Britain on Wednesday demanded a new deal to oversee post-Brexit trade involving Northern Ireland and warned the European Union that London would be justified in unilaterally deviating from a deal it struck with the bloc just last year.
The Northern Ireland protocol was agreed by Britain and the European Union as part of a 2020 Brexit deal, finally sealed four years after British voters backed the divorce in a referendum.
It sought to get round the biggest conundrum of the divorce: how to protect the EU's single market but also avoid land borders between the British province and the Irish Republic, the presence of which politicians on all sides fear could fuel violence largely ended by a 1998 U.S.-brokered peace accord.
The protocol essentially required checks on goods between the British mainland and Northern Ireland, but these have proved burdensome to business and an anathema to "unionists" who are fiercely supportive of the province remaining part of the United Kingdom.
"We cannot go on as we are," Brexit minister David Frost told parliament.
He said there was justification for invoking Article 16 of the protocol which allowed either side to take unilateral action to dispense with its terms if there was an unexpected negative effect arising from the agreement.
"It is clear that the circumstances exist to justify the use of Article 16. Nevertheless ... we have concluded that is not the right moment to do so.
"We see an opportunity to proceed differently, to find a new path to seek to agree with the EU through negotiations, a new balance in our arrangements covering Northern Ireland, to the benefit of all."
Reuters exclusively reported on Monday that Britain was considering such a threat.
'New Balance'
Frost said Britain wanted a new "balance", detailed in a command paper, which meant governance of the accord was no longer policed by EU institutions and the European Court of Justice, and a "normal treaty framework" which was "more conducive to the sense of genuine and equitable partnership".
"These proposals will require significant change to the Northern Ireland protocol," Frost said. "We do not shy away from that, we believe such change is necessary to deal with the situation we now face.".
Even though customs officials have so far applied a light-touch approach to checking goods entering Northern Ireland from Britain under the protocol, major retailers have said they have struggled to cope with the situation and might need to shift supply chains from the United Kingdom to the EU.
Frost called for a "standstill period" which would maintain grace periods already in place with a freeze on existing legal actions.
Britain unilaterally extended a grace period for the implementation of full checks due to begin in March covering shipments of chilled meat products, and the EU later agreed this could be extended until the end of September to end a dispute dubbed the "sausage war".
The introduction of full customs checks could become incendiary one of country's biggest retailers Marks & Spencer said on Wednesday as they led to price rises and some products failed to get through due to paperwork checks.
M&S said it had struggled to get goods into Ireland and France since Britain formally left the EU's single market at the start of the year due to the amount of paperwork required, and Northern Ireland would suffer a similar fate.
"It's going to be very, very serious for customers," M&S chairman Archie Norman told BBC radio.
There has also been disturbances among unionist communities in Northern Ireland and pro-British paramilitary groups told Prime Minister Boris Johnson in March that they were temporarily withdrawing support for the peace agreement due to concerns over the Brexit deal.

Paris:
People wanting to go to cinemas, museums or sports matches in France have to prove they have had a Covid-19 vaccination or a recent negative test from Wednesday as the country rolls out its controversial vaccine passport system in the face of surging new cases.
The so-called "health pass" will be required for all events or places with more than 50 people, before being extended to restaurants, cafes and large shopping centres in August.
The government, which is set to formalise the system with legislation being debated in parliament, is hoping to curb a fourth wave of infections and encourage people to get vaccinated.
Health Minister Olivier Veran warned Tuesday that the more infectious Delta variant was causing an unprecedented increase in new infections, which were up 150 percent over a week at 18,000 in the previous 24 hours.
President Emmanuel Macron met with top ministers Wednesday to discuss the health crisis, and Prime Minister Jean Castex was due to speak on television afterwards.
With most new cases among unvaccinated young people, the health pass is designed to encourage them to protect themselves with a jab and avoid a new nationwide lockdown that would affect the whole population.
But is has faced criticism, even from lawmakers in Macron's Republic on the Move (LREM) party, for allegedly restricting the civil liberties of the unvaccinated and for requiring venues to check the identities of their patrons.
Locations that fail to check the credentials of their customers will face fines of up to 1,500 euros ($1,700) for a first-time offence, and more for subsequent violations.
At the Eiffel Tower in Paris, tests were being offered to visitors who did not have vaccination proof.
"Protecting public health has been our priority since March 2020, but it has not threatened the cohesion of our country because the rules were the same for everyone," LREM lawmaker Pacome Rupin said on Tuesday.
"The health pass is going to fracture our country. It's a major change for our society," he said.
Jordan Bardella, vice president of the far-right National Rally, criticised the system as a "model of surveillance by everyone of everyone".
Other fringe critics, particularly on the far right, have accused Macron of turning France into a "health dictatorship," and 114,000 rallied against the measures around the country in protests on Saturday.
Striking a balance
The changes introduced on Wednesday were implemented by decree, but lawmakers are set to vote on legislation that will extend the system next month to restaurants, as well as trains or planes for long-distance travel.
From September, vaccinations will also be mandatory for healthcare and retirement home workers, many of whom have been wary or dismissive of the shots.
The debate started on Wednesday, with a vote expected at the end of the week at the earliest.
"We are vigilant. We need to find a balance between restricting freedom of movement and making sure we protect the health of our citizens," senior LREM lawmaker Yael Braun-Pivet told the France 2 channel on Wednesday.
With admissions to intensive care low but trending upwards, the head of the AP-HP public hospital network in the Paris region, Martin Hirsch, warned Wednesday that "the wave faced by hospitals could be the same size as previous ones."
Other measures to contain the surge in new cases include the reintroduction of rules requiring masks to be worn outdoors in hotspots such as the western coastal area around Bordeaux, a popular holiday destination.
Around 56 percent of the French population has received at least one dose of a Covid-19 vaccine, with 46 percent having had both, according to data by the covidtracker.fr website.
The announcement of the "health pass" system has spurred millions to book appointments for a jab.
More than three million reserved one in the three days after the system was announced by Macron last Monday.

US Deputy Secretary of State Wendy Sherman will travel to China this weekend, the State Department announced Wednesday, making her the highest-ranking official under President Joe Biden to visit amid deep tensions.
The visit is going ahead despite nearly daily new rifts between the two powers including on human rights and cybersecurity, indicating that both sides want at least to test the waters to see if diplomacy can bring more stability to a relationship often described as the most consequential to the world.
"These discussions are part of ongoing US efforts to hold candid exchanges with PRC officials to advance US interests and values and to responsibly manage the relationship," a State Department statement said, referring to the People's Republic of China.
"The deputy secretary will discuss areas where we have serious concerns about PRC actions, as well as areas where our interests align," it said.
The trip will still not have the trappings of a full-fledged official visit. Sherman will not go to Beijing but instead spend two days starting Sunday in Tianjin, the eastern port city.
The State Department said she would meet senior officials in Tianjin including Foreign Minister Wang Yi.
John Kerry, the former secretary of state turned US climate envoy, is the only other senior official from the Biden administration to visit China as the world's two largest emitters pledged to work together on the planetary crisis despite a host of differences.
Kerry did not hold talks in the capital either but rather met with his climate counterpart in Shanghai where there were few public sightings of the usually media-friendly former senator.
Secretary of State Antony Blinken and Jake Sullivan, Biden's national security advisor, met in March in Alaska with Wang as well as top official Yang Jiechi in a visibly tense meeting in which the Chinese side berated the United States in front of the cameras.
Suspense on trip
Since last week, the United States publicly accused Beijing of carrying out the massive hack in March of Microsoft Exchange and issued a business advisory warning of risks in Hong Kong. The US Senate voted to ban imports from the Xinjiang region due to allegations of forced labor.
On Tuesday, China denounced what it called a "fabricated" campaign by the United States which rallied allies including NATO for a joint condemnation of purported cyber attacks from the Asian power.
Sherman is already in Asia with a tour of Japan, South Korea and Mongolia. A State Department announcement of her travel last week raised eyebrows by not including China, indicating the two sides were continuing to negotiate whether she should visit -- and ultimately decided the trip would go ahead despite the latest episodes.
Biden has largely kept the hawkish stance on China of his predecessor Donald Trump, with US policymakers across party lines saying that an increasingly assertive China is the pre-eminent challenge for the United States.
But Biden has promised a more focused approach of working with allies and has toned down the more vitriolic statements about China from late in Trump's tenure.
The State Department also announced that Sherman would continue on to Oman.
While it said she would focus on relations with Oman, the Gulf sultanate has been the key go-between for the United States and Iran, diplomacy in which Sherman was closely involved under former president Barack Obama.

A local family restaurant has been forced to close its doors after 20 years due to the COVID lockdown, highlighting again how while the pandemic helped make the rich far richer, ordinary people continue to suffer.
Julios, a Mexican/Italian restaurant in the village of Oughtibridge, Sheffield, announced the closure on its Facebook page.
“Julio’s Restaurant and the Cosy Café wish you a very Happy Easter!!! We would also like to thank you for your support during almost twenty years! Thank you!!! Sadly and due to unexpected circumstances(covid19) we have been forced to close our doors for good. Nevertheless I will have happy memories of all of you. Ignacio and staff,” said the Facebook post.
Given that Julios was the only restaurant in the area (aside from pubs, which are also struggling), its loss is sure to be keenly felt by the local community given that it had been a much loved gathering place for almost 20 years.
The demise of Julios is just a microcosm of how the lockdown has wiped out pubs, restaurants and other small businesses across the UK.
<a href="https://www.bbc.co.uk/news/business-57087070">Figures</a> from back in May showed that almost 10 per cent of restaurants had been closed down, while mid-market “casual dining” venues have fallen by 19.4%. These figures are offset by including new restaurants that opened during the pandemic, so the true figure is even higher.
Another <a href="https://news.sky.com/story/covid-19-how-many-pubs-restaurants-and-clubs-closed-their-doors-permanently-in-2020-12194754">report</a> found that almost 10,000 licensed premises – including pubs, clubs and restaurants, had closed down during 2020.
And while small businesses and family-run operations were eviscerated by the lockdown, larger companies took advantage.
Worldwide, the combined wealth of the world’s 10 richest men rose by $540bn, including Amazon founder Jeff Bezos who saw his personal wealth grow by $86 billion as Amazon shares soared.
According to an <a href="https://www.bbc.co.uk/news/world-55793575">Oxfam report</a>, billionaires exploited the the impact of lockdown to create a “rigged economy,” causing expanding wealth inequality during the “worst economic downturn in a century”.
A record number of billionaires were also <a href="https://www.theguardian.com/business/2021/may/21/number-of-billionaires-in-uk-reached-new-record-during-covid-pandemic">created</a> in the UK during the pandemic even as millions of ordinary people lost their jobs and saw their businesses go under.
Lockdowns have also seen 150 million people globally <a href="https://www.worldbank.org/en/news/press-release/2020/10/07/covid-19-to-add-as-many-as-150-million-extreme-poor-by-2021">pushed</a> into extreme poverty.
Given that wealth inequality has made the rich richer and the poor poorer, in addition to the introduction of vaccine passports that will create a two tier society that discriminates against the poor and ethnic minorities, you’d think the left would be more vocal in opposing lockdown policies.
In reality, they have vehemently supported them at every turn and even called for much harsher restrictions.

The massive march, protesting both the oppressive ongoing lockdowns and the new COVID vaccine mandate, erupted last week following Macron’s speech warning of <a href="https://europe.infowars.com/french-face-6-months-in-jail-for-entering-a-bar-or-restaurant-without-a-covid-pass/">jail time for those unable to prove their vaccination status</a>.
“People unable to present a valid health pass risk up to six months in prison and a fine of up to €10,000 (£8,500), according to the draft text of the law, while owners of ‘establishments welcoming the public’ who fail to check patrons’ passes could go to jail for a year and be hit with a €45,000 fine,” reports <a href="https://www.theguardian.com/society/2021/jul/15/france-achieves-record-covid-jabs-with-macrons-big-stick-approach">the Guardian</a>.
Separate footage shows a group of officers laying down their helmets in solidarity with the protesters and medical personnel subjected to Macron’s draconian new law.

Although the protests initially saw citizens violently clash with the police, sentiment over the weekend evidently appeared to shift, despite the fact police were declared exempt from the forced inoculation (presumably as a way to keep them on Macron’s side).

In a post slamming the tech giant following her suspension, Greene compared the company to “Communist China,” claiming they violated her “freedom of speech.”

On Monday, Greene’s account was suspended after posts of hers were flagged for supposedly violating terms of service related to “Covid-19 misleading information.”
In a statement to <a href="https://newsbusters.org/blogs/free-speech/alexander-hall/2021/07/20/rep-mt-greene-blasts-twitter-platform-suspension" rel="noreferrer noopener" target="_blank">MRC</a>, a Twitter rep explained, “[W]e took enforcement action on the account you referenced (@mtgreenee) for violations of the Twitter Rules, specifically the<a href="https://help.twitter.com/en/rules-and-policies/medical-misinformation-policy"> COVID-19 misleading information policy</a> (Tweets<a href="https://twitter.com/mtgreenee/status/1417096540074565636"> here</a> and<a href="https://twitter.com/mtgreenee/status/1416945786273681409"> here</a>).”
Greene’s supposedly offensive tweets called for people to have the right to refuse the vaccine if they choose, instead of a national compulsory mandate.

Greene’s suspension comes as the White House has re-doubled their propaganda efforts in attempts to get more Covid jabs into the arms of Americans, going as far as to scold Facebook for not censoring enough anti-vaccine content quick enough.
The White House along with the US Surgeon General has also announced it will begin <a href="https://www.infowars.com/posts/more-censorship-white-house-flags-facebook-anti-vaccine-misinformation-posts-for-facebook/" rel="noreferrer noopener" target="_blank">flagging problematic posts for Facebook to review</a> in an anti-free speech crackdown that even George Orwell could not have predicted.
