Why Tesla won’t stop

<p>Tesla announced two massive recalls this week related to issues with its vehicles’ software. One of the recalls ordered Tesla to roll back a self-driving feature that caused the company’s cars to break the law. While Elon Musk <a href="https://twitter.com/elonmusk/status/1488615123946246151">said</a> “there were no safety issues,” federal regulators disagree. But it’s also increasingly clear that government pressure is unlikely to change Tesla’s brazen approach.</p> <p>In fact, these recently recalled features are just the latest examples of the company selling <a href="https://www.vox.com/recode/2020/2/19/21143933/tesla-artificial-intelligence-model-hacking-speeding">potentially dangerous software</a>. This trend is especially concerning because the National Highway Traffic Safety Administration (NHTSA), the agency that will oversee the recalls, can only <a href="https://www.nhtsa.gov/sites/nhtsa.gov/files/documents/understanding_nhtsas_current_regulatory_tools-tag.pdf">take action</a> after the Tesla software has been <a href="https://www.theverge.com/2015/11/4/9670744/tesla-self-driving-autonomous-cars-regulation-oversight">released to drivers</a>. Tesla typically pushes these updates to its vehicles when they’re connected to the internet, so they don’t come at <a href="https://www.barrons.com/articles/tesla-recall-2022-fsd-stock-price-51643722437">a significant cost to the company</a>. That’s left Tesla free to release and test new features with drivers on the road — until the government catches up and intervenes, or Tesla identifies issues on its own.</p> <p>Tesla’s <a href="https://static.nhtsa.gov/odi/rcl/2022/RCLRPT-22V037-4462.PDF">first recall this week</a> involved a feature that enabled users to program their Teslas to slow down but not completely stop at all-way intersections with stop signs, under very specific conditions. The company first introduced the so-called “rolling stop” feature back in October 2020 as part of an update to its Full Self-Driving beta software. This <a href="https://www.tesla.com/support/autopilot">advanced version</a> of Tesla’s Autopilot driver-assistance technology is only available to a limited number of Tesla owners who pay <a href="https://electrek.co/2022/01/18/tesla-increases-full-self-driving-package-price-but-not-monthly-subscription-service/">$12,000</a> for the upgrade and <a href="https://www.vox.com/recode/22425169/autonomous-features-cars-elon-musk-autopilot">is famously</a> <a href="https://www.businessinsider.com/tesla-fsd-beta-full-self-driving-autopilot-software-controversy-2021-11">controversial</a>. Despite the name, the Full Self-Driving software doesn’t actually turn Teslas into fully autonomous vehicles, but it does give drivers access to semi-autonomous features. The recent recall of the rolling stop feature affected all 53,822 Teslas that had upgraded to Full Self-Driving.</p> <p>It’s unclear exactly how dangerous Tesla’s “rolling stop” feature was in practice. No warranty claims or injuries were reported to Tesla, and the system only worked if the car was driving at very slow speeds. Elon Musk claims that speed was <a href="https://twitter.com/elonmusk/status/1488615123946246151">2 miles per hour</a>, while official NHTSA notes say it was <a href="https://static.nhtsa.gov/odi/rcl/2022/RCLRPT-22V037-4462.PDF">5.6 miles per hour</a>. Regardless, rolling through stop signs is <a href="https://abcnews.go.com/Technology/wireStory/tesla-recall-full-driving-software-runs-stop-signs-82596066">illegal</a> in most places, no matter how slow you’re going. As NHTSA <a href="https://static.nhtsa.gov/odi/rcl/2022/RCAK-22V037-9109.pdf">noted</a> in a letter to Tesla, “Failing to stop at a stop sign can increase the risk of a crash.” Tesla has now released a software update to address the recall.</p> <p>Tesla’s <a href="https://static.nhtsa.gov/odi/rcl/2022/RCLRPT-22V045-3599.PDF">second recall</a> came on Thursday after NHTSA said that more than 817,000 Teslas could have a faulty seat belt feature. The automaker has initiated nine recalls <a href="https://www.bloomberg.com/news/articles/2022-02-03/tesla-agrees-to-fix-seat-belt-chime-malfunction-on-817-000-cars?sref=Wg6QzS2e">within the past three months</a>, and federal safety regulators opening investigations into the company now feel like this is a regular occurrence. At the same time, some of the problems that the software updates are meant to address seem to be ongoing or, in some cases, worsening.</p> <p>For example, Tesla <a href="https://www.consumerreports.org/car-recalls-defects/tesla-recall-full-self-driving-software-phantom-braking-a5626328806/">issued a recall</a> — and a software update — following reports last fall that vehicles using Autopilot would brake without warning after their computers detected hazards that didn’t actually exist. But this “phantom braking” issue actually appeared to get worse in the months following the recall, possibly because Tesla decided to stop using radar-based sensors, in favor of cameras, on some vehicle models, according to <a href="https://www.washingtonpost.com/technology/2022/02/02/tesla-phantom-braking/">a recent report from the Washington Post</a>. Federal regulators are again consulting the company about how to address the problem.</p> <p>“NHTSA has kind of been playing a game of cat and mouse with Tesla for a number of years now,” explained Michael Brooks, the acting director of the Center for Auto Safety. “Right now, NHTSA seems to be playing a little more active version of a cat.”</p> <p>Yet Tesla shows no sign of stopping. Again, car recalls don’t work the way they once did. Car owners used to take their recalled vehicles to a dealer or auto shop for a repair, or they would get a replacement or a refund. But in recent years, automakers have had the option of fixing some flaws with an over-the-air software update, just like Tesla has done with all of the aforementioned recalls. Because these recalls are akin to releasing an app update, they’re easier and faster for car owners to address. But they’re also <a href="https://www.marketwatch.com/story/tesla-stock-shrugs-off-second-over-the-air-recall-for-auto-maker-this-week-11643907640">relatively cheap</a> for automakers to execute. So some might argue that, if recalls simply lead to software updates, they’re little more than a slap on the wrist from regulators.</p> <p>It looks as though Tesla is also using software updates to preempt potential recalls, too. This past <a href="https://www.nytimes.com/2021/12/07/business/tesla-video-game-driving.html">summer</a>, the company released a feature called <a href="https://www.cnet.com/roadshow/news/nhtsa-tesla-passenger-play-disabled-investigation/">Passenger Play</a> that let people play video games on Teslas’ touchscreens while the vehicles were in motion. But after NHTSA announced <a href="https://www.nytimes.com/2021/12/23/business/tesla-video-games.html">an investigation into the feature</a>, Tesla issued a software update in December to <a href="https://www.cnbc.com/2021/12/23/tesla-disables-passenger-play-video-games-while-vehicle-is-moving.html">disable</a> Passenger Play while the car is in motion. Last August, the agency similarly <a href="https://www.caranddriver.com/news/a37320725/nhtsa-investigating-tesla-autopilot-crashes-fatalities/">announced a formal investigation</a> into 11 crashes involving Tesla vehicles with Autopilot or Traffic-Aware Cruise Control engaged that hit stopped emergency vehicles with their lights flashing, and then Tesla pushed <a href="https://electrek.co/2021/09/22/tesla-autopilot-can-detects-slows-down-emergency-vehicles-lights-night/">a related software update</a> a few weeks later. That prompted NHTSA to ask the company in October why it <a href="https://static.nhtsa.gov/odi/inv/2021/INIM-PE21020-85573P.pdf">didn’t file a formal recall notice</a>, implying that Tesla may have used the update as a “<a href="https://abcnews.go.com/Business/wireStory/us-asks-tesla-recall-autopilot-driving-system-80552870">stealth recall</a>.”</p> <p>Other than formal recalls, regulators <a href="https://www.nhtsa.gov/sites/nhtsa.gov/files/documents/understanding_nhtsas_current_regulatory_tools-tag.pdf">don’t currently have many other tools</a> at their disposal. NHTSA could update its <a href="https://www.nhtsa.gov/laws-regulations/fmvss">Federal Motor Vehicle Safety Standards</a>, but that’s a <a href="https://www.theverge.com/22869190/pete-buttigieg-self-driving-cars-electric-tesla-decoder">yearslong process</a>, a fact that might help explain why regulations haven’t kept pace with new car technologies. The National Transportation Safety Board can also focus on car safety, but the agency is mostly limited to conducting <a href="https://www.washingtonpost.com/wp-srv/metro/documents/whatisntsb0091710.pdf">investigations into crashes</a> and making recommendations. Last May, Reps. Bobby Rush (D-IL) and Larry Bucshon (R-IN) proposed the <a href="https://www.congress.gov/bill/117th-congress/house-bill/2997?s=1&r=27#:~:text=Introduced%20in%20House%20(05%2F04%2F2021)&text=This%20bill%20requires%20the%20Department,different%20racial%20and%20ethnic%20groups.">Crash Avoidance System Evaluation Act</a>, which would force the Department of Transportation to study how well car crash avoidance tech, like Tesla’s Autopilot and Full Self-Driving, actually works. Meanwhile, Sens. Ed Markey (D-MA) and Richard Blumenthal (D-CT) urged the Federal Trade Commission in August to <a href="https://www.markey.senate.gov/news/press-releases/markey-and-blumenthal-call-for-ftc-investigation-into-teslas-misleading-advertising-of-driving-automation-systems">investigate</a> Tesla for false and misleading advertising related to those semi-autonomous features. Along with Sen. Amy Klobuchar (D-MN), they’ve also proposed the <a href="https://www.markey.senate.gov/news/press-releases/senators-markey-and-blumenthal-lead-reintroduction-of-four-auto-safety-bills-to-improve-recalls-enhance-defect-reporting-upgrade-seat-back-safety-and-prevent-distracted-driving">Stay Aware for Everyone Act</a>, which would mandate that the DOT analyze driver assistance systems and require carmakers to install driver-monitoring tools.</p> <p>“These latest developments with Tesla’s Autopilot and Full Self-Driving systems are exactly why we’ve long expressed our concerns with this flawed technology,” Blumenthal and Markey told Recode. “Although automated driving and driver assistance systems have the potential to enhance safety, they must be implemented with strong safeguards that will ensure our cars follow the rules of the road and drivers are fully engaged.”</p> <p>But the reason strong safeguards for semi-autonomous cars don’t exist is that there’s no consensus about how these vehicles should be regulated. Is the driver or the car manufacturer responsible when a software-assisted vehicle does something dangerous? Should autonomous and semi-autonomous cars be programmed to follow the letter of the law, or to drive the way most people actually drive? Regulators haven’t fully answered these questions, and Tesla is taking advantage of the ambiguity.</p> <p>This all comes at what should be a moment of opportunity for Tesla and its commitment to safety. In the first nine months of last year, the <a href="https://abcnews.go.com/Politics/wireStory/us-road-deaths-rise-record-pace-risky-driving-82600871">number of US road fatalities</a> rose at the fastest rate since the Transportation Department started tracking them in 1975. Musk has repeatedly argued that Tesla’s AI-powered vehicles save lives and that his vehicles could be a solution to worsening highway safety problems. Why the Olympics opening ceremony felt kinda weird

Directed by legendary Chinese film director Zhang Yimou (who also directed the 2008 Beijing opening ceremony), this year’s opening ceremony focused on visual spectacle, with giant LED screens covering the floor and lining the stage, and no celebrity entertainers.</p> <p>Facing <a href="https://www.vox.com/22451173/olympics-2022-winter-beijing-china-uyghurs-genocide">a diplomatic boycott</a> from many countries over <a href="https://www.vox.com/2020/7/28/21333345/uighurs-china-internment-camps-forced-labor-xinjiang">its human rights violations</a>, including the US — meaning the United States sent no official government envoy to the Games but its athletes are competing as usual — China took a low-key approach to this year’s opening ceremony. But inevitably, the tense geopolitics surrounding the event snuck in.</p> <p>The production, which dovetailed with the Chinese New Year spring festival, included about 3,000 performers, <a href="https://www.beijing2022.cn/wog.htm?cmsid=20220129006136">most of them teenagers</a>, and emphasized peace, world unity, and the people around the world who have battled the pandemic. The unifying aesthetic was about as peaceful as you could get: snowflakes.</p> <p>In the buildup to the ceremony, China had encouraged athletes to sign a “<a href="https://www.beijing2022.cn/wog.htm?cmsid=MHI2022020200238100">truce mural</a>” with other nations. The government also rolled out a <a href="https://www.scmp.com/economy/china-economy/article/3165599/will-chinas-beijing-winter-olympics-spur-snow-sports-boom">massive winter sports initiative</a> prior to the Games, claiming it had successfully engaged more than 300 million Chinese citizens in winter sports participation, especially targeting kids and teens. The ceremony emphasized these citizens above all else, with no famous singers or actors performing — a first for any Olympics in recent memory.</p> <p>This was due perhaps in part to the difficulty of coordinating live celebrity performances while Beijing is still under <a href="https://www.wsj.com/articles/beijing-steps-up-covid-19-control-measures-ahead-of-lunar-new-year-winter-olympics-11643286485">a period of intense lockdown</a> due to the pandemic. It happens to be in accord with China’s year-long <a href="https://www.glimpsefromtheglobe.com/regions/asia-and-the-pacific/china-cracks-down-on-digital-fandoms-behind-the-qinglang-operation/">“QingLang” campaign</a> to <a href="https://www.whatsonweibo.com/love-the-motherland-new-moral-guidelines-for-chinese-performers-come-into-force/">rein in the status of celebrities</a> and their fans — a sweeping attempt to control both the undue influence of idols as well as their often out-of-control fandoms.</p> <p>It’s in keeping with China’s <a href="https://www.bbc.com/news/world-asia-china-55355401">messaging</a> since the pandemic began: We’re all in this together, getting through this together, thanks to the tireless commitment of “<a href="https://madeinchinajournal.com/2021/05/30/the-cultural-politics-of-national-tragedies-and-personal-sacrifice-state-narratives-of-chinas-ordinary-heroes-of-the-covid-19-pandemic/">ordinary heroes</a>” like volunteers and essential workers — who had to execute China’s <a href="https://www.nytimes.com/2022/02/04/briefing/zero-covid-china-olympics.html">draconian (though highly successful) Covid policy</a>. Since 2021 was the Chinese Communist Party’s 100th anniversary, that narrative has also aligned with <a href="https://foreignpolicy.com/2021/12/28/china-ccp-centenary-centennial-xi-jinping-thought-history/">a heavy emphasis</a> on the importance of youth to carry the nation (and Chinese communism) into the future.</p> <p>That theme played heavily into the opening ceremonies, from the presence of seas of cute children smiling and singing onstage to a video featuring kids not much older than toddlers skiing and skating to the passing of the Olympic torch. For the cauldron lighting, Chinese athletes born in succeeding decades passed the torch along to one another, ending with two athletes born in the 2000s (one of whom embodied a message to the world, but more on that in a second).</p> <p>Throughout the parade of nations, happy volunteers jumped, danced, and waved alongside the competing Olympic athletes alongside a backdrop of utterly inoffensive European classical music. A bucolic snowflake aesthetic dominated the presentation, apparently emphasizing not the uniqueness of every snowflake, but the calm uniformity of the collective snowfall awaiting spring. Easy to imagine it all as a metaphor for the commonality of the global Olympics audience as we all await an end to Covid surges. At one point, roller skaters made idyllic snowflake patterns to the tune of John Lennon’s “Imagine.”</p> <p>Despite the banal quality of it all, the scene still held political tension. Viewers watching the NBC live feed of the ceremony got plenty of glimpses of Vladimir Putin, isolated in Russia’s box, attending the event despite being embroiled in <a href="https://www.vox.com/2022/1/31/22910635/russia-ukraine-border-crisis-us-nato">a border standoff with Ukraine</a> that threatens to overshadow the Games and their focus on global unity.</p> <p>As Chinese President Xi Jinping looked on, in the final moments, the Olympic torch was passed to 21-year-old cross-country skier <a href="https://www.instagram.com/dini0503/?hl=en">Dinigeer Yilamujiang</a>, who is a member of China’s Uyghur ethnic minority. Human rights experts have accused the Chinese Communist Party (CCP) of detaining millions of Uyghurs in <a href="https://www.vox.com/2020/7/28/21333345/uighurs-china-internment-camps-forced-labor-xinjiang">forced human labor camps in Xinjiang</a>; the US State Department has <a href="https://www.aljazeera.com/news/2021/3/30/china-genocide-uighurs-xinjiang-state-department-report-human-rights">described</a> the actions as genocide and alleged China is committing other crimes against humanity like rape, forced sterilization, and torture.</p> <p>China has claimed, despite <a href="https://www.rand.org/blog/rand-review/2021/04/chinas-disappeared-uyghurs-what-satellite-images-reveal.html">significant</a> <a href="https://www.dw.com/en/xinjiang-footage-sheds-new-light-on-uyghur-detention-camps/a-59880898">evidence</a> to the contrary, that the camps don’t exist, that workers’ labor is voluntary, and that accusations to the contrary are “<a href="https://www.chinadaily.com.cn/a/202103/20/WS60554c0ea31024ad0bab0672.html">the lie of the century</a>.” So the decision to prominently feature Yilamujiang to end the opening ceremony is a deeply political one — and one that will significantly complicate the message of unity conveyed in the Olympics’ opening ceremony. (Yilamujiang isn’t the first Uyghur athlete to carry the torch for China; Kamaltürk Yalqun, who carried the torch at age 17 in the 2008 Olympics, now lives in the US and <a href="https://www.tenterfieldstar.com.au/story/7606769/uyghur-2008-torch-bearer-laments-china/">has spent years protesting</a> China’s persecution of the Uyghurs.)</p> <p>China also welcomed separate delegations from Taiwan (competing as the “Chinese Taipei” team) and Hong Kong, despite its <a href="https://www.vox.com/2020/7/2/21309902/china-national-security-law-hong-kong-protests-us-sanctions">attempts</a> to bring those regions more tightly into its orbit and its emphasis on a <a href="https://www.vox.com/world/2017/2/10/14575442/trump-accept-one-china">“One China” policy</a>. As Yale professor Jing Tsu explained during NBC’s coverage, these contradictions are somewhat inherent to China’s political strategy: The country doesn’t necessarily expect to change minds, globally, with its message — but still, it is a clear one: unity, the future, and peace on earth. “We’ll see if there are any takers,” Tsu said.</p> <p>Still, it’s always worth noting that China and its people are not a monolith, nor are they synonymous with the CCP and its human rights abuses — whatever the CCP might want you to think. While China’s Olympic delegation obviously got the biggest cheer of the night from the hometown crowd, the Beijing Olympics Committee stressed a warm welcome to all the participating nations, from the <a href="https://twitter.com/tacodesandwich/status/1489590470045052932">Mexican athletes</a> wearing Day of the Dead jackets to the solo <a href="https://twitter.com/AP/status/1489592871816728584">American Samoa delegate</a> who arrived shirtless, fully Vaselined, and ready to play.</p> <p>Perhaps the opening ceremony did remind us of one thing: No amount of strange precedence or geopolitical tensions can fully suppress the thrilling and unexpected pleasures of the Olympics, from the weird and wacky to the groundbreaking and heroic. Their quest to find resources for their perpetually underfunded operation winds together with meditations on the nature of the birds, particularly kites, birds of prey that have been forced to adapt to the changing city. “Delhi is a gaping wound, and we’re a Band-Aid on it,” one of them says. Their work stands as a metaphor for the huge task that bringing healing to the city’s human residents might be, too. Director Margaret Brown weaves together the stories of the descendants of those who arrived on the Clotilda with the history of the region, and of the powerful family that’s tried to bury and deny its story for so long. When you see it, you’ll know why. Narrated by Miranda July and directed by Sara Dosa, <em>Fire of Love</em> is a tale of romance, both between Katia and Maurice and between the Kraffts and volcanoes. It’s no spoiler to say the couple perished in a volcanic explosion in 1991 (the film tells us this from the start), which means the whole tale is overlaid with bittersweet retrospection. But their passion for volcanoes, and the way they thought it might translate into helping mankind, helps us see who they really were, and the result, built largely from archival footage, is breathtaking. There military personnel and police forces from across the US could learn how to quell “civil disorders.” Director Sierra Pettingill draws on archival footage shot by the military to tell the story of the Riotsvilles and of the bigger attempt to keep citizens (and, some claimed, “outside agitators”) from protesting. Rita Baghdadi centers her story — which is so rhythmic and well-edited that you could mistake it for a carefully plotted scripted film — on the relationship between the band’s co-founders, Lilas and Sherry, and the ways their relationship echoes challenges they’re living through. During the Arab-Israel war, the Palestinian village of Tantura was razed, and many of its inhabitants were killed, but Israel’s official position has long been that it was not a massacre. Instead, casualties were all framed as casualties of war. Alon Schwarz, with exacting care and often shocking interviews, excavates what really happened in Tantura through the eyes of people who were there and who live nearby now. After President Bolsonaro’s election and thanks to his rhetoric, some people felt emboldened enough to invade and survey Uru-eu-wau-wau land, planning to cut down its trees and settle. Alex Pritz’s documentary, co-produced by the Uru-eu-wau-wau, follows the people through several years of struggling to get the Brazilian government to take action, and to convince the world that they’re being invaded. Joe Hunting’s extraordinary film was entirely filmed on the social VR platform <a href="https://hello.vrchat.com/">VRChat</a>, where he spent time with and interviewed several subjects, from a dance teacher to a sign language instructor to a couple who fell in love on the platform. I confess that I expected the movie to be gimmicky, but I was totally wrong. Instead, it’s a meditation on connection and finding a community where you belong, featuring subjects who’d found genuine friendships and relationships in VRChat that extended into the physical world. Hunting shot it in-world with a camera developed on the platform, and it looks marvelous.
