How two competing cryptocurrency policies began a conversation on digital rights

Senate deliberations continued over the weekend over a <a href="https://www.epw.senate.gov/public/_cache/files/e/a/ea1eb2e4-56bd-45f1-a260-9d6ee951bc96/F8A7C77D69BE09151F210EB4DFE872CD.edw21a09.pdf">$1 trillion infrastructure bill</a>, with a particular focus on how the bill could impact the world of cryptocurrency. The infrastructure bill, known as HR 3684, allocates money to build roads, bridges, transportation systems, and support clean energy, among other developments. However, Portman’s was the second proposed amendment that dealt with this concern. The two competing amendments illuminate the concerns of those in the crypto space who are particularly unhappy with one key word in the tax provision: “broker.”
The bill identifies a “broker” as anyone “responsible for and regularly providing any service effectuating transfers of digital assets on behalf of another person,” and anyone thus identified would be subject to tax reporting requirements. That appears to include people like “<a href="https://www.investopedia.com/articles/forex/042015/why-governments-are-afraid-bitcoin.asp">miners</a>,” who use a “proof of work” system by solving algorithms with computers and software that, if correct, serve as verification for crypto transactions. Miners don’t have customers, so they wouldn’t be able to get access to the information necessary to complete a <a href="https://www.investopedia.com/financial-edge/0110/10-things-you-should-know-about-1099s.aspx">1099 tax form</a> — something the provision requires brokers submit. Brokers must also submit reports of any transactions over $10,000 to the Internal Revenue Service (IRS), which was already required of them before the bill was proposed.
Digital rights nonprofit the Electronic Frontier Foundation (EFF) believes such requirements are also an issue of privacy. “The mandate to collect names, addresses, and transactions of customers means almost every company even tangentially related to cryptocurrency may suddenly be forced to surveil their users,” the foundation wrote in a <a href="https://www.eff.org/deeplinks/2021/08/cryptocurrency-surveillance-provision-buried-infrastructure-bill-disaster-digital">statement issued last week</a>.
Cryptocurrency’s <a href="https://techcrunch.com/2021/08/06/crypto-biden-amendment-infrastructure-bill-proof-of-work/">decentralized financial system</a> and its <a href="https://www.euromoney.com/learning/blockchain-explained/what-is-blockchain">blockchain transactions</a> don’t tie information to an individual, but rather to the series of transactions that came before, thus cryptocurrency marketplaces do not easily allow for the collection and reporting of information on users. <a href="https://twitter.com/jack/status/1424219726838960131">Twitter CEO Jack Dorsey</a> weighed in on the current state of crypto discussions. “Forcing reporting rules on Americans who develop software and hardware, who mine and secure the network, or who run nodes to build resilience and efficiencies, is an impossible ask that will only drive development and operation of this critical technology outside the US,” tweeted Dorsey.

The tax provision has met pushback from other digital rights advocates, like the nonprofit <a href="https://www.fightforthefuture.org/actions/stop-the-senate-from-sneaking-through-total-surveillance-of-the-crypto-economy/">Fight for the Future</a>, which urged supporters to call senators and encourage lawmakers to reconsider the crypto regulations. “We feel strongly that policies that impact people’s basic civil liberties and people’s rights in the digital age should never be tacked on to legislation like an infrastructure bill,” Evan Greer, director of Fight for the Future, <a href="https://www.cnn.com/2021/08/07/politics/cryptocurrency-infrastructure-bill/index.html">told CNN</a>. Additional backlash came from cryptocurrency stakeholders like Square, Coinbase, and RibbitCapital, that were among a group of entities to sign onto <a href="https://twitter.com/CoinbaseNews/status/1423006893673353216?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1423006893673353216%7Ctwgr%5E%7Ctwcon%5Es1_&ref_url=https%3A%2F%2Ftechcrunch.com%2F2021%2F08%2F06%2Fcrypto-biden-amendment-infrastructure-bill-proof-of-work%2F">a joint letter</a> addressing the bill’s shortcomings and encouraging alternatives.
In response to the criticism, Sens. Cynthia Lummis (R-WY), Ron Wyden (D-OR), and Pat Toomey (R-PA) proposed <a href="https://www.finance.senate.gov/imo/media/doc/Wyden%20Lummis%20Toomey%20Crypto%20Amendment.pdf">an amendment</a> to the bill’s tax provision that would reinstate protections for individual investors. The amendment releases entities — including miners, software designers and protocol developers — from the need to report data that would be difficult or impossible for them to collect. Specifically, if passed, the amendment would exempt brokers from the following reporting requirements:

And then there’s the proposed amendment from Sens. Mark Warner (D-VA), Rob Portman (R-OH), and Kyrsten Sinema (D-AZ), which is also backed by the White House. However, it would maintain the reporting requirements for those using a “proof of stake” (PoS) system used by many altcoins (cryptocurrencies other than Bitcoin), which is less energy-intensive and gives mining power based on the <a href="https://www.investopedia.com/terms/p/proof-stake-pos.asp">percentage of coins</a> held by a miner.
Currently, only altcoins (any cryptocurrency other than Bitcoin) use PoS systems, which leaves their users at more of a disadvantage if the Warner-Portman-Sinema amendment were to be passed. From a legislative perspective, though, this option may be more attractive, and has more administration support.
White House press secretary <a href="https://www.whitehouse.gov/briefing-room/press-briefings/2021/08/06/press-briefing-by-press-secretary-jen-psaki-august-6-2021/">Jen Psaki praised</a> the Warner-Portman-Sinema amendment because the administration believes it “strikes the right balance and makes an important step forward in promoting tax compliance.” <a href="https://www.washingtonpost.com/politics/2021/08/06/crypto-bitcoin-infrastructure-senate/">Treasury Secretary Janet Yellen</a> spoke with lawmakers Thursday about concerns over the Wyden-Loomis-Toomey amendment, implying that they should instead support the Warner-Portman-Sinema amendment, according to the Washington Post.
This rift between supporters of the two amendments led to a more public rebuke of the Warner-Portman-Sinema amendment from one of the Wyden-Loomis-Toomey amendment’s authors. “While I appreciate that my colleagues and the White House have acknowledged their original crypto tax had flaws, the Warner-Portman amendment picks winners and losers based on the type of technology employed,” <a href="https://twitter.com/SenToomey/status/1423731811096670215">tweeted Toomey</a>. “The Warner-Portman plan exempts bitcoin miners, but not other transaction validators or software developers who create these platforms.”

Some experts believe the conflict over the amendments entirely misses the point of just how difficult it is to regulate cryptocurrency. <a href="https://www.coindesk.com/congress-dont-rush-regulating-crypto?amp=1&__twitter_impression=true">Writing for Coindesk</a>, Angela Walch, a research associate at the UCL Centre for Blockchain Technologies, recommended lawmakers treat cryptocurrency as a separate issue rather than lumping it into a major spending bill.
“Just because policymakers and regulators have allowed [the crypto financial system] to grow to its present state largely unchecked, does not mean that rapid-fire, piecemeal regulation is the best way to address the situation,” she wrote.
Talks are ongoing as the Senate works to pass an infrastructure bill that has already been <a href="https://www.vox.com/22553888/joe-biden-infrastructure-deal-bipartisanship-democrats-republicans">stymied in the past</a> by cross-partisan differences. Given the chorus of voices across the political spectrum speaking out about cryptocurrency, the infrastructure bill appears to be more of a beginning than the last word on the future of how the US tackles crypto.

A prolonged civil war in Afghanistan is more likely than a rapid Taliban takeover as the United States' full military withdrawal nears, Washington's former ambassador to Kabul said Sunday.
The insurgents have snatched five provincial capitals since Friday in a lightning offensive, almost a month before the 20th anniversary of the September 11 attacks that sparked the American-led invasion.
"A prolonged civil war is a more likely outcome than a swift Taliban takeover of the entire country. They're being very smart about this. They're not launching major strikes into Kabul," former US ambassador to Afghanistan, Ryan Crocker, told ABC's "This Week".
Kunduz, Sar-e-Pul and Taloqan in the north fell within hours of each other Sunday, lawmakers, security sources and residents in the cities confirmed.
Kunduz is the most significant Taliban gain since the insurgents launched an offensive in May as foreign forces began the final stages of their withdrawal.
It has been a perennial target for the Taliban, who briefly overran the city in 2015 and again in 2016 but never managed to hold it for long. 
"They're doing what they're doing in part to create a climate of fear and panic. They are succeeding wonderfully," Crocker added, referring to the Taliban.
The withdrawal of foreign forces is due to finish at the end of this month and Crocker said he could not see any circumstance under which the United States would send its troops back.
"President (Joe) Biden has made that clear. We're going out and are staying out," the diplomat added. "He owns it. It's already an indelible stain on his presidency."

The monstrous Dixie Fire in northern California continued to grow overnight, making it the second-largest wildfire in state history as thousands of people continued to flee advancing flames, authorities said Sunday.
As of early Sunday it had destroyed 463,477 acres (187,562 hectares), up from the previous day's 447,723 acres. It now covers an area larger than Los Angeles and roughly the size of the Hawaiian island of Maui.
The Dixie blaze is the largest active wildfire in the United States, but one of only 11 major wildfires in California.
Over the weekend it surpassed the 2018 Mendocino Complex Fire to make it the second-worst fire in state history, the authorities said. 
The blaze, which on Saturday left three firefighters injured, remained 21 percent contained Sunday, unchanged from the day before, the CalFire website reported.
Crews estimate the fire, which began July 13, will not finally be extinguished before August 20.
Weak winds and higher humidity were providing some succor to firefighters, but they are bracing for higher temperatures expected to exceed 100 degrees Fahrenheit (38 centigrade) by midweek.
Thousands of residents have fled the area, many finding temporary housing -- even living in tents -- in the area, often unsure whether their homes have survived.
On Saturday, the Plumas County sheriff's office said it had received descriptions of five people considered missing in Greenville and was searching for them.
Five other missing people were confirmed found on Saturday.
The Dixie Fire has already destroyed 404 structures -- gutting the historic town of Greenville -- and CalFire said workers were being deployed in an effort to save homes in the towns of Crescent Mills and Hunt valley.
More than 5,000 personnel are now battling the Dixie blaze.
By late July, the number of acres burned in California was up more than 250 percent from 2020 -- itself the worst year of wildfires in the state's modern history.
The state's eight largest wildfires have all come since December 2017.
A long-term drought that scientists say is driven by climate change has left much of the western United States and Canada parched -- and vulnerable to explosive and highly destructive fires.

A firefighting aircraft crashed in Greece on Sunday, but there were no casualties, the fire brigade told AFP.
The Pezetel aircraft crashed while tackling a blaze at the Ionian island of Zakynthos, in Western Greece. The pilot is safe and sound and was helped by other firefighters, the ANA news agency reported.
Firefighters and desperate locals Sunday battled raging wildfires on the Greek island of Evia that have charred vast areas of pine forest and forced hundreds of people to flee their homes.
"We have ahead of us another difficult evening, another difficult night," civil protection deputy minister Nikos Hardalias said. 
"On Evia we have two major fire fronts, one in the north and one in the south," Hardalias said, adding that strong winds were pushing the northern fire front towards beach villages.
Greece and Turkey have been battling devastating fires for nearly two weeks as the region suffered its worst heatwave in decades, which experts have linked to climate change.
So far, the fires have killed two people in Greece and eight in neighbouring Turkey, with dozens more hospitalised.
While rain brought some respite from the blazes in Turkey over the weekend, Greece continues to endure soaring temperatures.
In all, 17 firefighting aircraft -- planes and helicopters -- were fighting the fires on Evia, Greece's second largest island, Hardalias said.

Authorities in the central Chinese city of Wuhan on Sunday said they had completed citywide testing of more than 11 million people for Covid-19 after a resurgence of cases more than a year after the coronavirus first emerged there.
The tests -- which began on Tuesday -- provide "basically full coverage" of all residents in the city except for children under the age of six and students on their summer break, senior Wuhan official Li Tao told a press conference, according to the state-run Xinhua.
By Saturday, the city had recorded 37 locally transmitted Covid-19 cases and found 41 local asymptomatic carriers in the latest round of mass testing, Xinhua reported.
City officials announced last week that seven locally transmitted infections had been found among migrant workers in Wuhan, breaking a year-long streak without domestic cases after it squashed an initial outbreak with an unprecedented lockdown in early 2020.
Authorities said they quickly mobilised more than 28,000 health workers at around 2,800 sites for the testing campaign.
China brought domestic cases down to virtually zero after the coronavirus first emerged in the city in late 2019, allowing the economy to rebound and life to return largely to normal. 
But the fresh outbreak has thrown that record into jeopardy, as the fast-spreading Delta variant reaches dozens of cities after infections among airport cleaners in Nanjing sparked a chain of cases that have been reported across the country.
China has since confined the residents of entire cities to their homes, cut domestic transport links and rolled out mass testing as it battles the outbreak, its largest in months.
Beijing has also tightened overseas travel restrictions for its citizens as part of efforts to contain the rising cases.
China's immigration authority on Wednesday announced it would stop issuing ordinary passports and other documents needed for exiting the country in "non-essential and non-emergency" cases.
That does not yet mean a blanket overseas travel ban for the Chinese public.
