Lawyer for Derek Chauvin Files Motion to Impeach Verdict: “Proceedings Deprived Client of Fair Trial”

<p><strong>The lawyer for convicted former Minnesota police officer Derek Chauvin filed a motion to retry the case Tuesday claiming the court deprived his client of a fair trial as prescribed by the US Constitution.</strong></p>
<p>Last month, a jury found Chauvin guilty on three charges, including second and third-degree murder and second-degree manslaughter, following the death of George Floyd last summer.</p>
<p>On Tuesday, Chauvin’s defense attorney Eric Nelson filed a motion claiming there was significant “prosecutorial and jury misconduct,” in addition to “errors of law at trial; and a verdict that is contrary to law.”</p>
<p>Here are a list of ways the court “deprived the Defendant of a fair trial,” according to Nelson, as reported by <em><a href="https://www.kare11.com/article/news/local/george-floyd/derek-chauvin-defense-seeks-new-trial/89-ada3b281-ab4f-40be-a000-da46bf5a90be">KARE11.com</a></em>:</p>
<ul>
<li>Denial of a change of venue</li>
<li>Publicity surrounding the case</li>
<li>Failure to sequester the jury</li>
<li>Prosecutorial misconduct by allegedly disparaging the defense and failing to adequately prepare witnesses</li>
<li>The court’s failure to order testimony from Morries Hall, who was with George Floyd on the day of his death</li>
<li>Jury instructions that “failed to accurately reflect the law” on the murder charges</li>
<li>Allowing the state to “present cumulative evidence” on use of force</li>
<li>The court allowed the state to “lead witnesses on direct examination”</li>
<li>The court failed to order a record of “numerous sidebars that occurred during the trial”</li>
</ul>
<p>Nelson says, “The cumulative effect of the multiple errors in these proceedings deprived Mr. Chauvin of a fair trial, in violation of his constitutional rights.”</p>
<p>Nelson’s motion also reportedly asked the court to “impeach” the verdict citing “jury misconduct,” after <a href="https://www.washingtontimes.com/news/2021/may/3/brandon-mitchell-derek-chauvin-juror-who-attended-/" target="_blank" rel="noreferrer noopener">reports</a> surfaced Tuesday that juror Brandon Mitchell had attended at least one BLM rally while <a href="https://www.msn.com/en-us/news/us/photo-of-chauvin-juror-wearing-blm-t-shirt-at-march-raises-questions-of-impartiality-experts-say/ar-BB1gkrE1?ocid=uxbndlbing" target="_blank" rel="noreferrer noopener">wearing</a> a shirt that read “Get your knee off our necks” prior to serving on the jury.</p>
<p>Mitchell’s attendance at the “Commitment March: Get Your Knee Off Our Necks” rally in August 2020 would be a basis to argue that the jury was not impartial, and a judge could declare a mistrial based on answers he gives during a Schwartz hearing.</p>

<p>“[T]he jury committed misconduct, felt threatened or intimidated, felt race-based pressure during the proceedings, and/or failed to adhere to instructions during deliberations, in violation of Mr. Chauvin’s constitutional rights to due process and a fair trial,” Nelson writes, without specifically naming Mitchell.</p>
<p>A statement from the Minnesota Attorney General’s office refuted Nelson’s appeal: “The court has already rejected many of these arguments and the State will vigorously oppose them.”</p>

<p><strong>Liberals have abandoned scientific evidence amid the COVID-19 pandemic in favor of virtue-signaling with severely restrictive measures to express their “political identity”, according to a piece in the <em>The Atlantic</em>.</strong></p>
<p>In the article <a href="https://www.theatlantic.com/politics/archive/2021/05/liberals-covid-19-science-denial-lockdown/618780/" target="_blank" rel="noreferrer noopener">“The Liberals Who Can’t Quit Lockdown”</a>, writer Emma Green explains that the pandemic has imbued the left with a new sense of purpose in obediently adhering to the lockdowns.</p>
<p>“Lurking among the jubilant Americans venturing back out to bars and planning their summer-wedding travel is a different group: liberals who aren’t quite ready to let go of pandemic restrictions,” Green wrote Tuesday.</p>
<p>“For this subset, diligence against COVID-19 remains an expression of political identity—even when that means overestimating the disease’s risks or setting limits far more strict than what public-health guidelines permit.”</p>

Liberal Stooge John Oliver Attacks Alex Jones In Pathetic COVID Vaccine Push

<p><strong>In a half-hourlong video released Monday, left-wing propagandist posing as a comedian John Oliver decided to attack popular political figures during a pro-COVID vaccine tirade.</strong></p>
<p>Infowars’ Alex Jones was mentioned by Oliver as he tried to tell Americans there is no proof whatsoever that experimental mRNA vaccines could be harmful to humans.</p>

<p>“The Pfizer and Moderna vaccines are the first authorized to use messenger-RNA, which is true, but that has given rise to speculation about what mRNA is capable of doing,” Oliver said before playing a video clip from <em>The Alex Jones Show</em>.</p>
<p>“Basically anyone taking these vaccines, they’re all designed to do the same thing, is going to have neurological disorders within one year. Most of the people taking the vaccine will be dead within 10 years,” Jones said. “Let me tell you something. You take the mRNA, it creates plaque in your brain and gives you Alzheimer’s and I got the studies too. So, you think they just put fluoride in the water to dumb you down?”</p>
<p>“Wow!” Oliver responded to the Jones segment. “Alex Jones is having a blast isn’t he? No one else has as much fun while making the world a worse place to live in. It’s like he invented a jetpack that sprays everyone below him with human shit.”</p>
<p>He continued, “But the thing is, there is absolutely no evidence or credible studies supporting any of what he just said.”</p>
<p>Of course, anyone watching <em>The Alex Jones Show</em> would have seen the “studies” referred to in the video clip, but Oliver ends the segment without showing Jones’ documentation and provides no evidence for his own claims.</p>
<p>Meanwhile, serving as an example of why people go to platforms like Infowars for news instead of late-night comedians like John Oliver, Alex Jones responded to the attack without using a teleprompter and actually provided data to viewers during Tuesday’s broadcast.</p>
