Dr Sam White speaks to Dr Reiner Fuellmich & the Corona Investigative Committee

<p><strong>Since mid-July 2020, the Corona Committee has been conducting live, multi-hour sessions to investigate why federal and state governments imposed unprecedented restrictions as part of the Coronavirus response and what the consequences have been and still are for people, and in a video uploaded on the 2nd September they spoke with Dr Sam White.</strong></p> <p><a href="https://www.drsamwhite.com/">Dr Sam White</a> recently published a video that went viral on social media being viewed by over 1 million people. In it he said that “the vaccine programme has been rolled out in breach of the legal requirements for clinicians to obtain the free and informed consent of those being vaccinated,” and “the requirement to wear face coverings in an NHS setting is in breach of common law obligations not to cause harm and breaches statutory obligations in relation to provision of PPE”.</p> <p>Since the video went viral Dr Sam White was told on the 26th June 2021 that he was suspended with immediate effect from all work within the UK’s National Health Service (NHS). The reason given was due to the social media video he had made.</p> <p>However, a day later he received a phone call from a senior clinical advisor to NHS England who did not reference his social media video as the reason for his suspension but instead claimed he had been suspended due to having a “health problem”. Implying that it had been decided Dr Sam White must be mentally ill due to the claims he had made in the video.</p> <p>With the help of Philip Hyland Solicitors, Dr Sam White then sent a <span>l<a href="https://dailyexpose.co.uk/2021/07/02/nhs-doctor-sends-legal-letter-to-chief-exec-of-nhs-england-laying-out-unlawful-actions-by-nhs-executives-uk-government-sage-and-the-mhra/">etter addressed to the Chief Executive Officer of NHS England</a></span>Sir Simon Stevens. All of these concerns were raised during the revalidation appraisal process and overlap with what is in my client’s social media content.</p> <p>“The NHS took no action on either the substance of the concerns raised in my client’s appraisal nor did the NHS take any action against my client for raising those concerns during his appraisal. My client’s appraisal was signed off by the NHS Responsible Person. The same Responsible Person who later suspended my client. The NHS appear to have acted in the way they did because my client pointed out that there are a number of elephants in the room.”</p> <p>The letter makes several extremely serious accusations which you can read in full <a rel="noreferrer noopener" href="https://www.covid19assembly.org/speak-out/" target="_blank">here</a>.</p> <p>Dr Sam White recently attended a tribunal held by <a href="https://www.gmc-uk.org/about/what-we-do-and-why/our-mandate">the General Medical Council</a>, the regulatory body in the UK who decide which doctors are qualified to work in the UK and set standards that doctors must follow. The same regulatory body that have so far refused to investigate several <a href="https://dailyexpose.co.uk/2021/07/12/dr-hilary-dangerous-lies-and-big-pharma-ties/"><span>false claims made by Dr Hilary Jones</span></a> to millions of people on the TV show Good Morning Britain.</p> <p>The GMC did not consider any evidence in the tribunal claiming they were not there to do that, despite the viral video made by Dr Sam White being evidence based and supported by expert witnesses. The GMC decided to charge Dr Sam White with “quoting misinformation”.</p> <p>They then told Dr Sam White that he can no longer comment on any aspect of the pandemic via social media and placed restrictions on his practice for a further 18 months pending a full trial by the GMC., breaching his human right to freedom of speech.</p> <p>Rather than remain silent as instructed by the GMC, Dr Sam How Shang-Chi’s post-credits scenes shape the future of the MCU

To add even more to the mix, the movie also has two new post-credits scenes that seem to figure into the future of the MCU.</p> <p>The highly anticipated movie is considered by fans to be the official start of Marvel’s <a href="https://www.vox.com/2019/7/20/20699437/marvel-phase-4-schedule-black-widow-eternals-thor-4-doctor-strange-2">Phase 4</a>, the slate of films that directly follow 2019’s <a href="https://www.vox.com/culture/2019/4/23/18512851/avengers-endgame-review-marvel-miracle"><em>Avengers: Endgame</em></a>. <em>Endgame</em> capped off a decade of Marvel’s big-screen storytelling, marking the end of several long-running storylines and saying goodbye to some of the MCU’s best-known characters.</p> <p>Now, <em>Shang-Chi</em> has arrived to kick off the next era — no offense to 2019’s <a href="https://www.vox.com/2019/6/27/18760677/spider-man-far-from-home-review"><em>Spider-Man: Far From Home</em></a> or this summer’s long-delayed <a href="https://www.vox.com/22564986/black-widow-post-credits-scene-florence-pugh-hawkeye-future-mcu"><em>Black Widow</em></a>. The film is solely a Marvel property (unlike <em>Far From Home</em>, which was a Sony co-production) and it takes place in the MCU’s present (<em>Black Widow</em> is a prequel whose title character is dead in the present). The expectation has long been that <em>Shang-Chi</em> will push the MCU forward, story-wise.</p> <p>The film does make a lot of progress in that regard: It tells Shang-Chi’s origin story, shows us his procurement of the legendary weapons known as the ten rings, arranges a meeting between Shang-Chi and the mystic arts master Wong, and possibly extends an invitation for Shang-Chi to join the Avengers.</p> <p>Like nearly all of its cinematic cousins in Marvel’s back catalog, <em>Shang-Chi</em> also has two post-credits scenes. Historically, Marvel has deployed post-credits scenes as a way to tease upcoming films or possibly introduce new characters. <em>Shang-Chi</em> upholds that tradition by having its title character meet up with some familiar faces from other films and setting up what appears to be a future villain in the MCU.</p> <p><em>Shang-Chi</em>’s first post-credits scene actually plays mid-credits. It’s a continuation of the end of the movie where Shang-Chi and Katy accompany Wong to what appears to be the magic arts home base known as the <a href="https://marvelcinematicuniverse.fandom.com/wiki/New_York_Sanctum">New York Sanctum</a>. The scene picks up as Wong analyzes the ten rings and struggles to figure out their origin.</p> <p>Shang-Chi, Wong, and Katy consult Carol Danvers a.k.a. <a href="https://www.vox.com/2019/3/5/18250949/captain-marvel-review-movie-brie-larson-carol-danvers">Captain Marvel</a> and Bruce Banner a.k.a. the Hulk. Before zipping off to deal with an unspecified emergency, Danvers declares that the rings are not alien in origin; Banner isn’t sure what they are either. The conclusion the group comes to is that the rings are very old and very powerful. The group also determines that the rings are emitting some kind of signal or beacon, but no one knows who might be receiving it.</p> <p>There are a few little tidbits in the scene that eagle-eyed Marvel fans will notice right away. The first is that Bruce Banner has figured out how to revert to his human form. Back in <a href="https://www.vox.com/2019/4/26/18514287/avengers-endgame-ending-explained-spoiler"><em>Endgame</em></a>, Banner <a href="https://www.youtube.com/watch?v=q2A2oLMMXus&list=TLGGCvkWoTRAUoMyNjA4MjAyMQ">merged his Hulk form with his human form</a>, and at the time it sure seemed like the merge would be permanent.</p> <p>In <em>Shang-Chi</em>’s mid-credits scene, Banner appears fully human, and no one makes any mention of it. There’s no explanation of when he un-merged or how he did it. It’s unclear whether his human form is permanent or whether he can consciously switch between the two forms, but he’s clearly figured out how to get back to being human Bruce.</p> <p>Another tidbit is that Danvers now has much longer hair than the cropped ’do she wore the last time we saw her onscreen, in <em>Endgame</em>. Obviously, my first question is which intergalactic hairstylist she’s seeing; I would love to see that explored in a future movie. The more important takeaway, though, is that a fairly significant amount of time has passed. Her locks have grown out from a <a href="https://img.cinemablend.com/filter:scale/quill/8/3/e/9/5/4/83e9540e7e76943e0df2689b1fcfcc54efbe2602.jpg?fw=1200">shorter side part</a> in <em>Endgame</em>, such that they’re close to hitting the tops of her shoulders. That suggests a span of several months, at least, between the events of <em>Endgame</em> and <em>Shang-Chi</em>.</p> <p>Regarding the MCU’s chronology, the indication is that <em>Shang-Chi</em> is set in a post-<a href="https://www.vox.com/22315312/wandavision-finale-recap-credits-scenes-spoilers-explained"><em>WandaVision</em></a> and probably a post-<a href="https://www.vox.com/culture/2019/7/2/20653081/spider-man-far-from-home-2-post-credits-scenes-explained-spoilers"><em>Spider-Man: Far From Home</em></a> world, since the events of <em>WandaVision</em> take place a few weeks after <em>Endgame</em> and the events of <em>Far From Home</em> take place a few months after <em>Endgame</em>. Thus it’s pretty solid confirmation that <em>Shang-Chi</em> is situated well into a post-<em>Endgame</em> world. Recent MCU events like Wanda’s chaos on <em>WandaVision</em>, Spider-Man’s identity being revealed in <em>Far From Home</em>, and possibly even the multiverse hijinks of <em>Loki</em> have already occurred when Shang-Chi’s adventure begins.</p> <p>As for the rings being ancient weapons and what signal they might be emitting now, it seems like a pretty convenient potential link that the Eternals — immortal beings that have lived on Earth in secret for over 7,000 years — <a href="https://www.youtube.com/watch?v=0WVDKZJkGlY">have a movie coming out in November</a>.</p> <p>Finally, one of the most glaring tidbits in the scene concerns who <em>isn’t</em> present at the Sanctum, since the only Avengers we see are Danvers, Banner, and Wong. The Guardians of the Galaxy and Thor are absent, possibly off doing some space stuff. We also don’t see Okoye or any other representative from Wakanda.</p> <p>The biggest question mark, however, has to do with the whereabouts of Doctor Strange, who <em>lives</em> in Sanctum and would presumably be there to consult with Wong. Perhaps he’s out dealing with Wanda’s new multiverse-threatening powers (which were <a href="https://www.vox.com/22315312/wandavision-finale-recap-credits-scenes-spoilers-explained">revealed at the end of <em>WandaVision</em></a>) or maybe he’s helping Peter Parker navigate his identity crisis now that the world knows he is Spider-Man (Doctor Strange, or maybe someone masquerading as Doctor Strange, appears in the latest trailer for December’s <a href="https://www.youtube.com/watch?v=WgU7P6o-GkM">S<em>pider-Man: No Way Home</em></a>). Either way, given the setting of this <em>Shang-Chi</em> credits scene, Strange’s absence is very curious.</p> <p><em>Shang-Chi</em>’s second post-credits scene arrives after all the credits have rolled. Shang-Chi’s sister Xialing is packing up her room at her father’s secret base when her sidekick Jon Jon summons her. He tells her that everyone’s ready, and the scene segues into Xialing taking over her father’s army a.k.a the Ten Rings. There’s one wrinkle, however: Unlike her father, she is allowing girls to train to be part of the Ten Rings crime syndicate.</p> <p>Setting up Xialing to become the new commander of a vast, virtually unstoppable army probably doesn’t have major implications for the MCU or spell trouble for Shang-Chi. While she has the numbers and the person-power, Shang-Chi has the actual rings (even if it’s not yet fully clear what they can do).</p> <p>What’s more fascinating about this post-credits scene is the way it slots Xialing into a world where there are power grabs happening on Earth at the national and international level, as established earlier this year in Marvel’s Disney+ TV series <a href="https://www.vox.com/culture/22335323/falcon-and-the-winter-soldier-review-disney-plus-sebastian-stan-anthony-mackie"><em>The Falcon and the Winter Soldier</em></a><em>.</em> With the whole world in flux after the upheavals of <em>Avengers: Infinity War</em>’s Thanos snap and <em>Endgame</em>’s life-restoring Iron Man snap, Xialing’s control of the Ten Rings army now makes her one of the most powerful people on the planet.</p> <p>It will also be interesting to see how Xialing’s coup might affect Contessa Valentina Allegra de la Fontaine (Julia Louis-Dreyfus), the mysterious woman who first showed up in <em>The Falcon and the Winter Soldier</em> and then returned in <a href="https://www.vox.com/22564986/black-widow-post-credits-scene-florence-pugh-hawkeye-future-mcu"><em>Black Widow</em>’s post-credits scene</a>. The staggering implications of the Supreme Court’s anti-abortion ruling

<div><img class="ff-og-image-inserted" src="https://cdn.vox-cdn.com/thumbor/g6pHiU6gLJaPMykJKYo9zmkozqE=/0x173:2409x1434/fit-in/1200x630/cdn.vox-cdn.com/uploads/chorus_asset/file/22822771/1094227856.jpg" /></div> <p>At midnight on Wednesday, the Supreme Court allowed a Texas law that effectively <a href="https://www.vox.com/2021/8/31/22650303/supreme-court-abortion-texas-sb8-jackson-roe-wade-greg-abbott">bans all abortions after six weeks of pregnancy</a> to take effect.</p> <p>Twenty-four hours later, the Court released a <a href="https://www.supremecourt.gov/opinions/20pdf/21a24_8759.pdf">brief, one-paragraph order</a> explaining why it did so — though it is a stretch to describe the Court’s short and thinly reasoned order as an “explanation”. The vote in <em>Whole Woman’s Health v. Jackson</em> was 5-4, with conservative Chief Justice John Roberts crossing over to vote with the three liberal justices.</p> <p>The implications of this order are breathtaking. The Texas law violates the precedent established in <a href="https://www.law.cornell.edu/supremecourt/text/505/833"><em>Planned Parenthood v. Casey</em></a> (1992), which protects “the right of the woman to choose to have an abortion before viability and to obtain it without undue interference from the state.” The sixth week of gestation is so early in a pregnancy that many people <a href="https://www.vox.com/22444100/texas-bans-abortion-6-weeks-supreme-court">aren’t even aware they are pregnant</a>.</p> <p>At least <a href="https://www.supremecourt.gov/DocketPDF/21/21A24/189841/20210830120232143_WWH%20v%20Jackson%20-%20emergency%20application%20with%20appendix.pdf">85 percent of abortions in Texas</a> take place after the sixth week of pregnancy, according to the abortion providers who sued to block Texas’s law, SB 8. All of those abortions are now illegal in the state.</p> <p>But the implications of the Court’s decision in <em>Whole Woman’s Health</em> stretch further.</p> <p>SB 8 relies on a <a href="https://www.vox.com/2021/8/31/22650303/supreme-court-abortion-texas-sb8-jackson-roe-wade-greg-abbott">highly unusual enforcement mechanism</a>. No state officer is permitted to enforce the statute. Instead, the law permits “any person, other than an officer or employee of a state or local governmental entity in this state” to file a lawsuit against an abortion provider or anyone who “aids or abets the performance or inducement of an abortion.” A plaintiff who prevails in such a lawsuit is entitled to bounty of at least $10,000, paid by the person they sued.</p> <p>As Justice Sonia Sotomayor <a href="https://www.supremecourt.gov/opinions/20pdf/21a24_8759.pdf">explains in one of four</a> opinions filed by the dissenting justices, Texas lawmakers “fashioned this scheme because federal constitutional challenges to state laws ordinarily are brought against state officers who are in charge of enforcing the law.” So if no state officer can enforce the law, it is unclear whether anyone can be sued to block it.</p> <p>The Supreme Court’s order, joined by the five most conservative justices, effectively blesses this method of evading judicial review.</p> <p>But if Texas can avoid a court order blocking its anti-abortion law by delegating enforcement of the law to private bounty hunters, so can any other state. Casey</em> decision means that the constitutional right to an abortion is effectively dead. States now have the power to ban abortion for the first time since the <em>Roe v. Wade</em> ruling was handed down in 1973.</p> <p>While it is theoretically possible that the Court could reverse course in subsequent litigation and strike down SB 8, the sort of justices who would allow such a law to take effect are exceedingly unlikely to do so. And the Court is already planning to hear a case in its next term, <a href="https://www.scotusblog.com/case-files/cases/dobbs-v-jackson-womens-health-organization/"><em>Dobbs v. Jackson Women’s Health Organization</em></a>, which it can use to <a href="https://www.vox.com/2021/5/17/22233440/supreme-court-abortion-roe-wade-dobbs-jackson-womens-health-amy-coney-barrett">overrule <em>Roe</em> explicitly</a>.</p> <p>The right to an abortion was killed in a one-paragraph order in a case that arose on the Supreme Court’s “<a href="https://www.vox.com/2020/8/11/21356913/supreme-court-shadow-docket-jail-asylum-covid-immigrants-sonia-sotomayor-barnes-ahlman">shadow docket</a>,” a mix of emergency motions and other decisions that receive only cursory briefing and no oral argument. The justices took action after considering the case for <a href="https://www.supremecourt.gov/search.aspx?filename=/docket/docketfiles/html/public/21a24.html">less than three days</a>.</p> <p><em>Whole Woman’s Health,</em> in other words, is a sea change in the Court’s approach to not only abortion rights but also all other litigation.</p> <p>The Court has now signaled that it will permit states to enact laws that were intentionally drafted to frustrate judicial review, at least if a majority of the Court agrees with what that law is trying to accomplish. And it handed down one of the most monumental decisions of our era — a decision effectively overturning <em>Roe v. Wade</em> — in a shadow docket order that offers virtually no reasoning.</p> <p>The reason why SB 8 can only be enforced by private lawsuits brought by individuals who are not employed by the state of Texas is that this structure makes it very difficult to challenge the law in federal court.</p> <p>Under a doctrine known as “sovereign immunity,” private parties typically cannot sue states directly. In <a href="https://caselaw.findlaw.com/us-supreme-court/209/123.html"><em>Ex Parte Young</em></a> (1908), however, the Supreme Court held that a private party who wishes to block a state law may sue the state officer charged with enforcing that law. So, for example, if Texas had enacted a law permitting its attorney general to prosecute abortion providers, an abortion provider could sue the attorney general in federal court and seek a court order blocking that law.</p> <p>But SB 8 states that it “shall be <a href="https://legiscan.com/TX/text/SB8/2021">enforced exclusively through … private civil actions</a>.” State officers and employees are explicitly forbidden from enforcing the law. So, it’s not at all clear who the appropriate defendant is in a federal lawsuit attempting to block SB 8.</p> <p>It’s worth noting that, even after the Supreme Court’s decision that effectively endorses this method of dodging judicial review, abortion providers still have a way to challenge the state law. They can violate it, wait for someone to sue them, and then argue in that lawsuit that SB 8 is unconstitutional.</p> <p>But here’s the rub: Under SB 8, “any person” except for a state employee may bring a lawsuit against an abortion provider. That lawsuit may be filed in any number of different Texas state courts, including a trial court in the same county where the plaintiff resides (assuming the plaintiff lives in Texas).</p> <p>That means anyone who is even suspected of performing an abortion after the sixth week of pregnancy can be hauled into court at any time, in nearly any venue in the state, and potentially by hundreds or even thousands of different litigants. The abortion provider will then have to hire a lawyer and defend itself against all of those lawsuits. And if it loses just one, it will have to pay a bounty of “not less than $10,000 for each abortion that the defendant performed or induced in violation of this subchapter.”</p> <p>It’s worth emphasizing the words “not less than.” A judge with particularly strong anti-abortion views might award a bounty of $20,000, or $50,000, or $18 million.</p> <p>The law also subjects anyone who “aided or abetted” an abortion after the sixth week of pregnancy to similar penalties <strong>—</strong> a term that’s not defined in the statute but could be construed to endanger parties who have exceedingly loose ties to an abortion clinic. As NYU School of Law professor Melissa Murray recently noted, even an <a href="https://www.plannedparenthoodaction.org/blog/wtf-an-abortion-bounty-law-in-2021">Uber driver who gives a pregnant woman a ride to a clinic</a> may be vulnerable to suit.</p> <p>SB 8, in other words, is likely to subject abortion providers (and maybe even Uber drivers) to a blizzard of lawsuits that they cannot possibly afford to defend themselves against, even if they ultimately prevail in each case. And should an abortion provider lose even one case, they could face truly draconian financial sanctions.</p> <p>For these reasons, many abortion clinics in Texas have simply stopped providing abortions. As Justice Stephen Breyer notes in his dissenting opinion, “One of the clinic applicants has stated on its website that ‘[d]ue to Texas’ SB 8 law,’ it is ‘<a href="https://www.supremecourt.gov/opinions/20pdf/21a24_8759.pdf">unable to provide abortion procedures at this time</a>.’” Others may try to provide abortions prior to the sixth week of pregnancy, but they do so at tremendous risk.</p> <p>The law normally prevents situations like this by allowing a party who faces an imminent risk of legal harm to sue to block a law <a href="https://www.vox.com/2021/8/31/22650303/supreme-court-abortion-texas-sb8-jackson-roe-wade-greg-abbott">before it is brought to bear against them</a>. But, of course, SB 8 was drafted to frustrate such lawsuits. And the Supreme Court has now endorsed Texas’s effort to frustrate a pre-enforcement lawsuit.</p> <p>There is one potential flaw in Texas’s scheme to prevent anyone from challenging SB 8 before it took effect. The law is enforced by private parties bringing lawsuits wherein a Texas state judge may award bounties against abortion providers. But <em>state judges</em> are state officers charged with enforcing SB 8, which means they could conceivably be sued.</p> <p>And that’s exactly what the plaintiffs in <em>Whole Woman’s Health</em> did, adding a Texas judge and a Texas court clerk to the list of defendants in their lawsuit.</p> <p>One potential problem with this approach, however, is that suits against judges are typically disfavored — though they are <a href="https://scholar.google.com/scholar_case?case=4856877825507349419&hl=en&as_sdt=6&as_vis=1&oi=scholarr">not absolutely forbidden</a>. As the five most conservative justices correctly note in their <em>Whole Woman’s Health</em> order, it is <a href="https://www.supremecourt.gov/opinions/20pdf/21a24_8759.pdf">not entirely clear</a> whether “under existing precedent, this Court can issue an injunction against state judges asked to decide a lawsuit under Texas’s law.”</p> <p>Indeed, that is the crux of the majority’s reasoning in <em>Whole Woman’s Health</em>. It is unclear whether private suits against Texas judges are allowed, so it’s not appropriate for the Supreme Court to order those judges not to enforce SB 8.</p> <p>But here’s the thing: Yes, it is true that current Supreme Court precedent is unclear about when state court judges may be sued in federal court. But do you know who is allowed to issue binding decisions interpreting previous Supreme Court decisions? The Supreme Court of the United States. That’s the whole point of having a single Court at the apex of the nation’s judicial hierarchy: It can resolve novel legal questions that aren’t settled by existing court decisions.</p> <p>Moreover, while there is some uncertainty regarding when state judges can be sued, the Court’s decisions do suggest that a lawsuit should be permitted under the unusual facts presented by <em>Whole Woman’s Health</em>. In <a href="https://supreme.justia.com/cases/federal/us/407/225/"><em>Mitchum v. Foster</em></a> (1972), the Court explained that one of the federal judiciary’s roles is to “protect the people from unconstitutional action under color of state law, ‘whether that action be executive, legislative, or judicial.’” Federal court injunctions binding state officers are especially justified when deemed “essential to prevent great, immediate, and irreparable loss of a person’s constitutional rights.”</p> <p>Plus, all the doctrines that Texas relies on to frustrate judicial review — a rigid form of sovereign immunity, and the way to get around sovereign immunity laid out in <em>Young</em> — are judicially created doctrines than can be tweaked by the Supreme Court at any time. (Although the <a href="https://www.law.cornell.edu/constitution/amendmentxi">11th Amendment</a> does provide for some form of sovereign immunity, its text does not immunize Texas from suits filed by its own citizens.)</p> <p>One possible reason why the Court might not want to resolve this question right away is that <em>Whole Woman’s Health</em> arrived on its shadow docket. The question of when private plaintiffs may sue state court judges in federal court is a difficult one that the Court should probably think about for more than three days.</p> <p>But we are long past the point where the Court avoids resolving difficult legal questions in shadow docket orders. During the pandemic, the Court handed down a <a href="https://www.vox.com/2021/4/12/22379689/supreme-court-amy-coney-barrett-religion-california-tandon-newsom-first-amendment">pair of shadow docket decisions</a> that <a href="https://www.vox.com/2020/12/2/21726876/supreme-court-religious-liberty-revolutionary-roman-catholic-diocese-cuomo-amy-coney-barrett">completely revolutionized its approach to “religious liberty” cases</a>, severely limiting a seminal Supreme Court precedent in the process.</p> <p>Similarly, the Supreme Court on August 24 ignored decades of prior decisions warning that judges should be very cautious about interfering with American foreign policy, effectively <a href="https://www.vox.com/2021/8/24/22640424/supreme-court-remain-in-mexico-trump-biden-samuel-alito-immigration">ordering the Biden administration to open diplomatic negotiations</a> with Mexico to reinstate a Trump-era immigration policy that the new administration tried to end. This decision was also handed down on the shadow docket.</p> <p>The Roberts Court, in other words, is perfectly willing to make sweeping legal pronouncements in shadow docket orders when conservative litigants ask them to do so. But now that a group of litigants who are hated by conservatives asked the justices to hand down a similar order, the five most conservative justices insist upon judicial modesty.</p> <p>Moreover, had the Court wanted to take more time to weigh the question of when state court judges may be sued in federal court, the justices could have given themselves that time. As Roberts writes in his dissenting opinion, the Court should have <a href="https://www.supremecourt.gov/opinions/20pdf/21a24_8759.pdf">issued a temporary order</a> that will “preclude enforcement of S. B. 8” while this case makes its way through the ordinary litigation process rather than being rushed through in a shadow docket order.</p> <p>That way, the Court would avoid making a sweeping pronouncement about abortion rights — and about whether states can use clever procedural tricks to dodge litigation — without full briefing, oral argument, or more than a few days to consider the case.</p> <p>There’s also a profound practical reason why the Supreme Court should not bless laws like SB 8 — and why it almost certainly would not bless a similar law that applied to a topic other than abortion.</p> <p>Imagine, for example, that New York passed a law permitting “any person” to sue gun owners and collect a $10,000 bounty from those gun owners. Or, for that matter, imagine if a state allowed anyone to file a lawsuit against Justice Samuel Alito, seeking a $10,000 bounty every time Alito used the word “the.”</p> <p>Does anyone think this Supreme Court would rule that a law authorizing thousands of harassment suits against gun owners is <a href="https://www.vox.com/2021/4/26/22364154/supreme-court-guns-second-amendment-new-york-state-rifle-corlett-shootings-kavanaugh-barrett">compatible with the Second Amendment</a>? Or that it would force those gun owners to hire lawyers and litigate a seemingly endless stream of lawsuits to avoid paying a bounty?</p> <p>Similarly, does anyone think this Court would allow one of its own members to be bombarded with lawsuits whose sole purpose is to hound him and impoverish him with legal fees?</p> <p>With their decision in <em>Whole Woman’s Health</em>, the justices have unleashed a monster. If taken seriously, that decision would allow any state to subject any person or institution to an overwhelming wave of lawsuits that they cannot possibly defend against. SB 8 is a direct attack on the rule of law and the principle that everyone should have their day in court <em>before</em> they are punished by the state.</p> <p>It’s an attack on the 14th Amendment, which provides that no state may “<a href="https://www.law.cornell.edu/constitution/amendmentxiv">deprive any person of life, liberty, or property, without due process of law</a>.”</p> <p>But, of course, if a state were to target gun owners, or Alito, or anyone else the Supreme Court’s most conservative justices approve of, the Court would almost certainly step in to protect a conservative litigant. Just last month, in <a href="https://www.supremecourt.gov/opinions/20pdf/21a8_3fb4.pdf"><em>Chrysafis v. Marks</em></a>, the Supreme Court blocked part of New York state’s eviction moratorium because it “denies the landlord a hearing” before that landlord is required to house an unwanted tenant.</p> <p>The Supreme Court is quite protective of due process — when the right litigant seeks the Court’s protection. And other localities may soon follow suit: Honolulu will <a href="https://www.khon2.com/coronavirus/honolulu-mayor-to-detail-new-safe-access-oahu-program-that-would-implement-covid-vaccine-passports-for-restaurants-other-businesses/">institute a vaccine passport system</a> this month (patrons can also submit a recent negative Covid-19 test), while the Los Angeles City Council is <a href="https://www.foxla.com/news/business-owner-vaccine-passport-requirement-would-be-devastating-for-los-angeles">considering a similar program</a>. But these new proof of vaccination rules are already creating new problems for venues and workers, who have largely been left on their own to figure out how to enforce the requirements and how to respond when angry customers push back.</p> <p>It all fits into the bigger pattern of how the United States has handled the pandemic. The US rollout of different vaccination and mask requirements has been patchwork. The White House has said it will not establish a national vaccine passport system, meaning that states, cities, and even private companies have built their own versions of vaccine passport apps (while some states, like Florida, have banned vaccine passports entirely). This checkered approach means that despite <a href="https://www.vox.com/recode/22384340/vaccine-passport-vaccine-record-covid-19-clear-commonpass-excelsior-pass">the wide availability of vaccine record apps</a>, the only standardized way in the US to prove your vaccination status is <a href="https://www.vox.com/recode/22349266/vaccine-passports-vaccination-record-commpass-walmart-walgreens">the flimsy and easy-to-lose paper card</a> with the CDC insignia that doesn’t quite fit in the average person’s wallet.</p> <p>“A guy came in here and told the bartender, ‘I wanna see your hepatitis and your AIDS vaccine,’” Candace Hutchinson, a manager at Beachcorner Bar and Grill in New Orleans who often greets customers, told Recode. Business has been down at least a quarter since the New Orleans indoor vaccine mandate went into effect on <a href="https://www.restaurantdive.com/news/new-orleans-vaccine-mandate-for-indoor-dining-takes-effect/604996/">August 16</a>, another Beachcorner manager, Gina Perrett, told Recode, and some customers are rebelling. One customer recently threw a drink in an employee’s face over the new rules.</p> <p>One effect of these vaccine rules is that they seem to be incentivizing some people to get the vaccine. Last month, <a href="https://www.nola.com/entertainment_life/article_5373d668-0511-11ec-858b-2bffa745bfec.html">99 attendees</a> at a New Orleans Saints game got vaccinated on-site just so they could enter the arena. In some regions in Italy, <a href="https://www.politico.eu/article/italy-green-pass-bar-museum-restaurant-coronavirus-vaccine-appointments/">vaccination rates</a> surged as high as 200 percent after the country instituted its national Green Pass system, which requires that people present proof of vaccination to enter indoor venues like restaurants and museums, using either a digital or paper version of their vaccine record. And France, which recently began <a href="https://www.wsj.com/articles/france-italy-require-health-pass-restaurants-bars-11628587800">requiring proof of vaccination</a> for indoor and outdoor dining, domestic flights, and other indoor activities, has seen <a href="https://www.forbes.com/sites/roberthart/2021/07/27/explosion-in-vaccinations-and-protests-follow-health-pass-announcements-as-europe-cracks-down-on-vaccine-holdouts/?sh=6d159f1136bf">a similar boost in vaccinations</a>.</p> <p>But another effect of the new requirements is that they’ve thrust the responsibility of enforcing public health regulations on service workers, who throughout the pandemic have already had to deal with abuse from certain customers over temperature checks, mask-wearing, and social distancing. In fact, 80 percent of service workers <a href="https://onefairwage.site/wp-content/uploads/2020/11/OFW_COVID_WorkerExp_Emb-1.pdf">surveyed</a> by the group One Fair Wage last fall, which advocates against subminimum wages for tipped workers, said they saw or experienced hostility, including racism and sexual harassment, from customers while enforcing public health rules during the pandemic. That’s why some big retail chains that operate in areas without vaccine mandates are <a href="https://www.cnn.com/2021/08/09/business/vaccine-mandates-retail-customers/index.html">avoiding</a> requiring proof of vaccination for customers, according to a CNN report: They don’t have the infrastructure to check IDs and fear that enforcing such a requirement could lead to problems for workers.</p> <p>That leaves service workers with two bad options, One Fair Wage’s co-founder and president Saru Jayaraman told Recode. But it’s not just customers that workers have to worry about. After Jen Agg, the owner of Bar Vendetta in Toronto, called for vaccine requirements for indoor dining, her restaurant was flooded with anti-vaccine passport protesters who, she recently <a href="https://www.cbc.ca/radio/asithappens/as-it-happens-the-tuesday-edition-1.6151478/toronto-restaurateur-says-anti-vaccine-protesters-are-harassing-her-patrons-and-staff-1.6151550">told a radio station</a>, “harass my staff and yell at me, scream in my face that we’re Nazis.”</p> <p>At the same time, restaurant hosts and greeters aren’t necessarily prepared to check vaccine documents or identification cards (New York City, for example, is <a href="https://twitter.com/marklevinenyc/status/1428709749189750788?lang=en">requiring</a> that indoor venues confirm patrons’ state ID matches the name on their vaccine document). Melissa Fleischut, the president and CEO of the New York State Restaurant Association, told Recode that most of the 40 operators of restaurants she’s spoken with personally have said they’ve had confusion or problems enforcing the new vaccine rules for customers.</p> <p>Cities like New York and New Orleans have said they’re providing resources to restaurants and other venues that are meant to make enforcing vaccine passport systems easier, including grace periods before beginning enforcement and a <a href="https://www1.nyc.gov/site/oath/conflict-resolution/conflict-resolution.page">training video about conflict resolution</a>, but measures like these seem quite limited. For instance, Louisiana and New York State have released vaccine passport apps that produce QR-code-based vaccine records, an alternative to the CDC’s paper cards. While QR codes are meant to be scanned to be confirmed, several establishments told Recode that right now they’re just looking at the QR code on peoples’ phones and not actually scanning them into a separate verification app.</p> <p>“Who am I to say if [a vaccine card is] real or not?” asked Regina Delfino, who runs an Italian restaurant, Mario’s, in the Bronx. “Who am I to say you’re not Santa Claus?” She said she will be the one checking peoples’ vaccine documentation at the door when New York City starts enforcing its rules later this month; the other staff at the restaurant don’t want to ask. Even without the requirement that her staffers must check customers’ vaccine status, it’s already difficult to hire people, she added.</p> <p>And that highlights another problem that seems likely to arise: Some service workers may not want to enforce these new rules and deal with possible customer anger. Their employers will then have to figure out solutions on their own. As Vox’s Anna North <a href="https://www.vox.com/22455058/jobs-restaurants-office-employers-covid-pandemic-work">reported</a> this spring, many restaurants across the US have been struggling to hire enough workers to meet the return of customers. The reasons for this are varied — higher-than-usual unemployment pay has given workers more leverage in deciding where and when they’ll work; on top of that, frequently low wages and dangerous conditions in restaurants are deterring workers. Some venues in cities with the new vaccine mandates told Recode they’ve had to ask existing employees to work extra shifts, or even hired bouncers, to help check vaccine documents.</p> <p>“We have the worst staffing crisis in the history of the restaurant industry in the United States,” Jayaraman of One Fair Wage told Recode. “The idea of adding requirements without raising the wage is a disaster waiting to happen.” Advocates for restaurant workers have said part of the solution involves raising wages and <a href="https://www.vox.com/22455058/jobs-restaurants-office-employers-covid-pandemic-work">ending tipped minimum wages</a>, which allow restaurants to pay workers who take home tips a wage as low as $2.13 an hour.</p> <p>In the meantime, many restaurant workers are still in a double bind. Ensuring customers are vaccinated <a href="https://www.vox.com/22423098/covid-19-vaccine-coronavirus-protection-herd-immunity">stands to make their jobs safer</a>, but having to enforce these rules on their own has made their already hard job harder. How to think about hurricane recovery, according to 3 experts

<p>The remnants of <a href="https://www.vox.com/22648189/hurricane-ida-new-orleans-louisiana-flood-climate-change-covid">Hurricane Ida</a> reached the New York City area on Wednesday, battering the region with record rainfall that flooded streets, subways, and basements. New York and New Jersey declared states of emergency, and officials in the Northeast had reported <a href="https://www.nbcnews.com/news/weather/ida-batters-new-york-city-region-flood-emergency-issued-first-n1278336">more than two dozen deaths</a> as of Thursday afternoon. Ida, which made landfall in Louisiana on Sunday, tied for the <a href="https://apnews.com/article/hurricane-ida-115ff1a54e18d9eee61a81afa8df9fad">fifth-strongest</a> hurricane in US history and has been blamed for deaths <a href="https://www.usatoday.com/story/news/nation/2021/09/02/deadly-flooding-new-york-new-jersey-hurricane-ida-louisiana/5692877001/">across seven states</a>. In a time of worsening storms and sea-level rise, these conversations can’t be restricted to the Gulf Coast. “We’re talking about Staten Island as well,” he said. “We’re talking about the New Jersey coast. We’re talking about basically anyone who can drive to the water.”</p> <p>The history of disasters like Hurricane Katrina, Horowitz said, can help us understand America’s possible future — both its vulnerabilities and its path to recovery. He said the policy responses, from lifesaving <a href="https://www.vox.com/22598883/infrastructure-deal-bipartisan-bill-biden-manchin">investments in infrastructure</a> to <a href="https://www.nytimes.com/2021/08/31/opinion/hurricane-ida-climate-change.html">ambitious climate policies</a> that could eventually stabilize global temperatures, should be sweeping and swift.</p> <p>In the age of climate change, a livable future will depend not only on physical infrastructure but on social support systems and a disaster recovery process that is democratic and relentlessly focused on equity, experts told Vox. In the view of Khalil Shahyd, a Louisiana native and a senior policy adviser for equity and environment at the National Resources Defense Council, this process should prioritize people over property.</p> <p>Two days before Hurricane Ida made landfall in Louisiana, Horowitz taught a class called “The Climate Crisis.” Over video chat from his home in New Orleans, he asked his students to close their eyes and think about what the climate crisis meant to them.</p> <p>The exercise was supposed to be theoretical, but Horowitz found himself thinking about how his shirt was wet with sweat: He had spent the morning moving pieces of patio furniture so Hurricane Ida wouldn’t turn them into projectiles. He also thought about what he would be doing that afternoon: picking up his two young children, evacuating the city, and driving to a rental apartment in Birmingham, Alabama.</p> <div class="e-image__meta"><cite>Gerald Herbert/AP</cite></span></figure> </div> <p>The Gulf Coast of the US is vulnerable to deadly hurricanes like Katrina and Ida for a host of reasons, many of them man-made, as my colleagues Umair Irfan and Benji Jones <a href="https://www.vox.com/22648189/hurricane-ida-new-orleans-louisiana-flood-climate-change-covid">reported this week</a>. Ocean and air temperatures are rising because humans are burning fossil fuels, and rising temperatures can infuse storms with more energy and water vapor. The state’s oil and gas industry has contributed to a boom in low-lying waterfront construction, even as rising seas wash away parts of Louisiana’s coastline. Communities of color are often on the front lines.</p> <p>“There’s nothing natural or inevitable about those vulnerabilities,” Horowitz told Vox. Hurricanes should draw our attention to human choices, he said: our decisions about where to build, which communities can settle on high ground or behind levees, who should control shared resources such as power grids. (Louisiana’s private electricity provider, Entergy, suffered “<a href="https://www.nytimes.com/2021/08/30/us/new-orleans-power-outage.html">catastrophic transmission damage</a>” during Hurricane Ida that left a million people without power during a heat advisory; the company’s backup gas power plant, which was rammed through a local approval process <a href="https://thelensnola.org/2018/05/10/entergy-says-a-public-relations-firm-hired-people-to-speak-on-behalf-of-its-new-power-plant/">with help from paid actors</a>, <a href="https://www.nytimes.com/2021/08/30/business/energy-environment/hurricane-ida-entergy-power-outage.html">did not come to the rescue</a>.)</p> <p>As Shahyd watched the news last week that Hurricane Ida would strike New Orleans, he had flashbacks to watching from afar as Hurricane Katrina approached the city. “You just get this dread,” he said from Washington, DC. “Am I going to have to watch my city drown again?”</p> <p>Most of Shahyd’s family evacuated for Hurricane Ida, but one of his uncles stayed behind in a Morgan City mobile home, and one of his brothers stayed in Metairie because of another ongoing disaster — the Covid-19 pandemic. The brother quarantined at home because he worried that his son, who is 12 and vaccinated for Covid-19, had a breakthrough infection. “It could not have been worse timing for them,” Shahyd told me. “My brother was saying that he had never seen that much rain before in his life.”</p> <p>National disasters like Covid-19 and Hurricane Ida are “compounding crises,” said Allison Plyer, chief demographer at the Louisiana nonprofit The Data Center. “This is compounding trauma.” The difficulties are both psychological and practical: For many, 2021 has been another year of financial instability, Plyer added.</p> <p>Disasters are especially catastrophic when they’re mapped onto poverty and inequality, as was true for both Katrina and Ida. “The most important thing to being resilient in a disaster is some savings in the bank, so you can put gas in your car and maybe pay for a hotel room,” Plyer said. But more than a decade after the hurricane, <a href="https://www.democracynow.org/2015/8/27/new_orleans_after_katrina_inequality_soars">the problem had worsened</a>. Twenty-six percent of New Orleans households — and more than a third of Black households — had <a href="https://prosperitynow.org/files/PDFs/profiles/Racial_Wealth_Divide_in_New_Orleans_RWDI.pdf">zero net worth</a>, according to a 2016 report by the nonprofit Prosperity Now. The same report showed that the unemployment rate for Black households was three times the rate for white households. More than 31 percent of Black households earned below the poverty line — six times the rate for white households.</p> <p>Worsening inequity results in large part from nationwide policy choices, Plyer pointed out. “What drives inequity is federal policies, not local policies,” she said. “That acceleration of inequity, post-Katrina, was within a national context of accelerating inequity.”</p> <p>In a majority-Black city like New Orleans, inequity is closely linked to structural racism, Shahyd said. “The persistence, the maintenance, and the sustaining of poverty is the most egregious impact of racism,” with the exception of police killings, he said. “There’s no better representation of that fact than the city of New Orleans — a city that is so celebrated, a city that is so loved, a city that produces so much value, economically, spiritually, culturally. It’s dependent on the impoverishment of a great many of its people.”</p> <p>Hurricane Katrina helped reveal a pattern to American catastrophes: “Disasters accelerate pre-existing trends, and they also accelerate inequity,” Plyer said. Covid-19 has followed this trend, she said, and this summer’s disasters like Hurricane Ida probably will too — unless we collectively do something about it.</p> <p>In 2006, about a year after Hurricane Katrina, four researchers published a perspective in Proceedings of the National Academy of the Sciences that considered <a href="https://www.pnas.org/content/103/40/14653">60 years of New Orleans history</a>, ending with the aftermath of Hurricane Katrina. In New Orleans, the storm sped up population and income declines, the paper concluded — not least because federal support was devastatingly slow to arrive, and local recovery policies were mismanaged.</p> <p>The relief that did come was not shared equally. Santiago/Getty Images</cite></span></figure> <p>Shahyd added that developers and property owners had an outsized influence over the rebuilding of New Orleans: “If you’re not an owner of property, then you have no stake in or claim to much of the investments and resources that go into a post-disaster recovery.” He worries that this pattern could repeat itself after Hurricane Ida.</p> <p>“I think what I most fear will be similar is that again, we have this sort of forced evacuation and depopulation of the city,” Shahyd said. “While many of us are going to be thinking about recovery and restoration, and getting home, other people are going to see that rapid, forced depopulation as an opportunity to reimagine urban space.”</p> <p>Climate policy should be an integral part of recovery, he added. “Support for oil and gas is a bipartisan issue in Louisiana,” Shahyd pointed out. Democratic Louisiana Gov. John Bel Edwards has pledged reductions in fossil-fuel pollution, but he <a href="https://apnews.com/article/joe-biden-climate-climate-change-john-bel-edwards-gulf-of-mexico-9fd12aa0235073580c846582f7f43117">has also resisted</a> some of President Biden’s climate policies and <a href="https://www.vox.com/22543816/offshore-oil-gulf-mexico-democrats-climate-change">taken steps to protect fossil fuel industries</a>. (The governor’s office did not respond to a request for comment.)</p> <p>“Louisiana will continue to get hit with bigger and more frequent storms, and then require federal emergency declarations, and all these federal resources — all the while we’re still continuing to pump the oil, refine the gas, burn the fossil fuels as the dominant sector of our economy,” Shahyd said. “The state has to begin to take more responsibility.”</p> <p>When it comes to climate change, Horowitz added, “There is no policy solution under serious consideration in the US right now that risks being too big for the challenge.”</p> <p>Plyer lives in Louisiana, but she spent the week following the news of the storm from her sister’s house in New Jersey. On Wednesday, Ida reached her all the way from the Gulf of Mexico, and she spent the night mopping water out of a neighbor’s basement. At least one person died in the county where her sister lives.</p> <p>“The good news is that we have the technology now to really see these hurricanes coming,” Plyer said. “The bad news is that we haven’t made the investments in infrastructure and equity to ensure that our communities can be resilient in the face of these disasters.”</p> <p>For all the reasons for pessimism in American history, Plyer said, she did find one reason to be hopeful: “There’s a few examples of places hit by disasters that broke from their historical paths.”</p> <p>This process of changing the future depends on three things, she went on. First, communities should use the interruption in the status quo to transform key institutions. Second, they should take advantage of large recovery investments to strengthen those institutions. more of the US, from California to Louisiana to New Jersey, more places will grapple with climate change and try to recover from shocks in ways that build resilience. “The future is here,” Plyer said. “We have to prepare for climate change, and have the infrastructure and housing and systems of support that we need to adapt.”</p> <p>And as communities prepare for the worst and do their best to recover from disasters, they should empower local residents to make decisions themselves, Shahyd and Horowitz said.</p> <p>The value of a city like New Orleans, Shahyd said, “is not based on its real estate, but its people.” Recovering communities should elevate the voices of the most vulnerable residents, he said, and allow them to choose whether to return and rebuild or relocate. “If we organize people, then they will represent themselves.”</p> <p>“It seems most important to me that we have a relentless focus on the legitimacy of a democratic process that brings about those decisions,” Horowitz said. “People have to feel collective authorship of these decisions.”</p> <p>Disaster recovery and climate adaptation sound daunting, Horowitz went on, but they can also be hopeful. “When you think about what the solutions might be, they’re often phrased in frightening terms about displacement or retreat or people losing their jobs,” he said. “But in fact, the solution, the redress to the climate crisis, would build a more safe, secure, viable, livable, humane world.”</p> <br /> <br /> source <a
