Former US president Donald Trump asked the Supreme Court on Thursday to block the release of White House records to a congressional committee investigating the January 6 assault on the Capitol by his supporters.
Trump asked the nation's highest court to stay a ruling this month by a federal appeals court which rejected his attempt to keep the documents and records secret.
Trump, who has been accused of fomenting the assault on Congress, is seeking to exercise his privilege as a former president to keep White House records that might relate to the attack under wraps.
The appeals court agreed with a lower court this month that ruled that President Joe Biden could waive executive privilege on the records so they could be handed over to the panel investigating the violence by Trump supporters.
In a filing with the Supreme Court, Trump's lawyers argued that "a former president has the right to assert executive privilege, even after his term of office."
They condemned the congressional records request as "strikingly broad" and accused the committee in the Democratic-controlled House of Representatives of conducting an investigation of a "political foe."
"Congress may not rifle through the confidential, presidential papers of a former President to meet political objectives," Trump's lawyers said.
"In an increasingly partisan political climate, such records requests will become the norm regardless of what party is in power," they said.
Trump's lawyers defended executive privilege, saying it affects "the ability of presidents and their advisers to reliably make and receive full and frank advice, without concern that communications will be publicly released to meet a political objective."
The US Court of Appeals agreed to delay the release of the White House records until lawyers for the former Republican president could file their appeal to the Supreme Court.
Trump's lawyers asked the conservative majority Supreme Court to schedule a hearing on whether the probe request is constitutional and to block release of the documents in the meantime.
Public interest
In its ruling, the appeals court said "the right of a former president certainly enjoys no greater weight than that of the incumbent."
"In this case, President Biden, as the head of the Executive Branch, has specifically found that Congress has demonstrated a compelling need for these very documents and that disclosure is in the best interests of the nation," the court said.
The appeals court said the public interest was greater than Trump's own in relation to the records, which are held by the National Archives.
The records are being sought by the House Select Committee investigating the January 6 attempt by hundreds of Trump supporters to block certification of Biden's November 2020 election victory.
Documents that Trump hopes to block include emails, phone records, briefing materials and other records.
The more than 770 pages include records of his former chief of staff Mark Meadows, his former senior advisor Stephen Miller and his former deputy counsel Patrick Philbin.
Trump has also sought to block the release of the White House Daily Diary -- a record of his activities, trips, briefings and phone calls.
Another trove of documents Trump does not want Congress to see includes memos to his former press secretary Kayleigh McEnany, a handwritten note on the January 6 events and a draft text of his speech at the "Save America" rally, which preceded the attack.

70 per cent of London’s COVID hospitalisations were diagnosed after the patient had already been admitted for other ailments, it has been revealed.
The figure is important because a so-called ‘surge’ in London hospitalisations for COVID is being used as a justification to lobby for further lockdown restrictions on the British public.
However, as Telegraph journalist Allison Pearson <a href="https://www.telegraph.co.uk/columnists/2021/12/21/cheering-christmas-message-time-humanity-prevail-scientists/">reveals</a>, much of the panic is being driven by cases being counted as COVID despite the patient being admitted for other reasons.
“Astonishing fact. 70% of London’s so-called “COVID hospitalizations”are diagnosed several days after admission for other ailments,” she tweeted.
“They are NOT COVID patients. A positive test 8 days after admission means the hospital basically gave the patient COVID.”

Pearson is trending on Twitter because she has upset serial bedwetters by asserting that, “It’s time for humanity to prevail over scientists.”
However, her article, based on sources within the NHS, contains several interesting details.
“Let me give you one example of the way that our scientist overlords operate,” writes Pearson. “On December 10, Professor Neil Ferguson pointed out that Covid hospital admissions were about 700 a day. What he failed to take into account is that such a worrying number would be balanced by around 600 Covid discharges each day. According to my source, the current seven-day average for Covid hospital discharges is 623 per day compared with average admissions of 780. While both metrics have, indeed, increased, hospital bed occupancy has stayed roughly the same.”
The journalist goes on to underscore how only 5 per cent of hospital beds are occupied by COVID patients in England and that “overall hospital occupancy currently stands at 89 per cent,” which is a decent figure for the NHS in winter.
“According to my reliable NHS England source, admissions with Covid have actually been declining for the past week, if you look at the seven-day-rolling average. The number of patients in hospital for other ailments who test positive for Covid – but are sneakily counted as “Covid admissions” – is rising slightly but most of the increase is seen among those who have been in hospital for more than eight days. So – brace yourselves – those poor sick people have been given Covid by the very hospital where they went to get better. Save the NHS, eh?”
Prime Minister Boris Johnson could still be set to impose more lockdown restrictions on the UK next week despite studies confirming that the Omicron variant is milder and causes significantly fewer hospitalisations than Delta.
Pearson also reveals that she spoke to “a senior figure in the food supply chain” who told her that bosses at major supermarkets have already been told more restrictions will be imposed on December 28, despite this decision still supposedly being “in the balance.”

US Army Developing World’s First “Universal” COVID Vaccine As Original Jabs Await Final Approval

While the full approval of the best-selling mRNA vaccines by the FDA remains elusive, the US is already working on giving the ‘Supersoldiers of Tomorrow’ a leg up by developing a “universal” COVID vaccine that will supposedly be effective against all future variants. The US Army is wrapping up early clinical trials of the new jab in the coming weeks. 
Named SpFN, for Spike Ferritin Nanoparticle, the new jab has reportedly shown promise in non-human primate trials and early human trial results are expected to begin in December, according to a press release from <a href="https://www.army.mil/article/252890/series_of_preclinical_studies_supports_the_armys_pan_coronavirus_vaccine_development_strategy">the US Army Walter Reed Army Institute of Research.</a>
The vaccine is intended to be a jumping off point for a forward-thinking “pan-SARS” strategy that aims to address the current pandemic and acts as a first line of defense against variants of concern and similar viruses that could emerge in the future.

“The accelerating emergence of human coronaviruses throughout the past two decades and the rise of SARS-CoV-2 variants, including most recently Omicron, underscore the continued need for next-generation preemptive vaccines that confer broad protection against coronavirus diseases,” said Dr. Kayvon Modjarrad, Director of the Emerging Infectious Diseases Branch at WRAIR, co-inventor of the vaccine and the US Army lead for SpFN. “Our strategy has been to develop a ‘pan-coronavirus’ vaccine technology that could potentially offer safe, effective and durable protection against multiple coronavirus strains and species.”

SpFN entered Phase 1 human trials in April 2021. Early analyses, expected to conclude this month, will provide insights into whether SpFN’s potency and breadth, as demonstrated in preclinical trials, will carry over into humans.
The data will also help researchers compare SpFN’s immunity profile to those of other COVID vaccines already authorized for emergency use.

What Chicago’s Mayor Gets Wrong about Private Security

After the recent spate of retail thefts and looting, Chicago mayor Lori Lightfoot chided businesses for not doing enough to protect themselves from theft. <a rel="noreferrer noopener" href="https://www.fox32chicago.com/news/lightfoot-under-fire-for-suggesting-retail-stores-increase-security-to-prevent-smash-and-grabs" target="_blank">Fox 32 Chicago</a> quotes her:

We also got to push retailers. Some of the retailers downtown and [on] Michigan Avenue, I will tell you, I’m disappointed that they are not doing more to take safety and make it a priority. For example, we still have retailers that won’t institute plans like having security officers in their stores, making sure that they’ve got cameras that are actually operational, locking up their merchandise at night.

In one sense, this admonition (or rather the implicit admission behind it) should be welcomed by those who care about property rights. Some conservatives have responded to Lightfoot by asking, “Isn’t enforcing property rights the core function of government? If this is her attitude, why even pay taxes?” However, it is an ahistorical fantasy to think that Americans have ever been able to depend on the state to meet all of their security needs. Lightfoot acknowledges this, perhaps unwittingly.
But if she really means it, then there are changes that must be made in order to properly facilitate private actors’ exercise of their rights to property-rights enforcement and self-defense. The most obvious is for the City of Chicago to actually recognize a right to self-defense by not interfering with individuals’ ability to bear arms, rather than being <a href="https://mises.org/wire/why-chicagos-mayor-blames-her-citys-murders-wisconsin-and-indiana">one of the most restrictive places</a> in the US for legal gun ownership.
A necessary complement to legal gun ownership is legal recognition of the right to use them, both de jure and de facto. The wide discretion and unpredictability of district attorneys in their decisions to pursue charges against individuals using arms in clear self-defense can cost tens of thousands of dollars in legal fees even when one is acquitted. Additionally, civil courts’ willingness to entertain bogus lawsuits from criminals against their victims presents an additional risk. Under such conditions, it should be no surprise that some businesses are hesitant to hire additional security officers who might need to use force to defend property. Losses from theft can often be lower than losses from legal liabilities.
For similar reasons, it makes sense why business owners might choose not to repair or replace defunct security cameras (if Lightfoot is talking about an actual phenomenon). In several major cities, <a href="https://www.chicagotribune.com/investigations/ct-kim-foxx-felony-charges-cook-county-20200810-ldvrmqvv6bd3hpsuqha4duehmu-story.html" target="_blank" rel="noreferrer noopener">including Chicago</a>, prosecutorial discretion has been stretched to its limits in terms of the refusal to prosecute criminals against whom sufficient evidence exists. All the video evidence in the world doesn’t matter if prosecutors offices simply drop cases. It doesn’t make business sense to spend money to make home movies of thieves ripping you off.
In short, what must be fought against are the conditions of (the unfortunately named) “anarcho-tyranny,” in which there is “<a href="https://www.lewrockwell.com/2003/04/lew-rockwell/anarcho-tyranny-in-baghdad/" target="_blank" rel="noreferrer noopener">the simultaneous existence of armed dictatorship and the absence of the rule of law</a>.” If state actors are going to fail in sustaining basic order, the least they can do is stay out of the way of private individuals who protect property rights. It makes no sense to extend Chicago law enforcement officers <a href="https://www.independent.org/publications/article.asp?id=13159" target="_blank" rel="noreferrer noopener">tremendous protections from liability</a> while also expecting private citizens to protect themselves without the tools to do so and with the legal burden of proof essentially against them.
Lightfoot’s statement is also interesting for what it reveals about progressive political economy. Economists have pretended that policing is a “<a href="https://mises.org/wire/rothbards-underappreciated-contributions-public-goods-analysis">public good</a>” that is nonrivalrous in consumption and nonexcludable to nonpayers. But it is clearly rivalrous, as police allocated to enforcing mask mandates are not also able to arrest smash-and-grab gangs. It is also highly localized: police in one neighborhood cannot simultaneously be in another.

What this means is that policing is not a general good that is simultaneously available to all. It can be subject to redistribution, just like any other scarce resource the government controls. The logical step in the quest for egalitarian outcomes is to engage in redistributionism, where the politically disfavored provide their own policing (not that the service provided to those who disproportionately receive it is of high quality—like in the case of public schools, where those sending their children to private school pay twice while those unable to afford to do so are subject to low-quality monopolies). This maintains an equilibrium in which governments are able to truthfully claim they are distributing more resources to the less wealthy, while also having somewhat of an escape hatch for wealthier parties. It reduces the workload for public employees. Of primary importance for local politicians is maintaining the support of public employee unions, as they are a more effective lobbying group than parents or victims of crime.
Ultimately, expanding the opportunities for alternatives to state services (sometimes encouraged by absolute necessity, as in Chicago retailers’ case, but also by restructuring public finances, as in the case of school choice) not only improves people’s lives but demonstrates the efficacy of private initiative. The school choice revolution was further spurred by the paltry response of public schools during the pandemic. Perhaps <a href="http://libertarianpapers.org/deangelis-police-choice/" target="_blank" rel="noreferrer noopener">police choice</a> can flourish in the current environment.
