesting truckers.
“I want to make something very clear: the illegal blockades seeking to take our neighborhoods and our economy hostage and the collective coveted fatigue we’re facing are two very separate things,” he said.
“If you joined the protest because you’re tired of Covid, you now need to understand that you’re breaking laws.”
“The consequences are becoming more and more severe,” he said.
“You don’t want to end up losing your license, end up with a criminal record, which will impact your job, your livelihood, even your ability to travel internationally, including to the US.” 
The prime minister’s message was criticized on social media, with many labeling Trudeau a “tyrant” over his threats.

Though it’s unclear what precisely on the ground has actually changed, President Biden is urging all Americans in Ukraine to “leave now”. “American citizens should leave now,” <a href="https://www.nbcnews.com/politics/white-house/biden-warns-americans-leave-ukraine-russia-troops-world-war-rcna15781" target="_blank" rel="noreferrer noopener">Biden said</a> while discussing the Russian troop build-up threatening Ukraine in a new NBC News interview. 
The president warned that “things could go crazy quickly” in the region and so it’s necessary that US citizens initiate plans to depart the country immediately. He further described in the interview set to air in full later in the day, “It’s not like we’re dealing with a terrorist organization. We’re dealing with one of the largest armies in the world. It’s a very different situation and things could go crazy quickly.”
However, elsewhere in the interview he suggested that it’s anything but certain that President Putin has made his intentions clear. Biden told NBC that if if Putin “foolish enough to go in, he’s smart enough not to …do anything that would negatively impact on American citizens.”
Earlier this week the Pentagon revealed plans to <a href="https://www.zerohedge.com/geopolitical/white-house-authorizes-us-troops-poland-spearhead-ukraine-evacuation-plan">stage a logistics operation</a> along the Polish-Ukrainian border, just inside Poland, that would assist in any potential large-scale evacuation of US citizens from Ukraine in the event of a Russian invasion. Biden addressed the possibility <a href="https://www.cnn.com/2022/02/10/politics/biden-ukraine-things-could-go-crazy/index.html">further with NBC</a>:

Congress just passed an extremely important bill protecting victims of sexual misconduct

The Senate passed a significant bill on Thursday that effectively prevents employers, universities, and other institutions from immunizing themselves from lawsuits alleging sexual harassment or assault. The bill <a href="https://www.bloomberg.com/news/articles/2022-02-10/senate-passes-landmark-metoo-bill-to-ease-workplace-lawsuits">passed the House on Monday</a>, and President Joe Biden is expected to sign it into law.
The bill, known as the <a href="https://www.congress.gov/bill/117th-congress/house-bill/4445/text">Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act</a>, targets “forced arbitration,” a practice <a href="https://archive.thinkprogress.org/neil-gorsuch-lashes-out-at-american-workers-cfaf9930ddf1/">championed by Republicans on the Supreme Court</a>. Forced arbitration allows companies to shield themselves from lawsuits — and to shunt legal disputes into a privatized arbitration system that <a href="https://www.vox.com/2020/2/12/21133486/doordash-workers-10-million-forced-arbitration-class-action-supreme-court-backfired">overwhelmingly favors corporate parties</a>.
The new legislation provides that plaintiffs alleging sexual assault or sexual harassment may elect to have their dispute decided by a real court, even if they previously signed a forced arbitration agreement.
<a href="https://scholar.google.com/scholar_case?case=8345012189188610773&hl=en&as_sdt=6&as_vis=1&oi=scholarr">Employers</a>, <a href="https://www.marketwatch.com/story/chase-is-bringing-forced-arbitration-clauses-back-to-its-most-popular-credit-cards-2019-06-04">banks</a>, <a href="https://www.elderlawanswers.com/new-rule-once-again-allows-nursing-home-arbitration-agreements-17278">nursing homes</a>, and numerous other companies require their workers, customers, and patients to sign contracts containing a forced arbitration provision. Under these provisions, if a legal dispute arises between the company and its workers or consumers, the dispute will not be resolved in a real court. Instead, the case will be resolved by a private arbitrator — often one supplied by an arbitration provider that is chosen by the company that drafted the forced arbitration provision.
Data shows that <a href="https://www.vox.com/2020/2/12/21133486/doordash-workers-10-million-forced-arbitration-class-action-supreme-court-backfired">corporate parties are far more likely to prevail</a> before an arbiter, as compared to a court. And when non-corporate plaintiffs do prevail before an arbiter, they typically receive much less money than they would if their case had been litigated.
The Court’s Republicans often present forced arbitration cases as <a href="https://scholar.google.com/scholar_case?case=8345012189188610773&hl=en&as_sdt=6&as_vis=1&oi=scholarr">ordinary contract disputes</a>. As Neil Gorsuch argued in one of his first decisions as a justice, workers and companies both signed forced arbitration agreements, so they should both be bound by them.
But non-corporate parties rarely have the choice not to sign such an agreement. Many companies refuse to do business with anyone who doesn’t submit to forced arbitration. And the Supreme Court’s decision in <a href="https://scholar.google.com/scholar_case?case=8345012189188610773&hl=en&as_sdt=6&as_vis=1&oi=scholarr">Epic Systems v. Lewis</a> (2018) permits employers to order their employees to relinquish their right to sue the employer under pain of termination. The upshot of that decision is that employees can easily be forced into a situation where their options in a legal dispute are arbitration or nothing.
Interestingly, while the Supreme Court frequently <a href="https://archive.thinkprogress.org/justice-ginsburg-republican-colleagues-consent-39721c42421e/">splits along party lines</a> in forced arbitration cases — with Republican justices cheerleading the practice and Democratic justices dissenting — the new bill passed both houses of Congress with bipartisan support. The bill passed the House by a <a href="https://clerk.house.gov/Votes/202233">lopsided 335-97 vote margin</a>, with 113 Republicans joining all House Democrats. It passed the Senate in an <a href="https://www.bloomberg.com/news/articles/2022-02-10/senate-passes-landmark-metoo-bill-to-ease-workplace-lawsuits">unrecorded voice vote</a>.
Congress passed the Federal Arbitration Act of 1925, in the words of the late Justice Ruth Bader Ginsburg, to allow “<a href="https://supreme.justia.com/cases/federal/us/577/14-462/">merchants with relatively equal bargaining power</a>” to resolve disputes through private arbitration.
Arbitration is a benign and <a href="https://www.vox.com/2020/2/12/21133486/doordash-workers-10-million-forced-arbitration-class-action-supreme-court-backfired">even potentially beneficial practice</a> in disputes between parties with reasonably equal bargaining power — disputes between an employer and a labor union, for example, are commonly resolved through arbitration — because it can be quicker and less expensive than litigation. Merchants in specialized industries can also choose an arbitrator who is more familiar with their industry than most judges.
Starting in the 1980s, however, the Supreme Court started to read the Arbitration Act expansively to allow companies to require ordinary consumers and workers to submit to arbitration.
In recent decades, moreover, the Court frequently divided along party lines in cases involving arbitration. Often, the Court’s decisions expanding forced arbitration read the text of the Arbitration Act <a href="https://archive.thinkprogress.org/neil-gorsuch-lashes-out-at-american-workers-cfaf9930ddf1/">so implausibly</a> that it’s questionable whether the justices in the majority were acting in good faith.
To give just a couple of examples, the Arbitration Act explicitly exempts “<a href="https://scholar.google.com/scholar_case?case=13997435562158688431&hl=en&as_sdt=6&as_vis=1&oi=scholarr">workers engaged in foreign or interstate commerce</a>.” Yet in <a href="https://scholar.google.com/scholar_case?case=13997435562158688431&hl=en&as_sdt=6&as_vis=1&oi=scholarr">Circuit City v. Adams</a> (2001), a 5-4 Supreme Court held that nearly all workers engaged in foreign or interstate commerce may be forced into arbitration.
The Arbitration Act is also completely silent on the subject of class actions — a form of dispute resolution where multiple plaintiffs with similar claims join together in a single lawsuit. But in <a href="https://scholar.google.com/scholar_case?case=3870951188038012616&hl=en&as_sdt=6&as_vis=1&oi=scholarr">AT&T v. Concepcion</a> (2011), the Court voted along party lines to permit companies to insert a clause into arbitration contracts that also ban class actions.
These decisions are a windfall for corporate parties, and a significant blow to the rights of workers and consumers. A <a href="https://www.epi.org/publication/the-arbitration-epidemic/">2015 study</a> of forced arbitration in the workplace, for example, found that workers are <a href="https://www.epi.org/publication/mandatory-arbitration-unfairly-tilts-the-legal-system/?utm_content=buffer76362&utm_medium=social&utm_source=twitter.com&utm_campaign=buffer">significantly less likely to prevail before an arbiter</a> — as compared to a lawsuit heard by a real judge.

And when workers do prevail over their employer, they are typically awarded about a fifth as much money as a similarly situated worker whose case was heard by a court.
In any event, once Biden signs the new legislation into law, forced arbitration will no longer exist in cases alleging sexual harassment or assault.
The bill targets “<a href="https://www.congress.gov/bill/117th-congress/house-bill/4445/text">predispute arbitration agreement[s]</a>,” so the parties to a sexual harassment suit may agree after a dispute arises to submit the case to an arbitrator. But companies will no longer be able to use blanket forced arbitration contracts to immunize themselves from lawsuits for sexual misconduct.
That’s an important victory for workers and consumers — though also a fairly limited one. The overwhelming majority of legal disputes do not involve sexual assault or harassment; in the federal courts, for example, sexual harassment suits are typically styled as civil rights suits, but civil rights litigation made up <a href="https://www.uscourts.gov/statistics-reports/us-district-courts-judicial-business-2020">less than 10 percent</a> of the federal judicial docket in 2020.
So the new law will help workers. But decisions like Circuit City and Concepcion will continue to govern the overwhelming majority of disputes.

Promising to “give white America a black eye,” the documentary ‘Everything’s Gonna be All White’ premieres this Friday, but outraged commentators have already slammed its trailer as “racist anti-white propaganda.”
The trailer, which was released last Tuesday, opens with actress Amanda Seales declaring: “I think what annoys me most about white people is when they pretend that they’re the victim. What’s also annoying is when they, you know, when they kill us.”

From there, the trailer features black and minority academics and celebrities condemning white people for a variety of sins. “Whiteness” is defined as a form of “ignorance,” whites living today are blamed for their ancestors’ involvement in the slave trade, Civil War monuments are described as “mementos of racism,” and white people are portrayed as “the problem.”
According to a writeup on <a href="https://tvline.com/2022/02/08/everythings-gonna-be-all-white-amanda-seales-showtime-documentary/" target="_blank" rel="noreferrer noopener">TV Line</a>, the show also features “edifying interviews with comedic actress Margaret Cho, journalist Jemele Hill, author Ibram X. Kendi, historian Dr. Nick Estes, and rappers Roxanne Shante, Styles P and Willie D.” Of these names, Kendi’s is perhaps the most widely known, with the “antiracist” author a leading proponent of so-called ‘critical race theory’ in the US.

Autopsy Confirms College Student Died From “COVID-19 Vaccine-Related Myocarditis”

24-year-old New York college student George Watts Jr. died on October 27, 2021, due to complications related to the Pfizer Covid-19 shots he took in August and September.
Thanks to Corning Community College’s <a rel="noreferrer noopener" href="https://www.corning-cc.edu/student-life/health-office/immunization-requirements.php" target="_blank">mandatory vaccination policy</a>, Watts had to get an experimental Covid jab in order to attend classes in person.
<a rel="noreferrer noopener" href="https://www.rochesterfirst.com/news/regional-news/i-dont-know-what-else-to-do-or-where-to-even-go-from-here-covid-19-vaccine-to-blame-for-southern-tier-mans-death/" target="_blank">According to his parents</a>, George Jr. chose to receive the Pfizer “vaccine” because it had been recently given full FDA approval.
They also said he discovered blood in his urine after the first shot and felt flu-like symptoms that wouldn’t go away after the second jab.
“I noticed he was starting to get puffy in the face like a sinus issue… He had a cough and I decided to take him to the emergency room to see what was going on,” the boy’s father explained.
Next, the father took his son to the hospital twice within a couple of weeks to seek help for his illness only to be given antibiotics and told to go home.
George Jr. eventually began coughing up blood, and experienced pain in his feet, hands, and teeth, even becoming extremely sensitive to sunlight.
“I told him that I was going to take him to the emergency room the next day after I got out of work,” George Sr. said. “We never made that trip to the emergency room.”

The student was found collapsed in his room on October 27, 202, and was pronounced dead later on that morning.
After an autopsy was performed, the Bradford County Coroner’s Office revealed George Jr. died from “COVID-19 vaccine-related myocarditis.”
The county’s Chief Deputy Coroner Timothy Cahill Jr. said, “The cause of death is the COVID-19 vaccine-related myocarditis. We are currently working on other cases that are related to vaccine and booster-related issues within our county.”
“The manner of death was ruled as ‘natural,’” Cahill noted before explaining that myocarditis is what Watts died from, but that it was induced by the shot.
“So, the vaccine caused the heart to go into failure, caused an infection in the heart,” he said. “So, it means that it’s just of a natural cause. But, if it wasn’t for the vaccine, he wouldn’t more than likely be passed away right now.”
“I don’t know what else to do, or where to even go from here,” the grieving father said.
As Cahill noted by admitting Bradford County is dealing with other Covid vaccine-related deaths, this is not an isolated incident.
Last month, <a href="https://www.infowars.com/posts/pfizer-booster-listed-as-cause-of-death-in-26-year-olds-autopsy-death-certificate-after-work-mandated-jab/" target="_blank" rel="noreferrer noopener">Infowars reported on</a> a 26-year-old man named Joseph Keating who died from myocarditis after a Pfizer Covid-19 vaccine booster jab.
According to the certificate of death, Keating died from “multifocal myocarditis involving the left ventricle and septum,” with the second cause of death listed as “Recent Pfizer Covid-19 booster vaccine.”
In October of 2021, <a href="https://www.infowars.com/posts/sheriffs-office-attributes-california-teens-death-to-second-pfizer-jab/" target="_blank" rel="noreferrer noopener">Police in Sonoma County, California blamed Pfizer’s experimental mRNA jab</a> for causing the sudden death of a local teen.
The teenager’s death report states that after a postmortem examination was conducted by a forensic pathologist, “the cause of death was determined to be: ‘STRESS CARDIOMYOPATHY WITH PERIVASCULAR CORONARY ARTERY INFLAMMATION (hours to days), due to, UNKOWN ETIOLOGY IN SETTING OF RECENT PFIZER-BIONTECH COVID-19 VACCINATION (days).’” [emphasis theirs]

Bobsledding (or bobsleighing) is one of the oldest Olympic sports, dating back to the very first Winter Games in 1924. Back then, women were barred from competing in nearly every event except <a href="https://www.britannica.com/event/Chamonix-1924-Olympic-Winter-Games">figure skating</a>. Of the 250 athletes that arrived for the first Winter Olympics, only 11 were women.
Times have changed. The 2022 Winter Olympics in Beijing is considered the most gender-balanced to date, with female athletes making up <a href="https://olympics.com/ioc/news/women-at-the-olympic-winter-games-beijing-2022-all-you-need-to-know">45 percent of the roster</a>. But sexist regulations and outdated “science” still creep in. Who could forget the 2021 Tokyo Olympics, when the <a href="https://www.nytimes.com/2021/07/20/sports/norway-beach-handball-team.html?smid=tw-share">Norwegian handball team was fined</a> for refusing to wear bikinis? Or questionable testosterone tests that <a href="https://www.bbc.com/news/world-africa-57748135">barred female sprinters from competing</a> in an event?
As recently as 2008, the Winter Olympics was riddled with controversy over gender inclusion issues; female aerial skiers <a href="https://olympics.nbcsports.com/2022/01/17/ski-jumping-olympics-usa-women/">sued the Vancouver Organizing Committee</a> over alleged discrimination. In 2005, the president of the International Ski Federation stated that ski jumping “<a href="http://content.time.com/time/specials/packages/article/0,28804,1963484_1963490_1963447,00.html">seems not to be appropriate for ladies from a medical point of view</a>.”

As for bobsledding, it wasn’t <a href="https://olympics.com/en/beijing-2022/sports/bobsleigh/">until 2002</a> that female athletes were invited to participate in the Games, but only in a single event: the two-woman bob. Since 1932, men have had two events (the two-man and four-man bob). In 2022, a new all-women bobsledding event was introduced: the monobob, a single-woman sled. But is it actually leveling the playing field? Maybe, but not entirely in the way you might think.

Peloton’s problems aren’t just Peloton’s

Peloton is spiraling, and its downfall could be a harbinger of real trouble for an entire industry. The at-home digital exercise company is one of several that thrived during the pandemic and <a href="https://www.vox.com/the-goods/2018/11/14/18088390/peloton-hugh-jackman-spin-bikes-hydrow-tonal">promised</a> <a href="https://time.com/5839552/peloton-ceo-john-foley/">to</a> <a href="https://www.vox.com/ad/20976068/mirror-home-gym-fitness">change</a> forever how we work out. But now, it’s not clear if they’ll be around to finish <a href="https://www.vox.com/the-goods/2020/5/6/21241805/yoga-with-adriene-youtube-workout-at-home">the at-home fitness revolution</a> they started.
There’s no denying that the pandemic made working out at home extremely popular. After gyms were forced to close their doors, people canceled their memberships and invested in exercise equipment and online class subscriptions instead. So much so that companies like Peloton couldn’t keep up with demand, leaving many customers <a href="https://www.theverge.com/2021/2/5/22266121/peloton-shipping-delays-earnings-q4-2020">to wait months</a> for their bikes and treadmills to be delivered. But Covid-19 restrictions didn’t last forever. Eventually, when gyms started reopening, people stopped buying — <a href="https://www.wsj.com/articles/pandemics-peloton-obsession-turns-to-peloton-fatigue-11633097818">and using</a> — exercise equipment with the same enthusiasm they had in the spring of 2020.

This transition has been brutal for Peloton. Sales of new bikes <a href="https://www.washingtonpost.com/business/2021/11/05/peloton-sales-gym-memberships/">have slumped</a>, and people haven’t bought enough of the company’s newer products, which include <a href="https://www.onepeloton.com/tread?utm_source=Sailthru&utm_medium=email&utm_campaign=Recode%202.9.22&utm_term=Recode">two treadmill models</a> and <a href="https://www.onepeloton.com/shop/accessories/dumbbells">weights</a>, to make up the difference. After losing <a href="https://www.nytimes.com/2022/02/08/business/dealbook/peloton-ceo-sale.html">$439 million last quarter</a><a href="https://link.recode.net/click/26652173.43833/aHR0cHM6Ly93d3cubnl0aW1lcy5jb20vMjAyMi8wMi8wOC9idXNpbmVzcy9kZWFsYm9vay9wZWxvdG9uLWNlby1zYWxlLmh0bWw/608c6cd87e3ba002de9a4dcaC68ed54e5">,</a> Peloton <a href="https://www.cnbc.com/2022/01/20/peloton-to-pause-production-of-its-bikes-treadmills-as-demand-wanes.html">decided</a> in January that it would temporarily halt production of its bikes and treadmills to cut costs, <a href="https://www.cnbc.com/2022/01/20/peloton-to-pause-production-of-its-bikes-treadmills-as-demand-wanes.html">according to internal documents obtained by CNBC</a>. Then, on Tuesday, the company said that it would <a href="https://www.wsj.com/articles/peloton-ceo-john-foley-to-step-down-become-executive-chair-11644314403">lay off 2,800 people</a>, <a href="https://www.businessinsider.com/peloton-factory-ohio-scrap-plans-construction-bike-treadmill-john-foley-2022-2">cancel its plans for a new $400 million factory in Ohio</a>, and that its CEO, John Foley, would step down. Former Spotify CFO <a href="https://www.wsj.com/articles/peloton-ceo-john-foley-to-step-down-become-executive-chair-11644314403">Barry McCarthy</a> will take his place.
Many of the issues Peloton faced were specific to the company. Some investors had <a href="https://www.wsj.com/articles/activist-investor-to-call-on-peloton-to-fire-its-ceo-11642982211">argued</a> that Foley — who led the company for a decade — just wasn’t up to the task of scaling the company so quickly. Peloton also had a series of slip-ups, including supply chain problems, a <a href="https://www.consumerreports.org/home-product-recalls/peloton-tread-tread-plus-treadmills-recalled-serious-safety-hazards-a6638931886/">very public recall of its treadmills</a>, and a <a href="https://www.vox.com/the-goods/22895463/peloton-stock-price-bike-cost-production">controversial ad campaign</a>.
But Peloton’s demise also coincides with a trend in more people working out like they used to do: at gyms. Demand for in-person <a href="https://www.bostonglobe.com/2021/07/07/business/back-gym-fitness-classes-gym-memberships-rebound-after-pandemic-era-hiatus/">fitness classes and gym memberships</a> has rebounded, while Google searches for home gym equipment overall <a href="https://trends.google.com/trends/explore?date=today%205-y&geo=US&q=home%20Gym%20equipment">have continued to fall</a> since their high in March of 2020. Foot traffic to gyms has now returned to the same levels as January 2020, according to data from SafeGraph, a geospatial data company. Planet Fitness alone <a href="https://www.bloomberg.com/opinion/articles/2022-01-28/desperate-to-hit-the-gym-again-planet-fitness-is-thrilled-peloton-not-so-much">said</a> that, by November, it had recovered 15 million customers, which amounts to just half a million customers less than its pre-pandemic peak.
In the wake of the return to gyms, Peloton’s competitors are starting to see signs of trouble, too. Mirror is one of them. The company sells a <a href="https://www.nytimes.com/wirecutter/reviews/can-the-mirror-really-replicate-the-studio-fitness-class-experience/">$1,495 smart mirror</a> that streams virtual exercise classes on the surface of the device as you work out. Just a few months into the pandemic, Lululemon bought Mirror for <a href="https://www.nytimes.com/2020/06/29/business/lululemon-buys-mirror.html">$500 million</a> in a bid to capitalize on the big transition to at-home fitness. Over a year later, the athleisure brand has cut its estimated <a href="https://markets.businessinsider.com/news/stocks/4-lululemon-analysts-react-to-post-earnings-weakness-challenging-year-in-digital-fitness-1031042007">revenue expectations</a> for Mirror in half.
“As you know, 2021 has been a challenging year for digital fitness,” Lululemon CEO Calvin McDonald <a href="https://news.yahoo.com/lululemon-spent-500-million-high-131115205.html">told investors</a> in December. “We have seen increasing pressures on customer acquisition costs that are impacting the entire industry.”
Meanwhile, NordicTrack’s parent company, iFIT, announced that it would go public last September, but a month later, it delayed the move, citing “<a href="https://www.marketwatch.com/story/ifit-postpones-ipo-citing-adverse-market-conditions-2021-10-07">adverse market conditions</a>.” And Nautilus, which owns fitness brands like Bowflex and Schwinn, also <a href="https://sgbonline.com/nautilus-q3-revenues-decline-on-reduced-direct-sales-and-shipping-constraints/">reported late last year</a> that some of its products haven’t been selling as well as they did earlier in the pandemic, though many are still more popular than they were back in 2019.
It’s possible that Peloton could find a path forward if a larger company acquires it. But there are <a href="https://www.nytimes.com/2022/02/08/business/dealbook/peloton-ceo-sale.html">reasons to believe that won’t happen</a>, even with its new CEO. Some activist investors want a larger company to buy Peloton and have suggested <a href="https://markets.businessinsider.com/news/stocks/peloton-potential-buyers-blackwells-berkshire-hathaway-lululemon-nike-john-foley-2022-2">at least 19 possible candidates</a>, including Apple, Netflix, and Lululemon. But these companies may <a href="https://www.nytimes.com/2022/02/08/business/dealbook/peloton-ceo-sale.html">not be interested</a> in an expensive but niche fitness business. Apple, for instance, is already wary of buying more companies and catching the attention of antitrust regulations. Netflix isn’t in the device business, and the streaming giant has generally avoided fitness content. Lululemon already has Mirror.
But as Peloton searches for a buyer, plenty of other companies are building streaming platforms for fitness content that allow people to use any equipment they want — and for a lot less money. These services include <a href="https://www.youtube.com/watch?v=4fVFsbcXBkI">Apple’s Fitness+</a>, on-demand home workouts from <a href="https://classpass.com/try/home-workout-videos">ClassPass</a>, and millions of fitness videos on YouTube. These streaming options tend to make money through advertisements or low-cost monthly subscriptions without pushing people to buy specialized equipment.
Whether other companies will go the way of Peloton remains to be seen. Of course, this would hardly be the first time an at-home fitness fad has come and gone. Every generation of tech seems to come with its own spin on the home fitness revolution, from VHS aerobics to the exercise equipment sold on QVC. This time around, Peloton thought streaming and touchscreens would be the breakthrough to keep people hooked. Unfortunately for Peloton, the company may have just built another expensive clothing rack.
