<p>Clad in yellow shirts, hundreds of marchers streamed across the Arlington Memorial Bridge on September 15, and ended their nearly 1,000-mile "Journey for Justice" march at the steps of the Lincoln Memorial.</p>
<p>Many of those marchers set out six weeks ago to retrace the historic "Bloody Sunday" civil rights march from Selma to Montgomery, Alabama, in 1965, which was instrumental to the passage of the landmark Voting Rights Act (VRA) that year. More than 50 years later, activists have taken their own civil rights march even farther than Montgomery – to the halls of Congress, to demand that legislators pass the Voting Rights Advancement Act (VRAA) and press for the advancement of a broader racial justice agenda around education, income inequality and reforms to the criminal legal system.</p>
<p>The VRAA, introduced this year, would restore a key provision of the VRA that was struck down by the Supreme Court two years ago in its 2013 Shelby County v. Holder decision. In that decision, the court tossed out a formula under Section 4 of the VRA that required federal approval, or preclearance, for changes to voting procedures in states with a history of voting discrimination.</p>
<p>The ruling paved the way for predominantly Republican-controlled state legislatures to move forward with congressional redistricting and voter identification laws that have been found to disproportionately suppress the vote of marginalized groups more likely to support Democratic and liberal-leaning third-party candidates.</p>
<p>"We know from our history that no matter how many times we make forward steps, there will always be someone out there looking to move us back," said Rep. Jim Clyburn (D-South Carolina) on the steps of the Lincoln Memorial during a September 15 press conference. Clyburn is the third-ranking House Democrat and a prominent member of the Congressional Black Caucus. "We hear it all around us today. They aren't just dog whistles. These people have now begun to make howling noises of wolves. We know who they are; we know what they stand for; we came here today to say to each and every one of them that we are not - will not - be moved."</p>
<p>Clyburn noted that not only was the VRA passed 50 years ago, but many other social programs – including education initiatives under Head Start, the elimination of federal immigration quotas and Medicare – were also all adopted in 1965. The congressman argued that these programs, too, still need protection in 2015.</p>
<p>Thousands of people have participated, relay-style, in the march's route through Alabama, Georgia, South Carolina, North Carolina and Virginia during the past month and a half before it ended this week in Washington, DC. Presidential candidate and Independent Vermont Sen. Bernie Sanders was among those who joined the march on September 15, during its last stretch from the Arlington Memorial Bridge to the Lincoln Memorial.</p>
<p>NAACP President Cornell William Brooks has been walking with the marchers about five days a week since they set out from Selma on August 1. "It's not enough for us to be bystanders and spectators to our history, which is happening now. You can't go into the theater and see Selma, or download it on Netflix, without paying attention to the Selma moment happening now," Brooks told Truthout, while walking through Virginia earlier in September.</p>
<p>"This is a long, strenuous, soul-testing, physically testing march. More to the point, it's a test of our kind of constitutional and moral character," Brooks said.</p>
<p>But the march has tested the activists' spirits in another deeply emotional way: They lost one of their own several days ago while marching. Middle Passage, a 68-year-old veteran and Colorado resident, became ill on September 12 while leading the march; he was unable to be revived and passed away soon after.</p>
<p>"I watched a brave man die beside me holding our American flag. His name was Middle Passage, a name that both invokes a historical legacy of suffering while suggesting the aspirations of freedom by African-Americans," Brooks said in a statement. "It was my forever-to-be-cherished honor to walk beside Middle Passage for hundreds of miles on America's Journey for Justice."</p>
<p>While protecting and broadening voting rights for communities of color is a central issue for the nearly 50 advocacy organizations supporting #JusticeSummer, as the march is referred to on social media, organizers are also pushing to advance a broader racial justice agenda around the theme of "Our Lives, Our Votes, Our Jobs and Our Schools Matter."</p>
<p>On September 16, marchers and organizers with the NAACP lobbied congressional representatives to pass several bills introduced this year in addition to the VRAA, including the End Racial Profiling Act, which would requiring states to certify their compliance with US Department of Justice rules discouraging racial profiling; the Raise the Wage Act, which would raise the federal minimum wage to $12 an hour by 2020; and the Paycheck Fairness Act, which would narrow the gender pay gap.</p>
<p>The activists are also pressuring lawmakers to act on implementing national standards to govern use of force by all law enforcement officers, ensure that every student has access to a quality education regardless of their income, and prioritize job creation and training. But the marchers are focusing "first and foremost," as Brooks says, on restoring the VRA.</p>
<p>"We're sending a message that we have no intention of giving up, that we have no intention of going one more election under this rather crooked system and set of rules that we're operating under," he told Truthout.</p>
<p>According to the Brennan Center for Justice, new voting restrictions, including voter identification laws, cutbacks to early voting and barriers to registration, have been enacted in 21 states since the 2010 midterm election. The strictest law was passed in Texas in 2011, requiring voters to present current, government-issued photo identification such as a Texas driver's license, gun license, military ID or passport. A photo ID issued by a state college and tribal IDs are not accepted under the law. At least 15 states will see these new restrictions in effect for the first time during the 2016 presidential election.</p>
<p>And already in the 2016 election cycle, hundreds of more bills that would restrict access to the ballot are being introduced in state legislatures across the United States. As of May 13, 2015, the Brennan Center tallied at least 113 bills aiming to restrict access to registration and voting that have been introduced or carried over from the previous legislative session in 33 states.</p>
<p>According to the Center's same tally, since the onset of the 2015 legislative session, at least 464 bills have also been introduced or carried over in 48 states (plus Washington, DC) that would do the opposite: enhance access to voting and registration. For example, the California Senate passed a bill in September that, if signed into law, would automatically register eligible citizens to vote when they visit the DMV to get a driver's license. If enacted, the bill could potentially add millions of new voters to California's rolls.</p>
<p>However, according to the Center's report, the resistance still faces an uphill battle: "[T]his strong show of support for making the ballot accessible has not necessarily put voters ahead of where they have been in recent years, because some recent restrictive legislation continues to make it harder for citizens to participate."</p>
<p>Overall, of the 113 bills introduced that would restrict voting rights in the 2015 session, six bills in five states have moved in the legislature, being either referred to committee or voted on, and one bill has been enacted. North Dakota passed a bill this session amending its current voter identification law so that now only four forms of ID are allowed at the polls. The bill originally allowed voters to use bills, bank statements and change-of-address forms to prove residency, as well as a college-issued photo ID.</p>
<p>Additionally, court battles are continuing to play out over voting restrictions in at least three states: Arizona, North Carolina and Texas. In August, the Fifth Circuit Court of Appeals ruled that Texas' voter identification law violates Section 2 of the VRA because the law discriminates against Black and Latino voters. But the state has since appealed, filing a petition arguing that if Section 2 does make Texas' voter ID law illegal, then Section 2 is unconstitutional.</p>
<p>Another issue the NAACP is focusing on in the #JusticeSummer initiative is campaign finance reform, which the activists see as a key stumbling block to restoring voting rights and achieving their other racial justice goals.</p>
<p>"It's hard to have a conversation about protecting voting rights when you literally have moneyed interests buying opposition to the right to vote," Brooks told Truthout. "What we have now are basically poll taxes and literacy tests of a bygone era being fueled by money in politics."</p>

“Punks for Positivity” Group Rebuilds Neglected Community Garden

<p>In York, Pennsylvania a group of “punks” have joined together to help rebuild an overgrown community garden that has been neglected since a license agreement with a local church expired. The group calls themselves <a href="https://www.facebook.com/Punksforpositivity" target="_blank">“Punks for Positivity”</a> and they also clean up trash in various areas of the city, in addition to their recent community garden project.</p>
<p><em>“It’s not run well now, but it was formerly one of our most productive community gardens,</em>” David Cross, chairman of the RDA board <a href="http://www.yorkdispatch.com/breaking/ci_28854586/punks-taking-over-york-city-community-garden" target="_blank">told the York Dispatch.</a></p>
<p>Founders Steve Klinedinst and Dustin Hildebrand said that they will soon be opening up a produce stand at the garden, and will sell produce for as cheap as possible, and use the money to make the garden even better. Since starting on the project, they have had almost 25 different volunteers from the community who have wanted to get involved.</p>
<p>“<em>As soon as people saw us (cleaning up an area), they started coming out,”</em> Klinedinst said.</p>
<p><em>“That area gets a bad rap. We want people to see something good coming from there. If people see that, maybe they won’t be as quick to judge the people living in that area,”</em> he added.</p>
<p>Klinedinst’s said he started the organization to help change the negative stigma that is often assigned to people who dress differently, or belong to a sub-culture that is outside of the mainstream, and to help bring the community together.</p>

<p>George Zimmer, founder of Men’s Wearhouse recently admitted to be a regular marijuana smoker, and called the plant’s prohibition, “the biggest con ever perpetrated.”</p>
<p><a href="http://www.cnbc.com/2015/09/18/mens-wearhouse-founder-comes-out-in-favor-of-pot-legalization.html" target="_blank">During an interview with CNBC</a> Zimmer sarcastically said, <em>“I’ve been smoking marijuana on a regular basis for about 50 years. As you can see, it’s really impacted me in a negative way.”</em></p>
<p>Zimmer has even been delivered a speech at the recent Cannabis World Congress & Business Expo in Los Angeles and has gone public with his support for marijuana legalization.</p>
<p>During his speech, Zimmer told the audience that <em>“Everybody in the country knows what the truth here is, except the 535 people we elect to make these decisions in Washington, D.C., It’s astounding.”</em></p>
<p>He pointed out the insanity of marijuana’s schedule 1 status, which rules that it is just as dangerous as heroin, saying that “<em>It’s treated like it was heroin, everybody’s who is in high school hears that and goes, ‘What are they talking about?'” The emperor’s not wearing any clothes. This is the biggest con that has been perpetrated on this country in the last century.”</em></p>
<p>Zimmer also mentioned how important it is to be careful about the regulations that the government attempts to put on marijuana once it is finally legalized.</p>
<p><em>“I think it’s important that we protect limited home cultivation without any government licensing, so whether it’s one plant or 10 plants, I don’t know, but I think that’s very important,”</em> he said.</p>
<p>He also discussed the many issues with taxations involved in the growing marijuana industry.</p>
<p><em>“There are still a lot of questions that are raised in terms of dispensaries, and the way the IRS does not allow normal business deductions,”</em> he said.</p>
<p>Zimmer broke from Mens Warehouse a few years ago and began starting up and investing in new businesses.</p>

<p>Overall, of the 113 bills introduced that would restrict voting rights in the 2015 session, six bills in five states have moved in the legislature, being either referred to committee or voted on, and one bill has been enacted. North Dakota passed a bill this session amending its current voter identification law so that now only four forms of ID are allowed at the polls. The bill originally allowed voters to use bills, bank statements and change-of-address forms to prove residency, as well as a college-issued photo ID.</p>
<p>Additionally, court battles are continuing to play out over voting restrictions in at least three states: Arizona, North Carolina and Texas. In August, the Fifth Circuit Court of Appeals ruled that Texas' voter identification law violates Section 2 of the VRA because the law discriminates against Black and Latino voters. But the state has since appealed, filing a petition arguing that if Section 2 does make Texas' voter ID law illegal, then Section 2 is unconstitutional.</p>
<p>Another issue the NAACP is focusing on in the #JusticeSummer initiative is campaign finance reform, which the activists see as a key stumbling block to restoring voting rights and achieving their other racial justice goals.</p>
<p>"It's hard to have a conversation about protecting voting rights when you literally have moneyed interests buying opposition to the right to vote," Brooks told Truthout. "What we have now are basically poll taxes and literacy tests of a bygone era being fueled by money in politics."</p>

<p>At a DoubleTree Hotel in Durham, N.C., in May 2014, Dr. Robert M. Califf gave a presentation to a group of biomedical researchers, lawyers and industry experts. He spoke about ways to quicken the pace of biomedical innovation by transforming research. Toward the end he showed a slide that noted one barrier: regulation.</p>
<p>It was just a passing reference, barely noticed by the small group in the room. But now, after President Obama nominated Dr. Califf on Tuesday to become the next commissioner of the Food and Drug Administration, his thoughts on the subject are suddenly taking on importance.</p>
<p>Dr. Califf, a cardiologist, is a renowned clinical researcher who has deep respect for the system in which he works, and no one who knows him thinks he wants to weaken the regulatory agency he has been chosen to lead. But he has deeper ties to the pharmaceutical industry than any F.D.A. commissioner in recent memory, and some public health advocates question whether his background could tilt him in the direction of an industry he would be in charge of supervising.</p>
<p>The answer is important because, if confirmed, Dr. Califf will be steering a vast and powerful federal agency that regulates about a quarter of every dollar spent in the United States. It is at the center of some of the most difficult health policy questions facing the country. A crucial decision on how to regulate electronic cigarettes is expected this fall, and Congress is halfway through a substantial overhaul of the way the agency approves drugs and medical devices.</p>
<p>While the previous commissioner, Dr. Margaret A. Hamburg, a former top health official in New York City, came from the field of public health, Dr. Califf ran a multimillion-dollar clinical research center at Duke University that received more than 60 percent of its funding from industry.</p>
<p>He has written scientific papers with pharmaceutical company researchers, and his financial disclosure form last year listed seven drug companies and a device maker that paid him for consulting and six others that partly supported his university salary, including Merck, Novartis and Eli Lilly. A conflict-of-interest section at the end of an article he wrote in the European Heart Journal last year declared financial support from more than 20 companies.</p>
<p>“In a sense, he’s the ultimate industry insider,” said Daniel Carpenter, a Harvard political science professor who has written extensively about the F.D.A.</p>
<p>Sanofi and Amgen are among the companies Dr. Califf has advised, in their case on costly new cholesterol-lowering drugs that the agency approved just this summer.</p>
<p>Through the F.D.A., where he has served as a deputy commissioner since March, Dr. Califf declined a request for an interview. A spokesman for the Department of Health and Human Services, Kevin Griffis, said that Dr. Califf had been through “a comprehensive screening process for conflicts of interest,” and that officials had “put in place measures to ensure that he is appropriately recused from matters that would give rise to conflicts,” including the new cholesterol medicines.</p>
<p>Mr. Griffis said Dr. Califf had been donating all his consulting fees to nonprofits since the mid-2000s. According to PharmaShine, a database of payments to health care professionals, and the federal government’s Open Payments database, Dr. Califf received about $215,000 in consulting fees from 2009 to early 2015.</p>
<p>A résumé studded with industry funding is not unusual in academic medicine, Dr. Califf’s supporters note. Doctors are paid consulting fees all the time, and universities routinely conduct clinical trials on behalf of companies. Those contracts help support university researchers’ salaries, a standard practice. Many emphasize that it does not imply an inherent conflict.</p>
<p>His supporters contend that Dr. Califf’s vast experience in the clinical science world could be a major asset in his new post.</p>
<p>“Drug companies fund a lot of clinical trials, and he’s a world-renowned trials expert,” said Dr. Aaron S. Kesselheim, the director of the Program on Regulation, Therapeutics and Law at Brigham and Women’s Hospital in Boston. “The question is whether he can transcend those relationships as commissioner and advocate for a strong F.D.A.”</p>
<p>Supporters and former colleagues say Dr. Califf’s background makes him perfectly suited to the job of commissioner. He has spent years improving the way clinical trials are conducted, coming up with groundbreaking trial designs for medicines against blood clots.</p>
<p>“His integrity in scientific matters is impeccable, and his innovation in clinical trial design is legendary,” said Dr. Steven Nissen, a cardiologist at the Cleveland Clinic, who has been an outspoken critic of both the F.D.A. and drug companies.</p>
<p>Dr. Califf is often in the gym on the StairMaster before 6 a.m., said a former colleague at Duke, Dr. Adrian Hernandez. He often invites younger doctors to join him in golf and has a passion for Duke basketball that he expresses by wearing the team colors on game days.</p>
<p>Dr. Califf founded and ran the Duke Clinical Research Institute, a $200 million center that manages clinical trials in more than 65 countries involving more than 1.2 million patients. Supporters say that management experience should serve him well at the helm of the drug agency, which oversees everything from prescription drugs and pacemakers to peanut butter and pet food.</p>
<p>But his position at the institute, whose budget is 37 percent government grants and 63 percent from the private sector, has also caused some concern.</p>
<p>“He has amassed an extensive record of close collaboration with industry, through consulting fees, speaking fees and research grants supporting his salary,” said Dr. Michael Carome, the director of the health research group at Public Citizen, a consumer advocacy group. “This will color his views when it comes to making regulatory decisions.”</p>
<p>Dr. Califf’s supporters say he has taken many positions against the interests of industry, for example pushing for the right to publish any result without companies reviewing — or approving — the manuscript first, as they often want to do.</p>
<p>“This is a long-held, steadfast position that has cost his groups research in the past,” said Dr. Robert Harrington, a professor and the chairman of the department of medicine at Stanford, who worked with Dr. Califf at Duke.</p>
<p>(A spokeswoman for the Duke Clinical Research Institute said the funder or sponsor is given a period of time to respond to the results, but has no rights over what is published.)</p>
<p>“He was really passionate about ensuring we were independent,” Dr. Hernandez said. “I’ve seen plenty of times when a company wanted to do something in a certain way and his answer was no.”</p>
<p>Dr. Califf had been mentioned for the commissioner’s post in the past and has been popular among Republicans but not Democrats (though he is a registered Democrat). His selection now is seen as a sign that the president has little stomach for a confirmation fight in a Republican-controlled Senate during a bitter period between the parties. Liberal Democrats have been largely silent on his nomination so far.</p>
<p>Dr. Califf’s slide show in North Carolina was titled “Disrupting Clinical Research: Transforming a System.” It said the drug and device development system was in crisis, and included a downward-sloping chart that illustrated the number of drugs approved per billion dollars spent on research over time.</p>
<p>“Regulation provides barrier to disruptive innovation,” said the second-to-last slide, called “Disruptive Innovation in Health Care.”</p>
<p>Mr. Griffis, the Department of Health and Human Services spokesman, said Dr. Califf was using the slide as a means of “identifying the challenge and the tension inherent in the F.D.A.’s charge” between encouraging innovation and protecting the public’s health. He said the slide was not a suggestion to deregulate — far from it.</p>
<p>“Dr. Califf doesn’t think of regulation as a zero-sum game, where either the F.D.A. or industry wins,” he said.</p>
<p>Professor Carpenter said he believed it was too early to tell what kind of commissioner Dr. Califf would be. “How does he think? We won’t know until we see how he behaves,” he said.</p>
<p>As for the slide: “I think it illuminates his thinking.”</p>

<p>Over the past month, trade officials have been frantically working to resolve outstanding disagreements over provisions in the Trans-Pacific Partnership (TPP) in the midst of speculation that the deal is in deep trouble. At this late stage of negotiations, the U.S. Trade Representative (USTR) has pretty much abandoned all remaining pretense of transparency in its consideration of these remaining policy issues. Since the failure to conclude the deal at the meeting in Hawaii over the summer, the USTR has held several closed-door meetings between high-level officials to finalize the agreement and it is under intensifying pressure to finish it off as soon as possible.</p>
<p><strong>Trade Officials Continue to Meet Secretly</strong></p>
<p>In mid-August, there was a week-long meeting in Mexico to do a “legal scrub” of the TPP text, in order to have the text ready to go for an eventual signing. Toward the end of August, officials from Canada and Mexico went to Washington to continue discussions, likely around auto trade issues. And this week the USTR met with Vietnam’s National Assembly along with corporate representatives of one of several trade advisory committees, with some other meetings taking place between Japan, Canada, and Mexico, also regarding auto trade.</p>
<p>U.S. officials seem confident that they can conclude before the end of the year. Undoubtedly, they are under mounting pressure from the impending federal elections in Canada, Japan, and the United States’ presidential election season looming on the horizon. The Japanese trade minister claims that it will need to be concluded before the end of September, stating that otherwise it will be difficult to continue talks as Canada heads into its general election in October.</p>
<p>The latest reports say that the U.S. is seeking another high-level ministerial meeting in late September, on the margins of a session of the UN General Assembly meeting in New York. Though it seems slim, there is a possibility that they could announce the TPP’s conclusion at that meeting. If the USTR does, President Obama would need to give 90-days notice to Congress before he could officially sign it—a provision stipulated by the Fast Track trade legislation that passed this summer. From there, he would still need to convince Congress to actually ratify the agreement in order for it to become binding on the United States. So even if they’re able to come to full agreement on the TPP the end of this month, it’s legally impossible for them to get the ratification they need to completely finish the deal by the end of this year.</p>
<p>And all the while, the U.S. is still trying to convince the public of the TPP’s merits and repair the USTR’s image as being a secretive, corporate-captured agency.</p>
<p><strong>USTR’s New "Chief Transparency Officer"</strong></p>
<p>The USTR has appointed one of its own leading lawyers, Tim Reif, as its new chief transparency officer, a position mandated by the recent Fast Track bill. According to the USTR’s Michael Froman, his role is to make “trade negotiations more accessible and transparent to the public and their representatives in Congress.” Some lawmakers have raised concerns that this official will only act to worsen the agency’s public engagement practices with more bureaucratic obstruction. “If it desired, USTR could grant greater access immediately, without fancy titles,” said Rep. Lloyd Doggett of Texas.</p>
<p>We share Rep. Doggett’s skepticism, and have strong doubts that this officer will bring about meaningful reforms to the trade negotiation process—but of course, we hope to be proven wrong. At the very least, it would be a welcome change to see the USTR regularly disclose accurate, specific descriptions of its policy proposals. However, that would hardly be enough. Anything short of mandating the full publication of draft texts of the agreement following each negotiation round, providing ample opportunities for public participation into the process, and introducing transparency to how the USTR arrives at their policy priorities, would be inadequate to produce the kind democratic, public interest-driven policies we need to have in the 21st century.</p>
<p><strong>Public Opposition to the TPP Still Grows</strong></p>
<p>Civil society groups and advocates have meanwhile continued the fight against the TPP. In New Zealand, thousands of people went to the streets to protest the TPP, as other leading advocates have filed a legal challenge over the government’s refusal to release documents relating to the agreement. A group of Japanese health advocates, including eight lawmakers and 157 lawyers,are also suing their government, on the grounds that the deal is unconstitutional and a danger to public health. The TPP’s Copyright Trap, which is an EFF campaign to fight back against the agreement’s 20-year retroactive copyright term extension, succeeded in directing hundreds of messages to TPP negotiators to resist the United States’ copyright maximalist demands. Our U.S. action to petition the Register the Copyrights to reaffirm its commitment to balanced policy has garnered thousands of signatures.</p>
<p>It’s hard to tell what’s next for the agreement. We know that trade officials are determined to conclude it as soon as possible even as public opposition has grown worldwide. In the meantime the Asian TPP nations have shifted their focus to another atrocious trade deal, the Regional Comprehensive Economic Partnership (RCEP), which may contain provisions that are even worse than the TPP. The fact that RCEP contains terrible copyright rules, even though it isn’t U.S.-led (and therefore not captured by Hollywood), goes to show how opaque trade agreements are a bad way to decide digital policy, regardless of who is behind them.</p>
<p>As the shape of TPP’s future comes into focus, we’ll maintain a close eye on any new developments. If the USTR manages to finalize the terms of this deal, that’s when we’re going to have to do everything in our power to stop it from getting signed or ratified.</p>
